1819 Improve Ninth StreetORDINANCE N0. 1819. (Published in the Salina Evening Journal.February D 1915) An ordinance providing for the paving, curbing, guttering and ex- eavating _of .Ninth street, in the city of Salina, Kansas, between the south line of South Street and the south line of Crawford Street, and providing for, the cost thereof and the manner of payment WHEREAS, by resolution duly adopted on the 7th day of December, 19142 the mayor and council of the city of Salina, have declared that they deem it necessary to pave, curb, gutter and excavate Ninth street in said city between the south line of South Street and the south line of Crawgord street; and., WHEREAS,.said resolution was piblished for more than five consecu- tive days in the Salina Evening Journal, a daily newspaper published in the city of Salina; and, WHEREAS, a majority of the resident owners .of property liable to assessment and taxation for the cost of said improvements did not, with- in twenty (20) days from the last publication of such resolution, file with the city clerk of said city their protest against such improvements or the making thereof; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Ninth street, in the city of Salina, Kansas, .bet•ween the south line of South street and the south.line of Crawford street, be pave, with such. mater- ial as the mayor and council may hereafter designate and select, as hereinafter provided, according to the specifications of the city en- gineer of said city hereinafter provided for, said street to be paved for such a width as the mayor and council may hereafter determine; Pro- vided, that'at the intersections of streets and alleys such paving shall extend to the lot line of said street so improved. Sec. 2. It is necessary and hereby ordered that said Ninth street, between the limits defined in section one hereof, be curbed and gutt8r- ed on both sides thereof with cement curbing and guttering, accord- ing to the specifications of the city_ engineer of said city hereinafter provided for, the curb part thereof to be six inches in thickness and the gutter part thereof to be thirty inches, more or less, from the back edge of such curb to the paving line of said street, and the.lot line edges of such curving shall be set such a distance from the center line of said street as the mayor and council shall hereafter determine; Provided, that at the intersections of streets and alleys said curb and gutter shall return to the lot line on said street improved. Sec. 3. For the work and improvement herein provided for, the city engineer shall make and file with the city clerk, on or before the 15th day of March, 1915, complete plans and specifications for the pav- ing of said street with asphaltic -concrete, asphalt, brick block and vitrified vertical side wire out brick paving block pavement, all on a four or five inch concrete base, with asphalt and sand filler for both of such brick pavements, and for the curbing and guttering of said street with cement curb and gutter, substantially as hereinbebore described; 1 1 1 1 1 and, on or before the said last named date, said city engineer shall file with said city clerk estimates of the cost of such curbing and guttering, and of such paving and excavating of said street with the different kinds of material mentioned herein. Sec. 4. That after such plans and specifeations shall have been made and prepared by the city engineer and filed with the city clerk, as aforesaid, the mayor and council may advertise for the reception of bids for the paving of said street with the differnet kinds of paving material named and specified in the preceding section hereof and for the curbing and guttering of said street, and after the receipt of such bids or proposals the mayor and council shall select from the different kinds of street paving material the kind with which said street ought, in their judgment, be paved, and may and are hereby authorized to let a contract for the curbing and guttering of said street, to the most satisfactory and responsible bidder, as determined by the said mayor and council, for the kind and character of pavement which shall be de- termined upon by said mayor and council, said mayor and council reserv- ing the right .to let the contract or contracts for the paving and exca- vating separately from the curbing and guttering or to let the contract for all of such improvements to one. party, and to reject any and all bids. Sec. 5. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested householders, who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation and assessment for the cost of the improvements herein provided for, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to assessment and taxation, as afore- said, without regard to the buildings or improvements thereon, and after making Siad appraisement shall return the same to the mayor and council at the first meeting thereof after such appraisement shall have been completed, and after said appraisement is returned to the mayor and council the said mayor and council shall designate a time for hold- ing a special session for the purpose of hearing complaints and equal- izing said appraisement, of which special session due notice shall be given in the official city paper; and to said special session the mayor and council shall, if they deem it just.and proper, alter or change such appraisement. 218 See. 6. For the purpose - of paying for the work and improvement in this ordinance provided for, the mayor and council are hereby author- ized and di"rected to issue bonds of the city of Salina in an amount not to exceed the contract price and cost of such improvement, and to run for a period of ten years and be payable in ten equal annual`l_install- menta, together with interest not to exceed fire per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of PeYing, principal and interest on said bonds as they severally become due and payable the mayor and council shall apportion and assess against the lots and'pieces of ground within the taxing district of such improvements special assessments covering the cost of such improvement, and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvement. Such assessment and apportionment ordinance shall contain the total amount of tax appor- tioned to each tract, -piece and parcel of land within the taxing distrct and -shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annually, at the same time as other taxes are to be certified,, certify to the county clerk of Saline coutny, Kansas, a full list of all property liable for such work and improvement, together with the respectilre amounts due on each of said tracts, pieces and parcels of land, which amount shall in - elude the annual installments and interest on all unpaid balances for one year at the rate of five per Genet per_annum, -and such amounts so certified shall be collected as other taxes are collected; Provided, that for the purpose of defraying the cost of improving the squares and areas formed by the crossing of streets and alleys, as well as where the improvement is through or adjacent to property of the city, for which the city would be liable, the assessments shall be made against all the taxable property of the city.
