1818 Improve Fifth Streeti I PAY ORDINANCE N0. 1818 _ (Published in the Salina Evening Journal, Februaryj, d , 1915) An ordinance providing for the curbing and guttering of Fifth Street, in the city of Salina, Kansas, between the south line of Walnut street and toe north line of'Prescott avenue, and providing for the cost thereof and the manner of payment. WHEREAS, by resolution duly adopted on the 7th day of December, 1914s the mayor and council of the city of Salina, Kansas, have declared that they deemed it necessary to curb and gutter Fifth Street in said city between the south line of Walnut street and the north line of Prescott avenue; and, WHEREAS, said resolution was published for more than five consecu- tive days in'the Salina Evening, -Journals a daily newspaper published in the city of Salina; and, WHEREAS, a majority of the resident owners of property liable to assessment and taxat ion' for the cost of such curbing and guttering of such street did not, within twenty (20) days from the last publication of such resolution, file with the city clerk of said city their protest against such improvements or the making thereof; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Fifth street, in the city of Salina, between the south line of Walnut street and the north line of Prescott avenue, be curbed and guttered on both sides thereof with cement curbing and guttering., according to the speci- fications of the city engineer of said city hereinafter provided for, the curb part thereof to be six (6) inches in thickness and the gutter part thereof to be thirty (30.) inches, more or less, fron the back edge of such curb to the paving line of said street, and the lot line edges of such curbing shall be set such a distance from the center line of said street as the mayor and coincil may hereafete determine. Sec. 2. For the work and improvement herein provided, the city engineer shall make and file with the city clerk of said city on or before the 15th day of March, . 1915, plans and specifications for the curbing and guttering of such street with cement curb and gutter of the dimensions, substantially, as hereinbefore described, and on or before said last named date, said city engineer shall file with the said clerk as estimate of the cost of such curbing and guttering; Provided, that at the intersections of streets and alleys said curb and gutter shall return to the lot', line on said Fifth Street. Sec. 3. That after such plans and specifications shall have been filed with said clerk as aforesaid, the mayor and council shall deter- mine the distance such curb and gutter shall be set from the center line of said street, and may then advertise for bids for the construction of such improvements, and may, after the receipt of such bids, let the contract for such improvements to the most satisfactory and responsi- ble bidder as determined by'said mayor and council; or said mayor and council may reject any and all bids for the making of such improve- ments. mprove- ments. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested householders, who, after having_ taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation and assessment for the cost of the improvements herein provided for, shall, within ten days after having been notified of their appointment, proveed to -appraise said lots and pieces of ground liable to assessment and taxation, as afore- said, without regard to the buildings or improvements thereon, and after making said appraisement shall return the same to the mayor -and council at the first meeting thereof after such appraisement shall have been completed, and after said appraisement is returned to the mayor and council the said mayor and council shall designate a time for hold - Ing a special session for the purpose of hearing complaints and equal- izing said appraisement, of wheih special session due notice shall be given in the official city paper; and at said specialsession the mayor and council shall, if they deem it just and proper, alter or change such appraisement. Sec. 5. For tho..purpose of paying for thework and improvement in this ordinance provided for, the mayor and council are hereby author- ized and directed to issue bonds of the city of Salina in an -amount not to exceed the contract price and cost of such improvement, and to run 'fora period of not exceeding ten years and be payable in not exceeding ten equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be made payable at the fiscal agen- cy of the State of Kansas; and for the purpose of paying principal and in- terest an said bonds as they severally become due and payable the mayor and council shall apportion and assess against the lots and pieces of ground within the taxing district of such improvements special assess- ments covering the cost of such improvement, and the apportionment there- in contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvement. Such assessment and apportionment ordinance shall contain the toal amount of tax apportioned to each.tract, piece and parcel of land with the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annually, at the same time as other taxes are to be certified,, certify to the county clerk of Saline county, Kansas, a full list of all prop- erty liable for such work and improvement, together with the respective amounts due on each of said tracts, pieces and parcels of land., which amount shall include the annual installments and interest on all unpaid 1 1 I' 1 I I PA Y 215 u J 1 1 . l balances for one year at the rate ,of five per cent per annum, and such amounts so certified shall be .collected as other taxes are collect- ed; Provided, that for the purTose of defraying the cost of improving the squares and areas formed by the crossing of streets and alleys, as well as where the improvement is through or adjacent to property of the city, for which the city would be liable,, the assessments shall be made against all the taxable .property of the city.
