WHEREAS, a petition has been presented to the mayor and council requesting said mayor and council to pave, curb, gutter and excavate Baker street, between the limits hereinbefore and hereinafter speci- f ied; and., WHERE, said petition has been examined by said mayor and coun- cil and found to contain thenamesof a majority of the resident own- ers of real property liable to taxation for such improvements; there - f ore Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Baker street,, in the city of Salina., between the south line of Iron Avenue and the north line of Walnut Street, be paved with such material as the mayor and council may hereafter designate and -select., as herein- after provided., said paving to be 26 feet In width --from gutter to gutter; Provided, that at the intersections of streets and alleys such pavement shall extend to the lot line of said street. See. 2. That it.1s necessary and hereby ordered that said Ba- ker street, between the limits defined in Section One (1) hereof., be curbed on both sides thereof with cement curbing and guttered on both sides thereof with cement guttering, such curb to be six inches in thickness and such guttering to be twenty-four (24) inches in width and the lot line edge of such curb shall set fifteen and one-half (152) feet, from and parallel with the center line of said street, ex- cept that at the intersections of streets such curb and gutter shall return to the lot line of said street. See. 3. All excavating, rolling and filling necessary for the proper construction of such Improvements shall be done,, and such pav- Ing, curbing and guttering shall be constructed on and according to the established grade of said Baker streetsas heretofore or hereafter established by the ordinances of said city. See. 4. That such street shall be paved with one course of vitrified vertical fiber .side wire cut Buffalo Brak Block paving ma- terial,, on a five inch base,, according to the specifications of the city engineer,, for such kind of paving material., now on file with the city clerk, and such specifications for such paving material are here- -by adopted and approved as and for the specifications for the paving, curbing and guttering of,said street,, and are hereby made a part of this ordinance. 275. See. 5. That a contract be and is hereby let to Watts and Amer- man for the paving and excavating of said street, at and for the fol- lowing. prices, to -wit: For paving said street with the paving material. specified in the preceding section, laid on a five inch concrete base, with asphalt filler, One dollar and Sixty-nine cents ($1.696 per square yard for the square yards of such pavement actually laid and put in place on' said street, and for all excavating on said street,- as. speei- f ied, thirty-three cents (33¢ j per cubic yard for the cubic yards of dirt actually moved from said street; and for the curbing and gutter- ing of said street a contract is hereby let to the said Watts and Amer- man at and f,or the price of fifty-two cents (520 per lineal foot, for the lineal feet of such curb and gutter actually laid and put in place on said street; which such prices are hereby found to be less than the estimated cost or prices of each of such improvements, made by the city engineer, and now on file With the. city clerk . After the passage and publication of this ordinance, the mayor and council shall appoint three disinterested householders who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation and assessment for the cost of the said improvements, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to assessment and taxation, as aforesaid, without re- gard to the building or -improvements thereon, and after making said ap- praisement shall return the same to the mayor and council at the first meeting thereof after such appraisement shall have been made and com- pleted, and after said appraisement.-is returned to the city council, the mayor and council shall designate a time for holding a special session for the purpose of hearing complaints'and equalizing said ap- praisement,'of which special session due notice shall be given in the official city paper; and at such special session the mayor and council shall, ' if they deem it just and proper, alter or change � such appraise - ment . Sec. 7. For.the purpose of paying for the work and improvements 'in this ordinance specified, the mayor and council aro'hereby author- ized and directed to issue bonds of the city of Salina, in an amount not to exceed the cost of such improvements, and to run for a period of ten years and payable in ten equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally 1 1 1 1 P,i Y 277 1 F, 1 1 1 become due, the mayor and council shall by ordinance apportion and assess against the lots and pieces of ground in the taxing district of such improvements special assessments.covering the cost of said im- provements, and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with such improvements. Such assessment and ap- portionment ordinance shall contain the total amount of tax apportioned to each tract. -piece and parcel of land, within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annually, at the same time other taxes are to be certified, certify to the county clerk of Saline county, Kansas, a full list of all property liable for the cost of such work and improvements, together with the respective a- mounts due on each of said tracts, pieces and parcels of land, wheih amount shall include the annual installments and the interest on all unpaid balances for one year at the rate of five per cent per annum, and such amounts so certified shall be collected as other taxes are col- lected; Provided, that for the purpose of defraying the cost of Im- proving the squares and areas formed by the crossing of streets and al- leys,as well as where the improvement is through or adjacent to proper- ty of the city, for which the city would be liable, the assessments shall be made against all taxable property of the city. Sec. 3. Allcxcavating, rolling, and filling necessary for the proper construction of such improvements shall be done, and such pav-ing, curbing and guttering shall be constructed on and according to theestablished grade of said sgreet, a s hereto- fore or hereafter established -by -the ordinances of said city. r Sec. 4. That such street shall be paved with one course of vitrified vertical fiber side wire cut Buffalo brick block paving material, on a five inch base, according to the specifications of the city engineer, for such kind of paving material now on file with the city clerk, and such specifications for such paving material are hereby adopted and approved as and for the specifications for the paving;, curbing and guttering of said street, and are hereby made a part of this ordinance. Sec. 5. Sec. 7. *For the purpose of paying for the work and improve- ments in this ordinance specified the mayor and council are hemby authorized and directed to issue bonds of the city of Salina, in an amount not to exceed the cost of such improvements, and to run for .a period of ten years and payable in ten equal annual installments, together with interest not to exceed five per cert per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas ; and for the purpose of paying; principal and interest on said bonds as they severally become due the mayor and council shall by ordinance apportion and assess against the lots and pieces of ground in the taxing district of such improvements special assessments covering the cost of said improvements, and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with such improve- ments. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within 'the taxing; district and shall state' the number of annual installments in which such tax is to be collected; and there- after the city clerk shall annually, at the same time other taxes are to be certified, certify to the county clerk of Saline county, Kan- sas, a full list of all property liable for the cost of such work and improvements, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amount shall in- clude the annual installments and the interest on all unpaid balan- ces for one year at the rate of five per cent per annum, and such amounts so certified shall be collected as other taxes are collected; Provided, that for the purpose of defraying the cost of improving the squares and areas formed by the crossing of streets and alleys as well as where the improvement is through or adjacent to property of the city, for which the city would be liable.. the assessments shall be made against all taxable property of the city.
