An ordinance providing for the paving curbing, guttering and excavating of Front street,, in the city of Aalina, Kansas, between the south line of I.ron avenue and the south line of Walnut street, extend- ed east, specifying the manner of construction, providing for the cost thereof -and the manner of payment, and letting the contract therefor. WHEREAS, a petition has been presented to the mayor and council requesting said mayor and council to pave, curb, gutter and excavate Front Street between the limits hereinbefore and hereinafter s pec i - f led; and, WHEREAS, said petition has been examined by said mayor and coun- cil and found to contain the names of a majority of the resident own- ers of real property liable to taxation for such improvements; there- fore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Front Street, in the city of Salina, between the south line of Iron avenue and the south line of Walnut Street,. extended east., be paved, with such material as the mayor and council may hereafter designate and se- lect, as hereinafter provided, said paving to be thirty-three (33) feet in width from gutter to gutter; Provided, that at the Intersect- ions of streets and. alleys such pavement shall :extend to the lot line of said street. Sec. 2. That it is necessary and hereby ordered that said Front street, between the limits defined in section one hereof, be curbed on both sides thereof with cement curbing and guttered on both sides thereof with cement guttering, such curb to be six inches in thick- ness. and such guttering to be twenty-four in width and the lot line edge of such curb, shall be set nineteen (19) feet from and -parallel with the center line of said -streets except that at the intersections of streets and alleys such curb and gutter shall return to the lot line of said -street. Sec. 3.- All excavating, rolling and filling necessary for the proper construction of such improvements shall be done, and such paving, curbing and guttering shall be constructed on and according to the e- stablished grade of said Front street, as heretofore or hereafter e - established by the ordinances of said city. ec. 4. That such street shall be paved with one -course of vitrified, vertical fiber, side wire cut, Buffalo brick block paving material ton -a- .five inch base, according to .the specifications of the City Engineer for such kind of. paving material now_ on file with the City Clerk, and such specifications for such . paving material are here- by adopt ed -and approved as and for the specifications for the paving, curbing and guttering of said street, and are hereby made a part of this ordinance. 258 See. 5 That a" contract be -and is hereby let to Watts & Amerman for the paving and excavating of said street, at and for the following prices, to -wit: For paving said street with the paving material specified In the preceding section, laid on a five inch concrete base, with as- phalt filler, as specified, one and 69/100 Dollars, ($1.69) per square yard, for the square yards of such pavement actually laid and put in place on said street, and for all excavating of said street, as specified, thirty-three cents (33¢) per cubic yard for the cubic yards of dirt actu- ally removed from said street; and for the curbing and guttering of said street, a contract is hereby let to the said Watts & Amerman at and for the price of fifty-two cents (52¢) per lineal foot for the lineal feet of such curb and gutter actually laid and put in place on said street; which such prives are hereby found to be less than the estimated cost or prices of each of such improvements made by•t he city engineer and now on file with the city clerk. Sec.. 6. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested householders who,. after haveing taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation and assessment for the cost .of the said improvements, shall, within ten days after having been noti- fied of their appointment, proceed to appraise said lots and pieces of ground liable to assessment and taxation, as aforesaid, without regard to the buildings or improvements thereon, and after making said appraise- ment shall return the same to the mayor and council at the first meeting thereof after such appraisement shall have been made and completed, and after said appraisement is returned to .the city council, the mayor and council shall designate a time for holding: a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper. and at such special session the mayor and council shall, if they deem it just and proper, alter or change such appraisement. Sec. 7. For the purpose of paying for the work and improvements in this ordinance specified the mayor -and council are hereby authorized and directed to issue bonds of the city of Salina, in an amount not to exceed the cost of such improvements, and to_ run for a period of ten years and payable in ten equal annual installments; together with inter - eat not to exceed five per'cent'per annum, which bonds shall be made pay- able at the Fiscal Agency of the State of Kansas; amd for the purpose of paying principal and interest on said bonds as they severally become due the mayor and council shall by ordinance apportion and assess against the lots.and pieces of ground in the taxing district of such Improve- ments special assessments covering the cost of said improvements, and the 1 1 D 11 apportionment therein contained shall .hold ,good for all the installments that are to be collected from the specific property chargeable with such improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual in- certify to the county clerk of Saline county; Kansas, a full list of all propertq'.liable for the,�cost of such work and improvements, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amount shall include the annual installments and the interest on all unpaid balances for one year at the rat e . of five per cent per annum, and such amounts so certified shall be collected as other taxes are col- lected; Provided, that for the purpose of defraying the cost of improv- ing -the squares and areas formed by the corssoing of streets and alleys as well as where the improvement is through or adjacent to property of the city, for which the city would be liable, the assessments shall be made against all taxable .property of the city. That such street shall be paved with "U vitrified, vertical fiber side wire cut Buffalo brick block paving material, on a five inch base, according to the specifications of the city enginneer for such kind of paving material now on file with the city clerk., and such specifications for such paving material are hereby adopted and approved as and for the specifications for the paving, curbing and guttering of said street and arelihe.reby made a part of this ordinance. Sec. 5. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, Ami piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annually, at the same time other taxes are to be certified, certifybto the county clerk of Saline. county, Kansas, a full list of all property liable for the cost of such work and improvements, together with the respective amounts due on each of said tracts, pieces and parcels of land, -which mount shall include the annual installments and the interest on all unpaid balancea for one year at the rate of five per cent per annum, end such amounts so certified shall be collected as other taxes are collected,. Provided, that for the purpose of defraying the cost of improving the squares and areas formed by the, crossing of streets and alleys as well as where the improvement is through or ad- jacent to property of the city, for which the city would . be liable, the assessments shall be made against all taxable property of the city.
