(Published in the Salina Evening Journal April ._1915) An ordinance letting the contract for the curbing and guttering of a certain portion of Fifth Street in the city of Salina. WHEREAS, .under the provisions of Ordinance No. 1818, passed and approved February 15th, 1915, the mayor and council determined to.curb and gutter Fifth Street, in the city of Salina, between the south line of Walnut Street and the north line of Prescott avenue; and, WHEREAS, plans and specifiaa.tions for the making of said improve- ments have been ftde:3by the city engineer and filed with the city clerk, as provided in said Ordinance No. 1818, and the same have been adopted and approved by the Mayor and Council; and, WHEREAS, proposals for doing -such curbing and guttering have been filed with the city clerk; and such proposals have been examined by the mayor and council and the proposal or bid of Watts & Amerman is hereby found and determined to be the most satisfactory proposal for the curb - ing and guttering of said street; and that the prices named in such pro- posal are hereby -found to be less than the estimated cost of making such improvements as heretofore made by the city -engineer,, and which estimate of the city engineer is now on file with the city clerk; therefore, Be it ordained by the.mayor and councilmen of the City of Salina: Section 1. That the curbing and guttering of said street, as pro- vided and defined in said Ordinance No. 1818, shall be so constructed that the lot line edges of such curbing shall be set nineteen (19) feet from and parallel with the center line of said street. Sec. 2. That a contract be and is hereby let to Watts & Amerman for the curbing and guttering,, of said Fifth Street, between the limits hereinbefore defined, at and for the uniform price of fifty-two (52¢) cents per lineal foot for the lineal feet of curbing and guttering ac- tually constructed and put in place on said street as computed and meas- ured by the city engineer of said city. Sec. 3. That such contract is awarded upon the express condition that the work and improvements to be done and performed thereunder shall be done in strict accordance with the specifications of the city engi- neer therefor, which are hereby made a part of this ordinance and of the contract hereby awarded; and upon the further condition, among others, that the said Watts & Amerman shall execute and file with the city of Salina within ten (10) days from this date a written contract, and a good and sufficient bond, in the approx-imate sum of the cost of such improvements, guaranteeing such curbing and guttering as in 252 , struct such paving, such contractors shall be paid at the rate of thirty- three cents (33¢) per cubic yard for the curbic yards of dirt actually removed from said street, all as computed and measured by the city en- gineer of said city. Sec. 4 That a contract be and :is hereby let to Watts & Amerman for the curbing and guttering of said street, as above defined, at and for the uniform price of fifty-two cents (52¢) per lineal foot for the lineal feet of curbing and guttering actually constructed and put in place�on said street,as computed and measured by the said city engineer. Sec. 5, That such contracts are awarded upon the'express condi- tion that the work and improvement thus awarded shall be done in strict accordance with the specifications of the city engineer therefor, which are hereby made a part of this ordinance and of the contract hereby awarded, and upon the further condition, among othersri that the said Watts & Amerman shall within ten (10) days from this date, execute a written contract with the city, and give to the city a surety bond, in the approximate sum of the cast of.such improvements, guaranteeing such pavement against all defects for the period of five years, and such curbing and guttering for a period of one year after such curbing and guttering shall be accepted by said city; and said contractor shall also give_ a good and sufficient bond as required by the statutes of the State of Kansas.
