An ordinance calling a special election in the city of Salina,
Kansas, for the purpose of submitting to the. qualified electors thereof,
the question whether the-sbLid city of Salina, Kansas, shall, issue . it -s
bonds in the sum of Twenty Thousand (20,000.00) Dollars t;.o aid The
Salina Northern Railroad Company in securing and paying for Right of,
Way, Depot Grounds and Terminal Facilities in the City of Salina, Kansas.
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. THAT WHEREAS a petition signed by T. D. Fitzpatrick
and eleven hundred and sixty-eight (1168) others of the resident tax
payers of the City of Salina, Kansas, and being more than twp-fifths
(2/5) of the resident tax payers of the said city of Salina, Kansas, has
been presented to the Mayor and Councilmen of the said city of Salina,
Kansas, for the consideration and action of the said Mayor and Council,
which said petition, with the signatures thereto omitted, is in words
and figures following, to -wit:
"In the matter of voting bonds to aid The Salina Northern Railroad
Company in securing and paying for land for Right of Way, Depot Grounds
and Terminal Facilities in the City of Salina=; Kansas.
To the Mayor and Councilmen of the City of Salina, Kansas:
We, the undersigned your petitioners each being a resident Tax
Payer of the City of Salina, Kansas, a City of the second class, under
and in pursuance of the Laws of the State of Kansas, respectfully pe-
tition your honorable to submit to the qualified electors of said City
of Salina, Kansas, for their acceptance or rejection at a special elect-
ion to be ordered by your honorable body under and in pursuance of the
Laws of the State of Kansas, relating to the issuance of Bonds ih Cit-
ies of the first and second class for the purpose of aiding any Railroad
Company whether operated by steam, electricity or other motive power,
constructing or proposing to construct its line of Railroad in or
through such City in securing and paying for land for Right of Way,
Depot Grounds and Terminal Facilities as the same are more particular-
ly set forth in Paragraphs 7049--7050--7051--7052--7053 and 7054 of the
General Statutes of the State of Kansas, for the year 1909. The follow-
ing proposition with the terms and conditions herein specified, to -wit:
Shall the saic city of Salina, Kansas, issue to the said The
Salina Northern Railroad Company, forty bonds of said City of the de-
nomination of Five Hundred ($500) Dollars each, said bonds to be pay-
able to bearer at the office of the Treasurer of the State of Kansas,
in the City of Topeka, Kansas, thirty years after the date thereof,
bearing interest at the rate of five per cent per annum, interest pay-
able semi-annually for which interest coupons shall be attached, pay-
able at the office of the Treasurer of the State of Kansas, at the
said City of Topeka, in the State of Kansas.

Said bonds aforesaid to be issued upon the following conditions,
namely:
That when said Railroad shall have been built and constructed
and in operation ( by lease or otherwise) from a point at or near the
west end of Elm Street in said city of Salina, Kansas, to Lincoln Cen-
ter, Kansas, and adequate side tracks and switching facilities, built
and constructed in said city of Salina, Kansas, then the Mayor and Coun-
cil of the said city of Salina, Kansas, shall cause one-half in number
and amount of such bonds, with coupons attached, as aforesaid to be is-
sued in the name of said City of Salina, Kansas, and shall deliver the
same to said Railroad Company.
PROVIDED, that said railroad shall have been built and completed
and in operation ( by lease or otherwise) as aforesaid to Lincoln Cen-
ter, Kansas, on or before.the 31st day of'December, A. D. 1915. And
when said railroad shall have been built and constructed and in opera -
ton ( by lease or otherwise) from the said city of Salina, Kansas, to
the City of Osborne, Kansas, then the Mayor and Council of the said City
of Salina, Kansas, shall cause the other one-half in number and amount
of such bonds, with coupons attached,ca-s aforesaid to be issued in the
name of said City of Salina, Kansas, and shall deliver the same to said
Railroad Company, provided, that said Railroad shall be built and com-
pleted, and in operation ( by lease or otherwise) as aforesaid to the
said City of Osborne, Kansas, on or before the 31st day of December,
A. D. 1915.
The form of Ballots to be used at said election shall be:
"For the issuance of Bonds to The Salina Northern Railroad
Company to aid said Railroad Company in securing and paying for Right
of Way, Depot Grounds and Terminal Facilities in the City of Salina,
Kansas", And,
"Against the issuance of Bonds to The Salina Northern Rail -
road Company to aid said Railroad Company in securing and paying for
Right of Way, Depot Grounds and Terminal Facilities, in the City of
Salina, Kansas."
Said railroad company not having heref ofore received any aid from
said City of Salina, Kansas, under any former act of the Legislature
of the State of Kansas."
Sec. 2.. That said petition having been duly filed, and having
been duly etamined and considered, by said Mayor and Council of said
City of Salina, Kansas, said Mayor and Council,do hereby find and declare
that said petition is in writing and that it is subscribed by more than
two-fifths (2/5) of the resident tax payers of the said city of Salina,
Kansas, and that it designates the said The Salina Northern Railroad
Company as the Company to which it is proposed to extend aid in secur-
ing and paying for land for Right of Way, Depot Grounds and Terminal Facil-
ities in and within the said city of Salina, Kansas, and setting forth
the terms and conditions upon which it is proposed to extend such aid to
said Railroad Company and the number and denomination of the Bonds pro-
posed to be issued, together with the terms of the payment thereof, and
that the said The Salina Northern Railroad Company, has not heretofore
received any aid from said City of Salina, Kansas, under any former act
of the Legislature of the State of Kansas.
Sec. 3. That in accordance with the prayer of said petition and
pursuant to and by virtue of and under the authority of the several Stat-
utes of the State of Kansas, in such case, made and provided, it is here-
by ordered and declared by the said Mayor and Council of said City of Sa-
lina, Kansas, that the prayer of said petition be, and the same is here,
by granted, and that it is hereby ordered that a special election shall
be held in the said City of Salina, in the State of Kansas, on the 4th
day of January, A. D. 1915, for the purpose of voting on said proposi-
tion, and that at said special election the question and proposition
as set forth in the hereinbefore recited petition, all of which said
petition if hereby submitted to the legal and qualified electors of the
said City of Salina, Kansas, for their decision by voting by ballot there-
on, as is in said petition designated.
Sec. 4. That said election shall be held at the usual places
for holding general elections in the said City of Salina, Kansas, and
that the same shall be held and that the returns thereof be made, and
the result be ascertained and determined, in the same manner as is pro-
vided by law, for holding general elections, and that the ballots used
at said election shall have written or printed thereon the words:
"For the issuance of bonds to The Salina Northern Railroad Com-
pany to aid said railroad company in securing and paying for Right of'
Way, Depot Grounds and Terminal Facilities in the City of Salina, Kan-
sas." And,
"Against the issuance of bonds to The Salina Northern Rail-
road Company to aid said Railroad company in securing and paying for
Right of Way, Repot Grounds and Terminal Facilities in the City of Sa-
lina, Kansas."

Sec. 5. That the said Mayor of said City of Salina, Kansas,
shall cause to be made due .proclamation and notice to the voters and
qualified electors of the said City of Salina, Kansas, of the submission
of said question and proposition set forth in said petition and this
ordinance to and for their decision at the special election to be held
as aforesaid by publiching the said notice and proclamation for three
consecutive weeks in the Salina Daily Union, a newspaper published in
and having a general.circulation in the said City of Salina, Kansas,
and that in said notice and proclamation the said Mayor shall set forth
this ordinance reciting said petition.
Sec. 6. That this ordinance shall take effect and be in force
from and after its publication once in the Salina Daily Union, a news-
paper of said city of Salina, Kansas, and published therein.
