1875 Improve College AvenueTPAy 11 1 1 337 -- ORDINANCE --NO.. - _1$75 An ordinance providing for the paving, curbing, guttering and excavat- ing of College Avenue, in the city of Salina, between the north line of Ash Street and the south line of Park Street, specifying the manner of construction, providing for the cost thereof and the manner of payment, and letting the contract therefor. WHEREAS, a petition has been presented to the mayor and council requesting said mayor and council to pave, curb,. gutter and excavate College avenue between the limits hereinbefore and hereinafter defined; and, WHEREAS, said petition has been examined and found to contain the names of a majority of the resident owners of real property liable to taxation and assessment for said improvements; therefore, Be it ordained by the Mayor. and Councilmen of the City of. Salina: Section 1. It is necessary and hereby ordered that College Aven- ue, in the city of. Salina;. Kansas, between the north line of Ash Street and thea south line of Park Street, , be paved with ' asphalt ic-concrete pav- ing material, as more particularly hereinafter described, said pavement to be thirty -,three (33) feet in "width, from gutter to gutter, and all excavating, rolling and filling necessary for the proper construction of such ._paving shall be done, and such paving shall be laid and con- structed on the established grade of said street. Sec.. 2. It is necessary and hereby ordered that said College Avenue, between the limits defined in section one hereof, be curbed on both sides thereof with cement curb and.guttered on both sides thereof with cement gutter, such curb to be .six inches in thickness and such gutter .to be twenty-four inches in width, and the lot line edge of such curb shall be set nineteen feet from and parallel with the center line of said'.street . .Sec.'3.- Such street shall be paved with Bermudas Lake asphaltic- conerete,paving.material, on a five inch concrete base, and according to the. specifications for the paving, curbing and guttering of Ash street -between College avenue and Railroad street adopted and approved by the mayor and.'council on the 3rd day of May, 1915, which such speci- ficatisms Jor-the improvements herein are hereby adopted and approved as the specifications for said College avenue between Ash and Park Streets and are hereby made a part of this ordinance. Sec. 4. A contract is hereby let to Watts & Amerman for, the Paving and 'excavating of said College avenue, at and for the following prices, to -wit: for the paving of said street, with the paving material specified in the preceding section, laid on a five -inch concrete base, as specified, one and 40/100 Dollars, ($1.40) per square yard, and for the ..excavating on said street thirty-three cents per cubic yard, and for the curbing and guttering of said street, as specified, fifty- two cents per lineal foot; which such prices are hereby found to be less than the estimated cost of such improvements as made by the city engineer of said city and now on file with the city clerk. Sec. 5. kfter the passage and publication of this ordinance the mayor and council shall appoint three disinterested appraisers who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment for the cost of said improvements, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground, accord- ing to law, and, after making said appraisement, shall return the same to the mayor 'and council at the first meeting thereof after such appraise- ment shall have been made and completed, and after said appraisement is returned the mayor and council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper; and at such special session the mayor and council shall, if they deem it just and proper, alter or change such appraisement. Sec. 6. For the purpose .of paying for the improvements in this ordinance specified the mayor and council, are hereby authorized to issue bonds of the city of Salina, in an amount not to exceed the cost of such improvements, and to run for a period 4.Dt to exceed ten years and payable in equal installments each year togeUier with interest not to exceed five per cent per annum, which bond -shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become due the mayor and council shall by ordinan-ce apportion and assess against the lots and pieces of ground in --the taxing district of such improvements special assessments covering the cost of said -'improvements.. and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with the cost of such improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned.to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such'tax is to be collected; and thereafter the city clerk shall annually, at the same time other taxes are to be certi- fied, certify to the county clerk of Saline county, Kansas, a full list of all property liable for the cost of such work -and improvements to- gether with the respective amounts due on each of such tracts, pieces and parcels of land, which amount shall include the annual installments and the interest on all unpaid balances for one year at the rate of five 1 1 1 1 1 1 1 per cent per annum, and such amount so certified shall be collected as other taxes are collected.
