1868 Improve Ash Streeti Pel Y 323 ORDINANCE NO. 1868. (Published in the Salina Evening Journal Aug. ��. 1915.) An ordinance providingfor the curbing and guttering of East Ash Street, in the city of alina, Kansas, from the east line of Fourth Street to the west line of Ohio Street, and providing for the cost thereof and the manner of payment. WHEREAS, by resolution duly adopted on the 3rd day of May, 1915, the Mayor and Council of the city of Salina, Kansas, have declared that they deemed it necess ary to curb and.gutter East Ash Street in said City from the east line of Fourth Street to the west -line of Ohio Street, and, WHEREAS, said resolution was published for more than five conse- cutive days in the Salina Evening Journal, a daily newspaper published in the City of Salina; and, WHEREAS, a majority of the resident owners of property liable to assessment and taxation for the cost of such curbing and guttering of such street did not, within twenty (20) days from the last publication of such resolution, file with the city clerk of said city their protest against such improvements of the making thereof; therefore, $e it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that East Ash Street, in the city of Salina, from the east line of Fourth Street to the west line of Ohio Street, be curbed and guttered On both sides thereof with cement curbing and guttering, according to the specifica- tions of the city engineer of said city hereinafter provided for, the curb part thereof to be six (6) inches in thickness on the top, and the gutter part thereof to be six (6) inches in thickness next to the curb, and eight (8) inches in thickness next to the paving, and forty-two (42) inches in width from the back edge of such curb to the paving line of said street, and the lot line edges of such curbing shall be set a distance from the center line of said street, as the mayor and coun- cil may hereafter determine. Sec. 2. For the work and improvement herein provided, the City Engineer, shall make and file with the city clerk of said city, on or before the sixth (6th) day of September, 1915, plans and specifications for the curbing and guttering of such street with cement curb and gut- ter, of the dimensions, substantially, as hereinbefore described, and on or before said last named date, said city engineer shall file with the said clerk an estimate of the cost of such curbing and guttering; Provided that at the intersections of streets and alleys said curb and gutter shall return to -the lot line on said East Ash Street - Sec. 3. That after such plans and specifications shall have, been filed with said clerk as aforesaid, the mayor and council shall - determine the distance such curb and gutter shall be set from the cen- ter line of said street, and may then advertise for bids for the con- struction of such improvements, and may, after the receipt of such bids, let the contract for such improvements to the most satisfactory and responsible bidder, as determined by said mayor and council; or the said mayor and council may reject any and all bids for the making of such improvements. mi. Sec. 4. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested householders, who, after having taken an oath. to faithfully and impartially appraise all lots and pieces,of ground liable to taxation and assessment for the cost of the improvements herein provided for, shall, within thn days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to assessment and taxation, as aforesaid, without regard to the buildings or improvements thereon, and after making said @)ppraisement shall return the same to the mayor and council at the first meeting thereof after such appraisement shall have been completed, and after said appraisement is returned to the mayor and council the said mayor and council shall desigante a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper; and at said special session the mayor and council shall, if they deem it just and proper, alter or change such appraisement. Sec. 5. For the purpose of paying for the work and improvements in this ordinance provided for, the mayor and council are hereby author- ized and directed to issue bonds of the city of. Salina in an amount not to exceed the contract price and cost of such improvement, and to run for a period of not exceeding ten years and be pyaable in not exceeding ten equal dnnualTinstallments, together with interest not to exceed five per cent {50} per annum, which bonds shall be payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become.due and payable that mayor and council shall apportion and assess against the lots and pieces of ground within the taxing district of such improvements special assess- ments covering the cost of such impr6v6ment, and the apportionment there - .in contained shall hold good for all the installments that are to be col- lected.from the specific property chargeable with said improvement. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annually, at the same time as other taxes are to be certified, certi- erti-fy fyto the county clerk of Saline county, Kansas, 'a full list of all pro-. perty liable for such work and improvement, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of five per cent per annum, and such amounts so certified shall be collected as other taxes are collected; Provided, that for the purpose of defraying the cost of improving the squares and areas formed by the crossing of streets and alleys, as well as where the improvement is through or adjacent to property of the city, for which the City would be liable, the assessments shall be made against all the taxable property of the City.. That after such plans and specifications shall have been filed with said clerk as aforesaid, the mayor and council shall deter- mine the distance such curb and gutter shall be set from the center line of said street, and may then advertise for bids for the construc- tion of such improvements, and may, after the receipt of such bids, let the contract for such improvements to the most saltisfactory and re- sponsible bidder as determined by said mayor and council; or said mayor and council may reject any all bids for the making of such improvements. Sec. 4. For the purpose of paying for the work and improvements in this ordinance provided for, the mayor and council are hereby author- ized and directed to issue bonds of the city of Salina in an amount not to exceed the contract price and cost of such improvement, and to run for a period of not exceeding ten years and be payable in not exceeding ten equal annual installments, together with interest not to exceed five per cent per annum, which bonds .shall be riade payable at the fiscal age*, cy of the State of Kansas; and for the purpose of paying principal and -3- interest on said bonds as they severally become,due and payable that mayor and council shall apportion and assess against the lots and pieces of ground within the taxing district of such improvements special assess menta covering the cost of such improvement, and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvement Such assessment and apportionment ordinance shall.contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annually, :'at the same time as other taxes are to be certified, certify to the county clerk of Saline county,, Kansas, a full list of all pro« perty liable for such Work and improvement, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amount shall include the annual installments and interest on all unpaid balances (for one. year at the rate of five per cent per annum, and such amounts so certified shall be collected as other taxes are collected; Provided, that for thepurpose of defraying the cost of improving the squares and areas formed by the crossing of streets and alleys, as well as where the improvement is through or adjacent to property of the city, for which the city would be liable, the assessments shall be made agains all the taxable property.of the city.
