1841 Railroad Right-of-WayIPAY 26"7 - - -- - ORDINANCE No. __1841 - - --- - - - - -- - (Published in the Salina Evening May Li 1915.) An ordinance making an appropriation of a certain sum of money for the purpose of acquiring certain real estate in the city of Salina, Kansas, for railroad right of way for the Missouri .Pacific Railway com- pany into and out of the proposed union depot in said city. WHEREAS, by previous agreement between the City of Salina and the Missouri Pacific Railway company and the Atchison_, Topeka & Santa Fe Railway :company, it was provided that said city should purchase from the said The Atchison, Topeka & Santa Fe Railway Company, for right of way ground for said Missouri Pacific Railway company into and out of the proposed uni6n depot now being constructed in said city, the piece of ground hereinafter.described; and, WHEREAS, said piece of ground hereinafter described and to be acquired by said city aa ­aforesaid has been appraised -by five disin- terested householders of said city heretofore appointed by the mayor and council of said city under previous ordinances and resolutions of said city, as provided by law, at and for the -sum of $564.60; and, WHEREAS, - said The Atchison, Tepeka & Santa Fe Railway company has executed a deed for the ground and real estate to be so asquired by said city as aforesaid, conveying the same directly to the said The Missouri Pacific Railway company, and has deposited said deed with C. B. Kirtland, of Salina, Kansas, to be delivered to said grantee upon payment of the consideration to it therefor. Therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. There is hereby appropriated out of the City Treasury the sum of Five Hundred sixty-four and 60100 Dollars, (564.60), to be paid to the order of the Atchison, Topeka & Santa Fe Railway company , in full payment of the following described real estate in the city of Salina, to be conveyed by said The Atchison, Topeka & Santa Fe Railway company to The Missouri Pacific Railway Company, to -wit: Commencing at a point in the north line of Bishop Street thirt- een and six -tenths (13.6) feet east from the east line of Twelfth Street, when measured along the said north line of Bishop Street; thence north - Westerly, along a line which makes a northwesterly angle of sixty-six (66) degrees, forthy-eight (48) minutes, with the said north line of Bishop Street, twrnty-seven and seven -tenths (27.7) feet, more or less, to the intersection with the southeasterly right of way line of the party of the first part, for point of beginning; thence continuing north- westerly, along the last above described line, two and six -tenths (2.6) feet, more or less, to a point five (,5) feet northwesterly from, when measured normally to the center line �of main track of the party of the second part, as located and constructed for Union Depot purposes; thence southwesterly, along a line parallel with and five (5) feet northwester- ly from the center line , of said main track of the pasty of the second part, two hundred twenty and sig -tenths (220.6) feet, more or less, to a point in the north line of Bishop Street; thence east., along the said north line of Bishop Street, one hundred seventy-six and nine -tenths (176.9) feet, more or less, to a point in the center line of Twelfth Street; thence north, along the said center line of `Twelfth Street, twenty-five (25) feet, thence east at right angles forty (40) feet to the point of intersection of the southeasterly right of way line of the party of the first part with the east line of Twelfth Street; thence 268 '� northeasterly along said southeasterly right of way line of the party of the first part, two and eight -tenths (2.8) feet more or less to point of beginning. Containing an area of Two Thousand Eight Hundred Twenty-three (2823) square feet, more or less, together with all right, title and Interest of the grantor in and to that part of Bishop street adjacent to said land. See. '2. That a warrant be drawn on the city treasurer for said sum of 564.60, to the order of the payee mentioned in section one (1) hereof, and such warrant shall be delivered to C. B. Kirtland in ex- change for said deed aforesaid. Sec. 3. This ordinance shall take effect and be in force from and after its publication once in the Salina Evening Journal.
