That it is necessary and hereby.ordered that Eleventh street, in the city of Salina, Kansas, between the south line of Wal- nut street and the north line of South street, be paved, with such mat- erial as the mayor and council may hereafter designate and select as hereinafter provided, according to the specifications of the City Eng- sneer of said city hereinafter for, said street to be paved a width of thirty-six (36) feet; Provided, that at the intersections of streets and alleys such paving shall extend to the lot line of said street so improved. Sec. 2. For the work and improvement herein provided for, the city engineer shall make and file with the city clerk, on or before the 15th day of March, 1915, complete plans and specifications for the paving of said street with asphaltic -concrete, asphalt, brick -block, and vitrified verticial side wire out brick paving block pavement, all on a four or five inch concrete base, with asphalt and sand filler for both of such brick pavements, substantially as hereinbefore de- scribed; and, on or before said last named date, said city engineer shall file with said city clerk estimates of the cost of such paving and ex- cavating of said street with the different kinds of material mentioned herein. Sec. 3. That after buah plans and specifications shall have been made and prEepared by the city engineer and filed with the city clerk, as aforesaid, the mayor and council may advertise for the recep- tion of bids for the paving of said street with the different kinds of paving material named -and , specified in the preceding section hereof, and after the receipt of such bids or proposals the mayor and council shall select from the different kinds of street paving material the kind with which said street ought, in thier judgment, be paved, and may and are hereby authorized to let a contract for the paving of said street with the matariel so selected, to the most satisfactory and re- sponsible bidder, as determined by the said mayor and council, for the kind and character of pavement which shall be determined upon by said mayor and council, said mayor and council reserving the right to reject any. and all bids. Sec. 4. After the passage and publication of this ordinance, the mayor and council shall appoint three"disinterested house -holders, who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to -taxation and assessment for the cost of the improvements herein provided for, shall, within ten days after having been notified of their appointment, .proceed to appraise said lots and pieces of ground liable to assessment and taxation, as aforesaid., without regard to the buildings or improvements thereon, and after making said appraisement shall return the same•to the mayor and council at the first meeting after such appraisement shall have been completed, and after said appraisement is returned to the mayor and council, the said mayor and council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper, and at said special session the mayor and council shall, if they deem it just and proper, alter or change such, appraisement. Bee. 5. For the purpose of paying for the work and improvement in this ordinance provided for, the mayor and council are hereby auth- - orized and directed to issue bonds of the city of _Salina in an amount not to exceed the contract price and cost of such improvement, and to run for a period of ten years and be payable in ten equal installments, together with interest not to exceed five per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas: And for the purpose of paying principal and interest on said bonds as they severally become due and payable the mayor and council shall ap- portion and.assess against the lots and pieces of ground within the tax - Ing district of such improvements special assessments covering the cost Of such improvement, and the apportionment therein contained shall hold good for all the installments that are to be collected from the spe- cific property chargeable with said improvement. Such assessment and apportionment ordinance shall contain the total amount of tax apportion- ed to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annually, at the I - 'I 1 1 IPAy 11 1 1 same time as other taxes are to be certified, certify to the county clerk of Saline county, Kansas, a full list of all property liable for such work and improvement, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amount shall in - elude the annual installments and interest on all unpaid balances for one year at the rate of rive per cent per annum, and such amounts so certified shall be collected as other taxes are collected; Provided, that for the purpose of defraying the cost of improving the squares and areas formed by the crossing of streets and alleys, as well as where the improvement is through -or adjacent to property of the city, for which the city would be liable, the assessments shall be made against all the taxable property of the city. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and pardel of land within the taxing district and shall state the number of annual installments in.which such tax is to be collect- ed; and thereafter the city clerk shall annually, at the same time as other taxes ' are t o be cert if ied, cert if t o the county clerk of Saline county, Kansas, a full list of all property liable for such work amd improvement, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amount shall include the annual installments and interest.on all unpaid balances Z V for one year at the rate of five per cent per. annum, and such amounts so certified shall.be collected as other taxes are collected; Provided, that for the purpose of defraying the coat of improving the squares and areas formed by the crossing of streets and alleys, as well as where the improvement is through or adjacent to property of the city, for which the city would be liable, the assessments shall be n `Wl made against X11 the taxable property of the city -) (�,� Y�U�-�' el� K� V Sec. 6.
