1877 Improve Park Street1 T PA Y 343 ORDINANCE NO. _1877, (Published in the Salina Evening Journal September _1� , 1915.) 1 F1 1 1 An ordinance providing for the paving, curbing, guttering and exca- vating of Park Street in the city of Salina, Kansas, between the west side of Ninth Street and the right-of-way of the Mis- souri Pacific Railway Company, and providing for the cost there- of and the manner of payment. WHEREAS, by resolution duly adopted on the 2nd day of August, 1915, the Mayor and Council declared that it was necessary to pave, Park Street within the limits above and hereinafter defined; and, WHEREAS, said resolution was published for more than five con- secutive days in the Salina Evening Journal, a daily newspaper pub- lished in the City of Salina; and, WHEREAS, a majority of the resident owners of property liable to -assessment and taxation for the cost of said improvements did not, within twenty days from the last publication of such resolution file with the city clerk of said city their protest against such improve- ments or the making thereof; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: gection 1. It is necessary and,hereby ordered that Park Street, in the city of Salina, Kansas, between the west side of Ninth Street and the right-of-way of the Missouri Pacific Railway Company, be paved with such material as the mayor and council may hereafter designate and select, as hereinafter provided, according to the specifications of the city engineer of said city hereinafter provided for, said street to be paved for such a width as the mayor and council may herafter de- termine; Provided, that at the intersections of streets and alleys such paving shall return to the lot line of said street so improved. Sec. 2. It is necessary and hereby ordered that said Park Street, between the limits defined in Sect ion one hereof, be curbed and gut- tered on both sides thereof with cement curb and gutter, according to the specifications of the city engineer of said city, hereinafter pro- vided for, the curb part thereof to be six inches in thickness and the gutter part thereof to be thirty inches, more or less, from the back edge of such curb to the paving line of said street and the lot line edges of such curbing shall be set such a distance from the center line of said street as the mayor and council shall hereafter determine; Provided, that at the intersections of streets and alleys said curb and gutter shall return to the lot line on said street improved. Sec. 3. For the work and improvement herein provided for, the city engineer of Salina shall make and file with the city clerk, on or before the 20th day of September, 1915, complete plans and specifi- cations for the paving of said street with vitrified vertical fiber side wire out brick paving block pavement all on a five inch concrete base with asphalt filler for such pavement, and for curbing and guttering of said street with cement curb and gutter, substantially as hereinbefore described; and on or before said last named date acid city engineer shall file with the city clerk estimates of the cost of such curb and gutter and of such paving and excavating of such street with the kind of paving material aforesaid. Sec. 4. That after such plans -and specifications shall have been made and prepared by the city engineer and filed with the city clerk as aforesaid, the mayor and council may advertise for the reception of bids for the paving of said street with the kind of street paving materi- al named and specified in the preceding section. hereof, and for the curbing and guttering of said street, and for the excavation of said street, andafter the receipt of such bids - or proposals the mayor and council shall, and they are hereby authorized to let a contract for the paving of said street with the material specified in Section three (3) hereof, and for the curbing and guttering of said street., and for the excavation of said street to the most satisfactory and responsible bid- -der for the kind and character of pavement above specified, said mayor and council reserving the right to -let the contract or contracts for the paving and excavating separately from the curbing and guttering or to let the contract for all such improvements to one party, and to re - jest any and all bids. Sec. 5. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested householders, who after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation and assessment for the for the costs of the improvements herein provided for, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to assessment and taxa- tion, as aforesaid, without regard to the buildings or improvements thereon, aiid after making said appraisement shall return the same to the mayor and council at the first meeting thereof after such appraise- ment shall have been completed, and after said appraisement is returned to the mayor and council, said mayor and council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper; and at such special seesion the 1 ii 1 1 1 the mayor and council shall, if they deem it just and proper, alter or change such appraisement. Sec. 6. For the purpose of paying for the work and improvements in this ordinance provided for, the mayor and council are hereby auth- orized and directed to issue bonds of the city of Salina in an amount not to exceed the cost of such improvements and to run for a period of ten years and payable in ten equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas, and for the purpose of paying principal and interest of said bonds as they severally become due and payable the mayor and council shall by ordin- ance appodtion and assess against. the lots and pieces of ground in the taxing district of.such improvements special assessments covering the cost -of said improvements and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvements. Such assess- ment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the tax - Ing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annually at the same time other taxes are to be certified, certify to the county clerk of Saline county, Kansas, a full list of all proper- ty liable for the cost of such work and improvements, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and the interest on all unpaid balances for one year at the rate of five per cent per annum, and such amount so certified shall be collected as other taxes are collected; Provided, that for the purpose of defray - Ing the cost of improving the squares and areas formed by the crossing of streets and alleys as well as where the improvements is through or adjacent to property of the city, for which the city would be liable, the assessments shall be made against all the taxable property of the City. Sec. 4. That after such plans and specifications shall have been made and prepared by the city engineer and filed with the city clerk as aforesaid, the mayor and council may advertise.f or the reception of bids for the paving of said street with the kind of street paving material named and specified in the preceding section hereof, and for and for the excavation of said street the curbing and guttering of said street and after the receipt of such bids or proposals the mayor and council shall and they are here- by authorized to let a contract for the paving of said street with the material specified in Section three (3) hereof, and for the curb - and for tth ex vat i o o sad e ing and guttering of said street, to to mos s tisracgtb hand respon- sible bidder for the kind and character of pavement above specified, said mayor and council reserving the right to let the contract or con- tracts for the paving and excavating separately from the curbing and guttering or to let the contrast for all such improvements to one party, and to reject any and all bids. 0 Sec. 5. Such assessment and apportionment ordin- ance shall contain the.total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall. state the number of annual installments in which such tax is to be collected; 0 _0 0 and thereafter the city clerk shall annually at the same time other taxes are to be certified, certify to the county clerk of Saline county, Kansas, a full list of all property liable for the cost of such work and improvements, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and the interest on all unpaid balances for one year at the rate of five per cent per annum, and such amount so certified shall be collected as other taxes are collected; Pro- vided that for the purpose of defraying the cost of improving the squares and areas formed by the crossing of streets and alleys as well as where the improvements is through or adjacent to property of the city, for which the city would be liable, the assessments shall be made against all the taxable property of the City.
