1827 Improve Crawford Street236 4 IORDINANCE NO. 1827_ (Published in the Salina Evening Journal April 1915.) An ordinance providing for the paving, curbing, guttering and ex- cavating of Crawford Avenue, in the city of Salina, between Ninth Street and Santa Fe avenue, specifying the manner of construction, providing for the cost thereof and the manner of payment, and letting the contract therefor. WHEREAS, by resolution duly adopted on the 15th day of February, 1915, the mayor and council declared that it was necessary.to pave, curb, gutter and excavate Crawford Avenue within the limits above and herein- after defined; and, WHEREAS, said resolution was published for more than five conse- ,cutive days in the Salina Evening Journal, a daily newspaper printed in the city of Salina, and, WHEREAS, a majority of the resident owners of property liable to assessment and taxation for the cost of said improvements did not, with- in twenty days from the last publication of such resolution, file with the city clerk of said city their protest against such improvements or the making thereof; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary amd hereby ordered that Crawford Avenue, in the city of Salina, between the west line of Santa Fe aven- ue and the east line of Ninth Street, be paved with Bermudas Lake asphal- tic-concrete sphal- tis-concrete paving material, on a five inch concrete base and according to the specifications made and prepared by the city engineer of said city and now on file with the city clerk, said paving to be thirty-six. (38) feet in width from gutter to gutter, except that at the intersections of sheets and alleys such paving shall extend from lot line to lot line on said street. Sec. 2. That itis necessary and hereby ordered that said Craw- ford Avenue between the limits defined - in section one (1) hereof, be ,curbed and guttered on both' -sides thereof, with cement curb and gutter, according to the specifications hereinafter provided for, the lot line edge, of such curbing to be set twenty (20) feet from and parallel with the center line of said street east and west; Provided, that at the intersections of streets,and*a lleys such curb and gutter shall return to the lot line of said street. Sec. 3. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done and all of said improvements shall be made and done in conformity to and compliance with the plans and specifications therefor made by the city engineer and now on file with the city clerk, and such plans and specifications are hereby incorporated in and made a part of this ordinance in all respects as if the same were written out in full herein. 1 n 1 1 1 1 Sec. 4. After the passage of this ordinance the mayor and coun- oil shall appoint three .disinterested householders of the city of Sa- lina., who, after having taken an oath to faithfully and impartially ap- praise all lots and pieces of ground liable to taxation and assessment for the cost of making such improvements; without regard to any build- ings or improvements thereon, and after making said appraisement said appraisers shall return the same to the city council at the first meet- ing thereof after said.appraisement shall have been completed, and after.said appraisement is returned to the city council the mayor and council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper, and at such special session the mayor and council shall, if they deem it just and proper, alter or change such appraisement. See. 5. That a contract be and is hereby awarded to J. B. Watts and M. R. Amerman, partners doing business as Watts & Amerman, for the paving and excavating of said.Crawford Avenue, between the limits aforesaid with Bermudas Lake asphaltic -concrete on a five inch concrete base at and for a price not to exceed one dollar and fifty cents ($1.50) per square yard for the square yards of such pavement and base actually laid and in place upon. said street, and for the excavating necessary to properly construct such paving, said contracts shall be paid at the rate of thirty-three (330 cents per cubic yard for the cubic yards of dirt actually removed from said street; and that a further contract is hereby let to said Watts & Amerman for the curbing and guttering of said street, as above defined, at and for the uniform price of fifty-. five.cents.(55¢Y per lineal foot for the lineal feet of curbing and guttering actually laid and put in place upon said street; all as measured by the city engineer of said city; and the mayor and council hereby determine and find that the price hereby agreed to be paid for the improvements aforesaid are less than the estimated prices and cost of each and all of said improvements as made and furnished by the said city engineer, which estimated cost of each and all of such Improve - merits as made by said city engineer is now on file with the city clerk. See. 6. For the purpose of paying for the work and improvement herein provided for the mayor and council are hereby authorized and directed to issue bonds of the city of Salina,, in an amount not to ex- ceed the cost of .such improvements, and to run for a period not ex- ceeding ten (10) years, and payable in equal annual installments, to- gether with interest at the rate of five per cent per annum, which 238 0 bonds shall be made payable at the fiscal agency of the State of Kansas, at Topeka; and for the purpose of paying principal and interest on said bonds as they severally become due and payable the mayor and council shall by ordinance apportion and assess against the lots and pieces of ground in the taxing district of .such improvements special assessments covering the cost of said improvements and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvements. Such assessment and apportionment ordinance s1gall contain the total amount of tax apport- ioned to each tract, piece and parcel of land within said taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annually, at the same time other taxes are to be certified, .certify to the county clerk of Sa- line county, Kansas, a full list of all property . liable for the cost of such work and improvements, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall in - elude the annual installments and the interest on all inpaid balances for one year at the rate of five per cent per annum, and such amounts so certi- fied shall be collected as other taxes are collected; Provided, that for the purpose of defraying the cost of improving the squares and areas formed by the crossing of streets and alleys as well as where the improve- ment is through or adjacent to property of the city, for which the city would be liable, the assessments shall be made against all taxable prop- erty of the city. Sec. 3. Sec. 4. Such assessment and appor, -tionment ordinance shall contain the total amount. of tax apportioned to each tract, piece and parcel of land within said taxing district and U shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annually, at the same tine other taxes are to be certified, certify to the county clerk of 0. Saline county, Kansas, a full list of all property liable for the cost of such work and improvements, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and the interest on all.unpaid balances for one year at the rate of five per cent per annum, and such amounts so certified shall be collected as other taxes are collected; Provided, that for the purpose of defraying the cost of improvirF the squares and areas formed by the crossing of streets and alleys as well as where the improvement is through or adjacent to property of the city, for which the :city -mould be liable, the assessments shall be made against all taxable property of the city.
