1821 Improve Crawford Street222 OFDINANCE NO. 1821. Published in the Salina Evening Journal March / 1915. An ordinance providing for the construction of certain sewers in the city of Salina, Kansas; letting the contract therefor, and providing for the payment of the cost of the same. WHEREAS, plans and specifications for certain sewers hereinafter described have been made and prepared by the city engineer and have been approved by the mayor and council; and, WHEREAS, bids for the construction of such sewers have heretofore been advertisdd for by said city and are now on file with the city clerk; theref ore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That the mayor and council deem it necessary and here- by order that the following described sewers be built and constructed in the city of Salina, Kansas, to -wit: 1. An eighteen (18) inch sewer on Grawf ord street, between High- land avenue and Ninth street, including the manholes and catchbasins therefor, as specified in said specifications; the approximate length of such sewer being, 425 feet; 2. A fifteen (15) inch sewer oh Ninth street, between Crawford street and Prescott avenue, including manholes and catchbasins therefor as .specif,ied, in said specifications; the approximate length of which sewer being 1125. feet; 3. A twelve (12) inch sewer on -Ninth street, between Prescott avenue and Washington street, including manholes and catchbasins there- for; the .approximate length of which sewer is 400 lineal feet. 4. A ten (10) inch sewer on Ninth street, between Washington street and a point about 200 feet north of Morrison avenue, including manholes and catchbasins therefor as specified; the approximate length of which sewer is 589 feet. 5. A ten X10) inch sewer commencing at the end. of the present sewer at State street and College avenue at a point west of College Aven- ue, running thence west on State street a distance of about 175 feet, thence north in a private alley to Ash street, thence west on Ash street a distance of about 176 feet; the total approximate length &f which sew- er is about 797 lineal feet; including the manholes and catchbasins, as specified in said specifications; 6. A ten (10) inch sewer between Ohio avenue and Connecticut street, commencing and connecting; with the main sewer on Ash Street and running.thence south about 215 feet to the center of the alley between Johnstown avenue and Ash street, with manhole therefor as specified; Provided, however, that the owner or owners of the real estate through which such sewer is to be construcetd shall grant a right of way through such land for said sewer. A ten (10) inch sewer on Prescott avenue between Tenth and E- leventh streets, including manholes and catchbasins therefor as speci- fied; the approximates length of which sewer is about 496 lineal feet. 9. A ten (10) inch sewer in the alley between Front'gnd Second streets from the main sewer on Ash street north to Elm street, of the approximate length of 835 lineal feet, including -manholes and catchbas- ins as specified; 11. A ten (10) inch sewer in the alley between Jewell and Kirwin avenues from a connection with the present 12 inch sewer on Santa Fe avenue west to the center of the above named alley, of the approximate length of 350 feet, including manholes and catchbasins as specified; 12. A ten (10) inch sewer on Park Street, commencing at the man - hole at Park street and College avenue and running west a distance of about 250 lineal feet, including manholes and catchbasins as specified, Sec. 2. That the plans and specifications of the city engineer of said city for the sewera above described dated February 15th, 19152 and now on file with the city clerk, are hereby adopted and approved as and for the plans and specifications for such sewers and are hereby made a part of this ordinance, and all the work therein specified and described shall be done in accordance and compliance with such plans and specifications. Sec..3. That a contract be and is hereby let to The Eby Construe t - ion Company and Corporation, of Wellington, Kansas, for the building and construction of the sewer above described, at the following price or prices, to -wit, that is to say: For sewer numbered one hereinbefore described, one dollar ($1.00) per lineal foot, and for catchbasins therefor 7.50 each and for man- holes theref or $35.00 each; For sewer numbered two hereinbefore described, seventy-four cents (74�) per lineal foot, and for catchbasins therefor $7.50 and for man- holes therefor $35.00 each; For sewer numbered three hereinbefore described fifty-seven cents (57¢) per lineal foot, and for catchbasins therefor $7:50 each and for manholes therefor $35.00 each; For sewer numbered f our hereinbef ore described, forty-eight cents (484) per lineal foot, and for catchbasins therefor $7.50 each and for manholes therefor $35.00 each; For sewer numbered five; hereinbefore described, forty-eight cents (48/) per lineal foot, and for manholes therefor $35.00 each; For sewer numbered six hereinbefore described, one dollar Q1.00) per lineal foot, and for manholes therefor 35.00 each; For sewer numbered eight hereinbefore described, seventy cents (70¢) per lineal foot, and for manholes therefor $35.00 each; For sewer numbered nine hereinbefore described, seventy cents (70e'4) per lineal foot, and for manholes therefor $35.00 each; For sewer numbered eleven hereinbefore described, . f fifty -f ive cents (55�) per lineal foot, and for manholes therefor $35.00 each; For sewer numbered twelve hereinbefore described, fifty-two cents (52� ) per lineal foot, and for manholes therefor $35.00 each; The number of manholes and catchbasins to be built and construct- ed being set forth in the specifications aforesaid; and the prices here- inbefore set forth are to include and cover all labor and material ne- cessary for the complete construction of each and all of said sewers and the catchbasins and manholes therefor, all as specified and requir- ed by the said specifications of the city engineer aforesaid and accord- ing to said specifications therefor; and it is hereby found and de- termined that the prices hereby agree to be paid for each of such sewers and the catchbasins and manholes therefor, as specified, are less than the estimatdd cost of each of said sewers and of the catchbasins and manholes therefor heretofore made by the city engineer and now on file with the city clerk. Sec. 4. That the corporation to whom said contract is awarded as aforesaid shall execute a written contract with `said city for the build- ing of such sewers as aforesaid and shall file with the city clerk a good and sufficient bond, in the total sum of said contract, conditioned that it will build such sewers according to said specifications, that it will re -fill the ditches made in the streets and alleys under which said sewers 'are to be laid and constructed, that it will fulfill the guaranty required in said specifications, "that it will hold and save harmless the city of Salina from all damages to persons and property which°may arise through the carelessness and neglect of said contractor and its servants and employes; and that it will protect said city from all liens or claims for labor and material used and employed in the building of such sewef1s . Sec. 5. The cost and expense of°constructing such sewers shall be assessed against all lots and pieces of ground contained in the city of Salina as a sewer district, as provided by Ordinance No. 613, passed and approved December 23, 1887, and the mayor and council are hereby authorized to provide for the payment of the cost thereof by install- ments instead of levying the entire tax or special assessments at one time, and for such installments they may issue sewer improvement bonds of the city of Salina, payable in installments of equal amounts each 1 L� 1 1 TPAY : 225 year, none of which bonds nor the installments thereof shall run longer than ten years or bear interest exceeding five per cent per annum, and such bonds maybe delivered to the contractor building such sewers in payment thereof, or the mayor and council may sell said bonds, at not less than their par value, and pay said contractor out of the proceeds thereof; and for the purpose of paying principal and interest on said. bonds as they severally become due the mayor and council shall each year during the life of said bonds levy an assessment or special tax against all the taxable rea; estate in said city, at the assessed val- ue thereof for general revenue purposes, in an amount sufficient to pay the principal and interest of said bonds for that year; and the city clerk shall certify said assessments and special taxes as they are severally made and leveid, as aforesaid, to the county clerk of Saline county, Kansas, at the same time and in the same manner as other tax- es of said city are certified. r Sec. 6.
