An ordinance providing for the construction of certain sewers in the
City of Salina,. -Kansas; letting the contract therefor;
and providing for the payment of the cost of the same.
WHEREAS, plans and specifications for certain sewers hereinafter
described have been made and prepared by the City Engineer and have
been approved by the Mayor and Council; and,
WHEREAS, bids for the construction of such sewers have heretofore
been advertised by the said city and are now on file with the City
Clerk; therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That the Mayor \and Council deem it necessary and here-
by order that the following described sewers be built and constructed ,
and the following catchbasins be re -located, and re -constructed in the
City of Salina, Kansas, to -wit: -

1. A ten (10) inch sewer in the alley between Penn Avenue and
Columbia Avenue running north from Elm Street in the center of said alley
to the north line of lot Fourteen (14) in Block Two (2), Riverside Park
Addition to the City of Salina, including the manholes, "Y'S" and catch -
basins therefor as specified in said specifications, the approximate
length of said sewer being 390 feet.
2. A twelve (12) inch sewer on Fifth Street running south of Bond
Street about.350 feet, including the manholes, catchbasins and "Y'S", as
provided for in said specifications.
3. A ten (10) inch sewer stub at Thirteenth Street and Bishop
Street, commencing at the present manhole at the intersection of Thir-
teenth Street and Bishop Street and south of the track of the Missouri
Pacific Railway Company, and running east about 30 feet and west about
50 feet from said manhole at the intersection of Thirteenth Street and
Bishop Street, including the "Y'S" as provided for in said specifica-
tions; the approximate length of said sewer stub is 80 feet.
4. Sewer stubs on Iron Avenue t o be located at the following
points, to -wit:
A ten (10) inch sewer stub at the intersection of Iron Avenue and
Penn Avenue, commencing at the present manhole at the intersection of
Penn avenue and Iron Avenue, thence running south 40 feet, including
the "Y'S" as provided for in.said specifications.
A ten (10) inch sewer stub at the intersection of Iron venue and
Columbia Avenue, commencing at the present manhole at the intersection
of Iron Avenue and Columbia Avenue, thence running north 40 feet and
south 40 feet, including the "Y'S" as provided for in said specifications;
The length of said sewer is 80 'feet .

A ten (10) inch sewer stub at the intersection of Iron Avenue and
Kansas Avenue, commencing at the present manhole at the intersection of
Iron Avenue and Kansas Avenue, thence running north 40 feet and south 40
feet, including the "Y'S" as provided for in said specifications; the
approximate length Of said sewer is 80 feet.
A ten (10) inch sewer at the intersection of Iron Avenue and Ohio
Avenue, commencing at the present manhole at the intersection of Iron
Avenue and Ohio Avenue, thence running north 40 feet and south 40 feet,
including the "Y'S" as provided for in said specifications; the approxi-
mate length' of said sewer is 80 feet.
A ten (10) inch sewer stub at the intersection of Iron Avenue and
Connecticut Avenue, commencing at the present manhole at the intersection
of Iron Avenue and Connecticut Avenue, and running thence south 40 feet,
including the "Y'S" as provided for in said specifications.
A fifteen (15) inch sewer stub at the intersection -of Iron Avenue
and Connecticut Avenue, commencing at the present manhole at the inter-
section of Iron Avenue and Connecticut Avenue and running thence north
40 feet, including the "Y'S" as provided for in said specifications.
5. The re -location of the present catchbasins on Iron Avenue to
the probable number of five (5) and the construction of the brick -work
of said re -located catchbasins, and also all or part of the pipe connect-
ing said catchbasins with the manholes. Such catchbasins shall be con-
structed according to the said specifications and as directed by the
City Engineer.
6. A ten (10) inch sewer in the alley between Columbia Avenue and
Kansas Avenue, commencing on Ash Street in line with the above alley and
running north in said alley to Elm Street; also running south from Ash
Street about 75 feet, thence about 12 feet from the new manhole in said
sewer to the manhole in main sewer, including manholes, "Y'S", and con-
nections as provided for in said specifications; the approximate length
of said sewer is 865 feet.
7. A ten (10) inch sewer at the intersection of Walnut Street and
Front Street east of the Walnut Street bridge, commencing at the'manhole
at the above described location and running south 85 feet to a point
south of the south line of Walnut Street and south of the proposed paving
of Front Street; including the "Y' S" as provided for in said specifications:
the length of said sewer -is approximately 85 feet.
S. A ten (10) inch sewer in the alley between Fourth Street and
Fifth Street, commencing 80 feet north of the manhole on North Street,
thence north of a point 50 feet south of the main track of the Union Pa-
cific Railroad Company, measured at right angles to said track, including
the mabholes and "Y'S" as provided for in said specifications., the approx-
mate length of said_ sewer is 500 feet.

9. A ten (10) inch sewer on Twelfth Street, commencing at the
present manhole at the intersection of Twelfth Street and Elm Street,
and running north on Twelfth Street about 575 feet to Bishop Street,
including the manholes and "Y'S", as provided for in said specifica-
tions.
Section 2. That the plans and specifications of the City Engin-
eer of said city, for the sewers above described, dated June 5th, 1915,
and now on file with the City Clerk, are hereby adopted and approved
as and for the plans and specifications for the above described sewers ,
and are hereby made a part of this ordinance as fully as 'if set out in
full herein, and all the -work herein specified and described shall be
done in accordance and compliance with such plans and specifications
and under the direction of the said City Engineer.
Section 3. That the contract be and is hereby let to L. H. Lyon
for the building and construction of the . sewers . and cat chbas ins above
described, at the following price or prices, to -wit:
For the sewers numbered one, hereinbefore described, Forty-three
(43¢) cents per lineal foot,, and for the manhole therefor, Thirty-six
and 50100 ($36.50) Dollars.
For the sewer numbered two, hereinbefore described, Sixty-five
(65�) cents, per lineal foot, and -for the manhole therefor, Thirty
($30.00) dollars.
For the sewer numbered three, hereinbefore described, Fifty cents,
(50¢) per lineal f oot .
For the sewer stubs numbered four, hereinbefore desetibed, the
following prices, to -wit:
For the sewer stub at the intersection of Iron Avenue and Penn
Avenue, Fifty-five cents (55¢) per lineal foot.
For the sewer stub at the intersection of Iron Avenue and Colum-
bia Avenue, Fifty-nine cents (59M per lineal foot.
. For the sewer stub at the intersection of Iron Avenue and Kansas
Avenue, Sixty-five cents (65�) per lineal foot.
For the sewer stub at the intersection of Iron Avenue and Ohio
Avenue, Sixty-five cents (65d) per lineal foot.
For the sewer stub at the intersection of Iron Avenue and Con-
necticut Avenue, thence running south 40 feet, Eighty-three cents,
(83�) per lineal foot.
For the sewer stub at the intersection of Iron Avenue and Con-
necticut Avenue, thence -running north 40 feet, One and 35100 Dollars,
Q1.35) per lineal foot.
For the re -locating of catchbas ins numbered five; hereinbefore
described, located on -Iron Avenue -.,,Ten Dollars,'Q10.00) each, and for
the iron tops -thereto, Eight and 50100 Dollars, (-8.50) each, and for
the connecting pipe therefor, Forty-five cents (45 ) per lineal foot.
For.the sewer numbered six, hereinbefore described, commencing
on Ash Street and running north in the alley between Columbia Avenue
and Kansas Avenue about 785 feet,. Sixty-eight cents (68�) per lineal
foot; and for the said sewer numbered six, commencing on Ash Street
and running south about 75 feet, Seventy cents (70¢) per lineal foot;
and for said sewer numbered six running from the manhole of said sewer
to the old - manhole on the main sewer, a distance of about twelve (12)
feet, One and 50100 Dollars, ($1.50) per lineal foot; and for the
manhole for said sewer number six to be located on Ash Street Thirty-
five Dollars, (35.00) and for the manhole of said sewer numbered six
to be located in the alley Thirty-three Dollars -{33.00); and for the
manhole for said sewer numbered six to be located on Elm Street Thirty
Dollars, ($30.00).
For the sewer numbered seven, hereinbefore descirbed, fifty-three
(53�) Cents per lineal foot, and for the manhole therefor Thirty Dol-
lars ($30.00).
For the sewer numbered eight, hereinbefore described, fifty-sev-
en cents (57�) per lineal foot,. and for the rpanhole therefor Thirty
(30.00) Dollars.
Fof the sewer numbered nine, hereinbefore described, Fifty (50¢)
cents per lineal foot; and for the manhole therefor Twenty-six Dol-
lars, Q26.00).
The number of manholes and catchbasins to be built and construct-
ed.. being set forth in the specifications aforesaid; and the prices
hereinbefore set forth, are to include and cover all labor and material
necessary for the complete construction of each and all of said sewers,
catchbasins and manholes, allas specified and required by the said
specifications of the City Engineer aforesaid and according to the said
specifications therefor; and it is hereby found and determined that the
price hereby agreed to be paid for each of said sewers, catchbasins
and manholes, as specified, is less than the estimated cost of said sew-
ers, catchbasins and manholes hereinbefore made by the City Engineer
and now on file with the City Clerk.
Sec. 4. That the person to whom said contract is awarded, as
aforesaid, shall execute a written contract with said city for the
building of such sewers, catchbasins and manholes as aforesaid, and
shall file with the City Clerk a good and sufficient bond in the total
sum of -said contract, conditioned that he will build such sewers accord-
ing to said specifications; that he will re -fill the ditches made in
the streets and alleys under which such sewers shall be laid and con-
structed; that he will fulfill the guaranty required in said specifica-
tions;
pecifics-tions; and that he will hold and save harmless the City of Salina from

all damage to persons and property which may arise through the care-
lessness or neglect of said contractor or his servants and employ-
ees; and that he will protect said city from all liens or. claims for
labor and material used and employed in the building of such sewers.
Section 5. The cost and expense of constructing such sewers
shall be assessed against all lots'and pieces of ground contained in
the City of Salina as a sewer distirct,as- provided by Ordinance No.
613, passed and approved December 23, 1887, and the Mayor and Council
are -hereby authorized to provide for the payment of the cost thereof
by installments instead of levying the entire tax or special assess-
ments at one time, and for such installments they may issue sewer
improvement bonds of the City of Salina, payable in installments of
equal amounts each year, none of which bonds nor the installments
thereof shall run longer than ten years or bear interest exceeding
five per cent (5%) -per annum, and such bonds may be delivered to the
contractor building such sewers in payment thereof; or the Mayor and
Council may sell said bonds at not less than their par value and pay
said contractor out of the proceeds thereof, and for the purpose of
paying principal and interest on said bonds, as they severally become
due, the Mayor and Council shall each year during the life of said
bonds levy an assessment or special tax against all taxable real est-
ate in said City at the assessed value thereof f -or general revenue
purposes, in an amount sufficient to pay the principal and interest
of said bonds for that year; and the City Clerk shall certify said
assessments and special taxes as they are severally made and levied
as aforesaid, to the County Clerk of Saline County, Kansas, at the

same time and in the same manner as other taxes of said City are
certified.
Section 6. That said contractor shall properly re -fill all
excavations made in the construction of the above described sewers
accordant to the plans and specifications of the City Engineer there-
here-for,
for,and shall properly re -fill said excavations if any sinking or
depression appears therein within a period of one (1) years after the
acceptance of said sewers by the aforesaid City.

Section 7. This ordinance shall take effect and be in force
from and after its publication once in the Salina Evening Journal.

Whereas, plans and specifications for certain sewers herein-

ing the "Y"s as provided for in said specifications.

said specifications; the approximate length of said sewer is 80 ft.
A ten (10) inch sewer stub at the intersection of Iron
Avenue and ConnecttLcut Avenue, commencing at the present manhole at
the intersection of Iron Avenue and Connecticut Avenue and running
thence south 40 feet, including the "Y"s as provided for in said
specifications.
A fifteen (15) inch sewer stub at the intersection of Iron
Avenue and Connecticut Avenue, commencing at the present manhole at
the intersection of Iron Avenue and Connecticut Avenue and running
thence north 40 feet, including the "Y"s as provided for in said
specifications..

5. The re -location of the present catch basins on Iron A venu
to the probable number of five (5) and the construction of the
brick work of said re -located catch basins, aid also all, or part of
the pipe connecting said catch basins with the manholes#Ashall be
according to the said specifications and as directed by the City
Engineer.
6. A ten (10) inch sewer in the alley between Columbia Avenue
and Kansas Avenue, commencing on Ash Street in line with the above
alley and running north in said alley to Elm Street; also running
south from Ash Street about 75 feet, thence about 12 feet from the

For the sewer numbered eight, hereinbefore de-
scribed, Fifty -seven -Wit) it) cents per lineal foot, and for the man-
hole therefor Thirty ($30.00) Dollars*
For the the sewer numbered nine, hereinbefore described
Fifty (50je) cents per lineal foot; and for the manhole therefor
Twenty-six ($26*00) Dollars.
The number of manholes and catch basins to be built and con-
structed, being set forth in the specifications aforesaid and the
prices hereinbefore set forth, are to include and - cover all labor
and material necessary for the complete construction of each and
all of said sewers, catch basins and manholes, all as specified and
required by the said specifications of the City Engineer aforesaid
and according to the said specifications therefor, and it is hereby
found and determined that the price hereby agreed to be paid for
each of said sewers, catch basins and manholes, as specified, is
less than the estimated cost of each of said sewers, catch basins
and manholes hereinbefore made by the City Engineer and now on file
with the City Clerk.
Section 4. That the, person to whom said contract is awarded,
as aforesaid, shall execute a written contract with said City for
the building of such sewers, catch basins and manholes as afore-
said, and shall file with the City Clerk a good and sufficient bond
in the.total sum of said contract, conditioned that he will.build
such sewers according,to said specifications; that he will re -fill
the ditches made in the streets and alleys under which such sewers
shall be laid and constructed; that he will fulfill the guaranty
required in said specifications;Wand that he will -hold and save
harmless the City of Salina from all damage to persons and property
which may arise through the carelessness or neglect of said con-
tractor or his servants and employees; and that he will protect
said City from all liens or claims for labor and material used and
employed in the building of such sewers.
Section -5. The cost and.expense of constructing such sewers
shall be assessed against all -lots and pieces of ground contdined
in the City of Salina as a sewer district, as provided by Ordinance
No.613, passed and approved December 23, 1887, and the Mayor and
Council are hereby authorized to provide for the payment of the
