An ordinance making an appropriation of a certagn sum of money
for the purpose of acquiring certain real estate for railroad right
of way for the Missouri Pacific Railway Company into the proposed
Union Depot in the city of Salina.
WHEREAS, by previous agreement between the City of Salina and
the Missouri Pacific Railway Company and the Chicago, Rock Island and
Pacific Railway Company, it was provided that the city of I Salina should
purchase from the said Chicago, Rock Island, and Pacific Rg'i ilway -Company,
for right of way ground for the Missouri Pacific Railway Company into
hhe proposed union depot now being-constructed in the said city, the
piece of ground hereinafter described, the agreed donsideration and
price for such strip of ground being $4,906.80; and, p
WHEREAS, such sum and amount is hereby determined to be a fair
and reasonable price for the real estate so to be purchased by said
city, as hereinafter described; and,
WHEREAS, by the terms of said agreement it was further provided
that the said The Missouri Pacific Railway Company should'I'convey to

the said City a certain part of its present right of way south
of the real estate hereinafter described, to be used for a public
street of said city, in lieu of the said real estate so to be conveyed

to it by the said The Chicago Rock Island and Pacific Railway Company;
and,
WHEREAS, said the Chicago Rock Island and Pacific Railway company
has made and executed to the said The Missouri Pacific Railway company
a deed for such real estate, and has deposited.the same in the hands
of C. B. Kirtland to be delivered to said. city .upon payment to the.-.said
The Chicago, Rock-Island and Pacific Railway Comapny of the said con-
sideration aforesaid; therefdre,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section l.. There is hereby appropriated out of the city treasury
the sum of Four thousand, nine hundred six and 80100 ($41'31906.80)

Dollars, to be paid to the order, of the Chicago, Rock-Island and
ific Railway Company, in consideration of which the said The Chicago,

Rock Island and Pacific Railway Company shall make and exelcute to the
said The Missouri Pacifie Railway Company,. deed for the f,lollowing
described real estate, to-wit: it

All of Lots 22 and 23, and the south.8 feet of Lots 21 and 24, I
in Block 7; all of Lots 18 and 19, and the south 8 feet of Lots 17 and
20, yin Block 8; all of Lots 1-4 and 15, and the south 8 feet of Lot 13,
and ,all that part of the south 8 feet of ,Lot 16, .lying southerly of the
right of way of the Atchison, Topeka and Santa Fe Railway Company, in
Block 12, all in Depot Addition to the city of Salina;, Also all right,
title and interest in and to the .south 33 feet of the vacated alley in
said Block 12, and all right, title and interest in and to that part of
the east one-half of Twelfth (12th) street, now vacated, in said city
of Salina, lying west of and adjoining the real estate hereinbefore de-
scribed; containing in all 24,534 square feet, more or less.
Sec. 2. That a warrant be drawn on the city treasurer for said
sum of $4,906.80, to the order of the payee mentioned in section one (1)
hereof, and such warrant shall be delivered to said C. B. Kirtland in
exchange for said deed aforesaid; Provided, that before such warrant
shall be exchanged for such deed, the said The Missouri Pacific Railway
Company shall deposit with said C. B. Kirtland proper deeds or conveyan-
ces for the real estate which the Missouri Pacif Railway Company is to
occupy to. said city in accordance with such agreement aforesaid.
Sec. 3. This ordinance shall take effect and be in force from
and after its publication once in the Saline Evening Journal.
