1876 Improve State Street-340 ORDINANCE NO. 1876 - - 1�, %I iQ'hori in 4.1-%ro C,'nl inn Rw anincr Jnnrnnl So_r&.aTnhwP %%x 1 A1FR _ 1 An ordinance providing for the curbing and guttering of State Street on both sides thereof, between the -east line of the right of way of the Missouri Pacific Railway Company and the west line of College Avenue; Mulberry Street-, on both sides thereof between the east line of Santa Fe Avenue and the west side of Second Street; Walnut Street on both sides` thereof, between the east line of the right of way of the Missouri Pacific Railway Company and the west line of College Avenue; Chicago Street on both sides thereof, between thenorth line of Walnut Street and the south line of State Street; and State Street, on the south side thereof, between the west line of Railroad Street and the east line of Olive Street, all in the City of Salina, Kansas. WHEREAS, by resolutions duly adopted on the 2nd day of August, 1915, the Mayor and Council of the city of Salina, Kansas, have de- clared that they deemed it necessary to curb and gutter the above named streets within the bounds above set forth; and, WHEREAS, said resolutions were published for five (5) consecu- tive days in the Salina Evening Journal, a daily newspaper published in the City of Salina; and, WHEREAS, a majority of the resident owners of property liable to assessment and taxation for the cost of such curbing and guttering of such streets did not, within twenty days after the last publica- tion of said resolutions, file with the City Clerk of said city their protest against such improvements or the making thereof, on any of such streets; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that State Street, in the City of Salina, Kansas, between the east line of the right-of-way of The Missouri Pacific Railway Company and the west line of College Avenue be curbed and guttered on both sides thereof; that it is necessary and hereby ordered that Mulberry Street in the City of Salina, Kansas, between the east side of Santa Fe Avenue and the west side of Second Street, be curbed and.guttered on both sides there- of; that it is necessary and hereby ordered that Walnut Street, in the City of Salina, Kansas, between the east line of the right -of -way of the Missouri Pacific Railway Company and the west line of College Avenue, be curbed and guttered on both sides thereof; that it is necessary and hereby ordered that Chicago Street, in the City of Salina, Kansas, be- tween the north side of Walnut Street and the south side of State Street, be curbed and guttered on t-obh sides thereof; that it is necessary and is hereby ordered that State Street, in the city of Salina, Kansas, be- tween the west line of Railroad Street and the east line of Olive Street be curbed and guttered on the south side thereof, all of such streets to be curbed and guttered with cement curbing and guttering, according to the specifications of the city engineer of said city 1 1 1 1 1 -T PAY 341 hereinafter provided for, the curb part thereof t•o be six inches in thickness and the gutter part thereof to be forty-two (42) inches from the back edge of such curb to the paving line of said street, and the lot line edges of such curbing shall be set such distances from the center lines of said streets as the Mayor and Council may hereafter designate. Sec. 2. For the work and improvement herein provided, the city engineer shall make and file with the city clerk of said city, on or before the 20th day of September, 1915, plans and specifications for the curbing and guttering of said streets with cement curb and gutter of the dimensions, substantially, as hereinbefore described, and on J or before the last named date the said city engineer shall file with the said clerk an estimate of the cost of such curbing and guttering. Sec. 3. That after such plans and specifications shall have been made and filed with the city clerk as aforesaid, the mayor and coun- oil shall determine the distance such curb and gutter shall be set from the center lines of said streets, and may then advertise for bids for the construction of such improvements, and may, after the receipt of such bids, let the contract for such improvements to the most satisfact- ory and responsible bidder or bidders as determined by said Mayor and Council; or said Mayor and Council may reject any and all bids for the making of said improvements. sec. 4. After the passage and publication of the ordinance the Mayor and Council shall appoint three•disinterested householders, who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation and assessment for the cost of the improvements herein provided for, shall, within ten days after having been notified of their appointment proceed to apparise said lots and pieces of ground liable to assessment and taxation for the making of said improvements herein provided for, without regard to the buildings or improvements thereon, and after making said appraise- ment shall return the same to the mayor and council at the first regular meeting thereof after the completion of such appraisement, and after such appraisement is returned to the mayor and council, the said mayor and council shall designate a t ime for holding a special meeting for the purpose of hearing complaints and equalizing said appraisement, of which special meeting due notice shall be given in the official city paper; and at said special meeting the mayor and council shall, if they deem it just and proper, alter or change such appraisement. 342 Sec. 5. For the purpose of paying for. the work and improve- ments in.this ordinance provided for, the mayor and council are hereby authorized and directed to issue bonds of the City of Salina in an amount not to exceed the cost of such -improvement , and to run for a period of not exceeding four years and to be payable in not exceeding four equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be payable at the fiscal agency of the State of Kansas; and for the purpose of payint the principal and inter- est of said bonds as they severally become due and pyable the mayor and council shall apportion and assess against the lots and pieces of ground within the taxing districts of such improvements special assessments covering the cost of such improvements, and the apportionment therein contained shall hold good for all the installments that are to be col- lected from the specific property chargeable for the making of said improvements. Such assessments'and apportionment ordinance shall con- tain the total amount of tax apportioned to each tract, piece and par- cel of ground within such taxing districts and shall state the number of annual installments in which said tax is to be collected; and there- after the city clerk shall annually, at the same time that other taxes are to be certified, certify to the county clerk of Saline County, Kan- sas, a full list of all property liable for such work and improvements, together with the respective amounts due on each of said tracts, pieces an parcels of land, which amount shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent. per annum, and such amounts so certified shall be collected as other taxes are collected; Provided that for the cost of improving the squares and areas formed by the crossing of streets and alleys,as well as where the improvement is through or adjacent to the property of the City, for which the city would be liable, the assessments shall be made against t1l the taxable property of the City., Sec. 6. For the purpose of paging for the, work and improvements in this ordinance provided for, the mayor and -council are hereby.authorized and directed to issue bonds of the City of - Salina in an amount not to exceed the cost of such improvement, and to run.for a perioa� of not exceeding U4 years and to be payable in not eeeding equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall: be payable at,. the -fiscal agency of the State of 4an86s; and for the purpose of paying the principal and.interest of said bonds as they severally become due and payable the mayor and council shall apportion and., assess against the lots and pieces of ground within the taxing districts of such improvements special assessments covering the cost of such improvements, and the apportionment therein contained shall held good for all the installments that are to be collected from the specifie property chargeable for the making of said improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each traat,pAece and parcel.of ground within such taxing districts and shall state the number of annual installments in which said tax is to be collected and thereafter the city clerk shall annually, at the same time thak other taxes are to be certified, certify to the county clerk of Saline County,Zansas, a full list of 0 all property liable for such work and improvements, together with the - respective amounts due on each of said tracts,pteoes and parcels of land, which amount shall include the annual installments and interest on all unpaid bal4nces for one year at the rate of not to ex4eed five per cent per annum, and such amounts so certified shall be collected as other taxes are collected; Provided that for the cast of improving the squares and areas formed by the crossing of streets and alleye� as well as where the improvement is through or adjacent to the property of' the city, for which the city would be !iabl,e, the assessments ehall be made against all the tax§ble property of the city.
