1831 Improve Ninth StreetITPAY 247 ORDINANCE N O . 1831. (Published in the Salina Evening Journal April , 1915.) An ordinance specifying and selecting the paving material to be used, and, letting the contract for the paving and excavating and for the curbing and guttering of certain portions of Ninth street in the City of Salina. WHEREAS, under the provisions of Ordinance No. 1819, passed and approved February 15th, 1915, the mayor and council determined to pave and excavate and curb and gutter Ninth Street in the city of Salina, between the south line of South Street and the south line of Crawford avenue; and, WHEREAS, plans and specifications for the making of said improve - meets have been made by the city engineer and filed with the city clerk as provided in said Ordinance No. 1819; and the same have been adopted and approved by the mayor and council; and, WHEREAS, proposals for doing such paving and excavating and such curbing and guttering have been filed with the city clerk, and such pro- posals have been examined by the mayor and council and the proposal or bid of Watts & Amerman is hereby found and determined to be the most satisfactory proposal for the kind and character of pavement herein- after designated and selected, and that the prices named in such.pro- posal are found to be less than the estimated cost of each of such im- provements as heretofore made by the city engineer and now on file with the city clerk; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section -1. The mayor and council hereby determine that said Ninth street, between the south line of south street and the south line of Crawford Avenue shall be paved with one -course of vitrified, verti- cal fiber, side wire cut Buffalo brick block paving material, as speci- fied in the specifications of the city engineer filed by him with the city clerk on the 15th day of March, 1915, and such paving material as aforesaid,, -laid on a five inch.concrete base, as specified, is hereby adopted and selected as the material with which said street shall be paved. Sec. 2. That the curbing and guttering of said street, as pro- vided in said Ordinance No. 1819, shall be so constructed that the lot line edges of such curbing shall be set eighteen and one-half (182) feet from and parallel with the center line of said street, and such street, shall be paved thirty-two (32) feet in width. Sec. 3. That a contract be and is hereby let to Watts & Amerman, of Salina, Kansas, for the paving and excaysting of said street, at and for the uniform price of one and 69100 Dollars, ($1.69) per square yard for the square yards of such pavement, with a concrete base,as specified, actually laid on said street; and for the excaxa ting necess- 248 ary to properly construct such pavement, said contractors shall be paid at the rate of thirty-three (33¢) per cubic yard for the cubic yards of dirt actually removed from said street, all as computed and measured by the city engineer. Sec. 4. That a contract be and is hereby let to Watts & Amerman for the curbing and guttering of said street, as above defined, at and for the uniform price of fifty-two cents (55¢) per lineal foot for the lineal feet of curbing and guttering actually constructed and put in place on said street, as computed and measured by the city engineer. Sec. 5. That such contracts:arerawarded upon the express condit- ion that the -work and improvement thus awarded shall be done in strict accordance with the specifications of the city engineer therefor, which are hereby made a part of this ordinance and of the, contract hereby awarded; and upon the further condition, among others, that the said Watts & Amerman shall within ten (10) days from this date execute a written contract with the city and give to the city a surety bond in the approximate sum of the cost of such improvements, guaranteeing such pavement against all defects for the period of five years and such curb and gutter for a period of one year, after such paving and curbing and guttering, shall be accepted by said city. Sec. 6. This ordinance shall take effect and be in force from and after its publication once in the Salina Evening Journal. Passed and approved, April 19th, 1915. (SEAL) Attest: Chas. E. Banker.
