ORDINANCE., NO. 1833.

An ordinance specifying and selecting the paving material to be
used and letting the contract for the paving, curbing, guttering and
excavating of -.a part of Thirteenth Street in the city of Salina.
WHEREAS, under the provisions of Ordinance No. 1824, passed and
approved March 1, 1915, the mayor and council determined to pave, curb,
gutter and excavate Thirteenth Street, in the city of Salina, between
the north line of Ash. Street and the north line of Bishop street ex-
tended due west from Ninth street; and,
WHEREAT, plans and specifications for the making of said improve-
ments have been made with the city engineer and .filed with the city
clerk, as provided in said Ordinance No. 1824, and the same have been
adopted and approved by the mayor and council; and,
WHEREAS, proposals for doing such paving and excavating and such
curbing and guttering have been filed with the city clerk, and such pro-
posals have been examined by the mayor and cofincil and the proposal or
bid of Watts & Amerman is hereby found and determined to be the most
satisfactory proposal for the kind and character of . pavement herein-
after designated and selected, and that the prices named in such pro-
posal atte found to be less than the estimated cost of each of such im-
provements as heretofore made by the city engineer and now on file with
the city clerk; therefore.,
Be it ordained by the Mayor and Councilmen of the city of Salina:
Section 1. The mayor and council are hereby determined that said
Thirteenth Street, between the north line of Ash street and the north
line of Bishop street, shall be paved with one -course of vitrified, ver-
tical fiber, side wire, out Buffalo brick block paving material, as
specified in the specifications of the city engineer aforesaid, and such
paving material, laid on a five inch concrete base, as specified, is
hereby adopted and selected as the material with which said Thirteenth
street shall be paved.
Sec. 2. That the curbing and guttering of said street, as provid-
ed in said Ordinance No. 1824, shall be so constructed that the lot line
edges of such curbing shall be set nineteen (19) feet from and parallel
with the center line of . said street, and such street shall be paved
thirty-three (33) feet in width.
Sec. 3. That a contract be and is hereby let to Watts & Amerman
for the paving and excavating of said street, at and for the uniform
price of One and 69/100 Dollars, ($1.69) per square yard for the square
yards of such pavement, with a concrete base, as specified, actually
laid on said street, and for the excavating necessary to properly conf-L
struct such paving, such contractors shall be paid at the rate of thirty-
three cents (33¢) per cubic yard for the curbic yards of dirt actually
removed from said street, all as computed and measured by the city en-
gineer of said city.
Sec. 4 That a contract be and :is hereby let to Watts & Amerman
for the curbing and guttering of said street, as above defined, at and
for the uniform price of fifty-two cents (52¢) per lineal foot for the
lineal feet of curbing and guttering actually constructed and put in
place -on said street,as computed and measured by the said city engineer.
Sec. 5.. That such contracts are awarded upon the express condi-
tion that the work and improvement thus awarded shall be done in strict
accordance with the specifications of the city engineer therefor, which
are hereby made a part of this ordinance and of the contract hereby
awarded, and upon the further condition, among othersT that the said
Watts & Amerman shall within ten (10) days from this date, execute a
written contract with the city, and give to the city a surety bond, in
the approximate sum of the cost of such improvements, guaranteeing such
pavement against all defects for the period of five years, and such
curbing and guttering for a period of one year after such curbing and
guttering shall be accepted by said city; and said contractor shall
also give_a good and sufficient bond as required by the statutes of
the State of Kansas.
Sec. 6. This ordinance shall take effect and be in force from and
after itis publication once in the Salina Evening Journal.
