1847 Improve Iron Avenue27 ORDINANCE N0. 1847. (Published in the Salina Evening Journal June /,t/ 1915.) An ordinance providing for the paving, curbing, guttering and ex- cavating of Iron Avenue, in the city of Salina, between Penn Avenue and Delaware street,' specifying the manner of construction, providing for the cost thereof and the manner of payment, and letting the con- tract, therefor. WHEREAS., by resolution duly adopted on the 15th day of February, 1915, the mayor and council declared it was necessary to pave, curb, gutter and excavate said street within the limits above and herein- after defined; and, WHEREAS, said resolution was published for more than five conse- onse- cutive cutive days in the Salina Evening Journal, a daily newspaper printed in the city of Salina, and, WHEREAS, a majority of the resident owners of property liable to assessment and taxation for the cost of said improvements did not, within twenty days from the last ' publication of such resolution, file with the city clerk their protest against such improvements or the making there- of ; theref ore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Iron Av- enue in the city of Salina, between the west line of Penn avenue and the west line of Delaware Street, be paved with one course of Vitrified vertical finer side wire out Buffalo brick block paving material, on a five inch bonerete base and according to the specifications made and prepared by the city engineer of said city and now on file with the city clerk, said paving to be 36 feet in width from gutter to gutter except that the intersections of streets and alleys such paving shall extend from lot line to lot line on said street, except that the street car line shall not be paved for a width of eight (8) feet. Sec. 2. That it is necessary and hereby ordered that said Iron Avenue, between the limits defined in sectione one (1) hereof, be curbed and guttered on both sides thereof, with cement curb and gutter, accord - Ing to the specifications hereinafter provided for, the lot line edge of such curbing to be set twenty and one-half (2021) feet from and para- llel with the center line of said street east and west; Provided, that at the intersections of streets and alleys such curb and gutter shall return to the lot line of said street. See. 3. All excavating, filling and rolling necessary for the proper construction of such improvemente shall be done and all of said improvements shall be made and done in conformity to and compliance with the plans and specifications therefor made by the city engineer and now on file with the city clerk, and such plans and specifications are hereby incorporated in and made a part'of this ordinance in all respects as if the same were written out in full herein. 1 T PA Y _ 279 1 1 1 1 Sec. 4. After the passage of this ordinance the mayor and council shall appoint three disinterested hoa.seholders of the city of Salina, who, after after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation and assess- ment for the cost of making such improvements, without regard to any buildings or improvements thereon, and after making said appraisement said appraisers shall return the same to the city c ounc i at the .first meeting thereof after said appraisement shall have been made and com- pleted, and after said appraisement is returned to the city council,, the mayor and council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said ap- praisement, of which special session due notice shall be given in the official city paper, and at such special session the mayor and council small, if they deem it just and proper, alter or chang3 such appraise- ment. See. 5. That a contract be and is hereby awarded to J • B • Watts and M. R. Amerman, partners doling business as Watts & Amerman, for the paving and excavating of said Iron Avenue between the limits aforesaid with the material specified in Section One (1) hereof, on a five inch concrete base, at and for the uniform price of one dollar and seventy- four cents ($1.74) per square yard for" the square yards of such pave - merit and base actually laid and in place.upon said street, and for the excavating necessary to properly construct such paving, said contractors shall be paid at the rate of thirty-three cents (33�) per cubic yard for the cubic yards of dirt actually removed from said street; and that a further contract is hereby let to said Watts & Amerman for the curbing cl and guttering of said street, as above defined, at and for the uniform price of fifty-two cents (52¢) per lineal foot, for the lineal feet, cif curbing and guttering actually laid and put in place upon said street; all as measured by the city engineer of said city; and the mayor . and council hereby determine and find that the price hereby agreed to be paid for the improvements aforesaid are less than the estimated prices and cost of each and all of said improvements as made and furnished by the said city engineer, which estimated cost of each and all of such improvements as made by said city engineer is now on file with the city clerk. See. 6. For the purpose of paying for the work and improvement herein provided for the mayor and council are hereby authorized and di- rected to issue bonds of the city of Salina, • in an amount not to exceed the cost of such improvements, and to run for a period of ten years, and payable in equal annual installments, together with interest at the rate of five per cent per annum, which bonds, shall be made payable at the fiscal agency of the State of Kansas, at Topeka; and for the pur- pose of paying principal and interest on said binds as they severally become due and payalbe the mayor and council shall by ordinance a ppor- tion and assess against the lots and.pieces of ground in the taxing district of such improvemente special assessments covering the cost of said improvements and the apportionment therein oontained.shall hold good for all .the installments that are to be collected from the specific property chargeable with said improvements. Such assessment and appor- tionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel. of land within the said taxing district and shall state the number of annual installments in which such tax is to, be collected; and thereafter the city clerk shall annually at the same time other taxes ante to be certified, certify to the county clerk of Saline county, Kansas, a full list of all property liable for the cost of such work and improvements, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and the interest on all unpaid balances for one year at the rate of five per cent . per annum, and . such amounts so certified shall be collected as . other taxes are collected; Provided, Vhat for the purpose of defraying .the. cost of improving the squares and areas formed by the crossing of streets and alleys as well as where the Improvement is through or adjacent. to property of the city, for which the city would be liable, the assessments shall be made against all taxable property of the city.
