1824 Improve Thirteenth Street�1J ORDINANCE NO. 1824. (Publishied in the Salina Evening Journal March 1, 1915.) An ordinance providing for the paving, curbing, guttering and excavating of Thirteenth street, in . the .city of Salina, Kansas, between the north line of Ash street and the north line of Bishop Street extend- ed due west from Ninth Street, and' providing for the cost thereof and the manner of payment. WHEREAS, by resolution duly adopted on the 18th day of January, 1915, the mayor and council declared that it was necessary t,o.pave Thir- teenth street within the limits above and hereinafter defined; and WHEREAS, said resolution was published for more than five aonse- eutive days in -the Salina Evening Journal, a daily newspaper published in the city of Salina; and, 'WHEREAS, a majority of the resident owners of property liable to assessment and taxation -for the cost of said improvements did not, with- in twenty days from the last publication of such resolution file with the city clerk of said city their protest against such improvements or the making thereof; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. It is necessary and hereby ordered that. Thirteenth Street, in the city of Salina, Kansas, between the north line of Ash street and the north line of Bishop street extended due west from Ninth Street, be paved.with such material as the mayor and council may here- after.designate and select, as hereinafter provided, according to the specifications of the city engineer of said city hereinafter provided for, said street to be paved for such a width as the mayor and council may hereafter determine; Provided, that at the intersections of streets and alleys such paving shall return to the lot line of said street so improved. Sec. 2. It is necessary and hereby ordered that said Thirteenth street between the limits defined in section one hereof,_, be curbed and guttered on both sides thereof with cement curb and gutter, according to the -specifications of the city engineer of said city, hereinafter provided for, . the curb part thereof to be six inches in thickness and the gutter part thereof to be thirty inches moreor less, from the back edge of such curb to the paving line of said street and the lot line edges of such curbing shall be set such a distance from the center line of said street as the mayor and council shall hereafter determine; Provided, that at the intersections of streets and alleys said curb and gutter shall return to the lot line on said street improved. Sec. 3. For the work and improvement herein provided for, the City Engineer of Salina shall make and file with the city clerk, on or before the 1st, day of April, 1915, complete plans and specifications, for the paving of said street with asphaltic -concrete, asphalt, brick - block, and vitrified vertical side wire cut brick paving block pave- ment all: on a four or five inch concrete base with asphalt and sand l 1 1 1 1 1J i T P 1 Y 1 1 1 1 0 231 filler for both of such brick pavements-, and for curbing and gutter - ing of said street with cement curb and gutter, substantially as here- inbefore described; and. on or before said last named date said city engineer,shall file withAhe city clerk estimates of the\cost of such curb and gutter and of such paving and excavating of such street with .,the different kinds. of paving material aforesaid. Sec. 4. That after such plans and specifications shall have been made and prepared by the city engineer and filed with the city clerk as -aforesaid; the mayor and council may advertise for the reception of bids for the paving of said street with the different kinds of street paving material named and specified in the preceding section hereof, and for the curbing and guttering of said street, and after the receipt of such bids or proposals the mayor and council shall select from the different kinds of such paving material the kind with which said street shall be paved, and they may and are hereby authorized to let a con- tract ,for the paving of said street with the material so selected, and for the curbing and guttering of said street, to the most satisfactory and responsible bidder for the kind and character of pavement which shall be determined upon by said mayor and council, said mayor and coun- cil reserving the right to let the contract or contracts for the pav- ing and excavating separately from the curbing and guttering or let the contract for. all such improvements to one party, and to reject anti and all bids. Sec. 5. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested householders, who after having taken an oath to faithfully and impartially appraise all lots and -pieces of ground liable to taxation and assessment for the costs of the improvements herein provided for, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to assessment and taxation, as aforesaid, without regard to the buildings .or improvements thereon, and after making said appraisement shall return the same to the mayor and council at the first meeting thereof after such appraisement shall .have been completed, and after said appraisement is returned to the mayor and council said mayor and council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper; and at such special session the mayor and council shall, if they deem it just and proper alter or change such appraisement. Sec. 6. For the purpose of paying for the work and improvements 232 in this ordinance provided the mayor and council are hereby authorized and directed to issue -bonds of the city of Salina in an amount not to exceec ., the cost of such improvements and to run for a period of ten years and payable in ten equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas, and for the purpose of paying prin- cipal and interest on said bonds as they severally become due and payable the mayor and council shall by ordinance apportion and assess against the lots and pieces of ground in the taxing district of such improvements special assessments covering the cost of said improvements and the appott- ionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said im- provements. Such assessment and apportionment ordinance shall con- tain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; -and thereafter the city clerk shall annually, at the same time other taxes are to be certi- ' fied, certify to the county clerk of Saline county, Kansas, a full list of all property liable for the cost of such work and improvements, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and the in- terest on all unpaid balances for one year at the rate of five per cent per annum, and such amount so certified shall be collected as other tax- es are collected; Provided, that for the purpose of defraying the cost of improving the squares and areas formed by the crossing of streets and al- leys as well as where the improvements is through or adjacent to property of the City, for which the city would be liable, the assessments shall be made against all the taxable property of the city. Sec. 7. This ordinance shall take effect and be in force from and after its publication once in the Salina Evening Journal. Passed and approved, March lst, 1915. (SEAst. V. E. Nicuette, _ Chas. E.
