1793 Sidewalk Repair - AshlIPiaY 159 ORDINANCE NO. 1793 (Published in the Salina Evening Journal October 1914.) An ordinance providing for the re-laying and re -construction of a certain sidewalk in the city of Salina, Kansas, and repealing Ordinance No. 1779. WHEREAS, the present sidewalk running along the south side of Ash streetj between the east side of the bridge crossing the Smoky Hill river on said Ash street and Oakdale avenue, when laid, was laid so as to enroach upon the roadway and driveway of said Ash Street and now encroach- es upon said street, and is now below the proper grade of such Ash street; and, WHEREAS, it is necessary to widen the said Ash street, between the limits aforesaid, to its proper width by causing the removal of said sidewalk, and it is necessary to raise said sidewalk to the proper grade of said street; therefore; Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That the present sidewalk running along the south side of Ash street between the bridge crossing the Smoky.Hill river on said Street and Oakdale avenue is hereby ordered to be removed and re-laid as provided for in this ordinance as per the specifications and plans therefor made by the City Engineer and now on file with the City Clerk, which said plans and specifications are hereby made a part of this Ord- inance. See. 2. Said sidewalk shall be re -constructed and re-laid of the width of five feet and the outer edge thereof shall be re-laid six feet from and parallel with the south line of said Ash Street, as shown by the plat books of the city of Salina, now on, f ile in the office of the Register of Deeds of Saline county. Sec. 3. That said sidewalk when re-cbnstrudted and re-laid shall be re-laid on the grade of said Ash street as established by the ordi- nances of said city, and as shown by the said plans and specifications of the said city engineer, and the proper amount of filling shall be done to bring such sidewalk to such grade when re -constructed and re-laid. Sec. 4.. That the owners or owner of all the lots and pieces of ground abutting on the south side of Ash street between the limits afore- said shall re -construct and re-lay said sidewalk as provided in this ordinance before the 19th day of October, 1914; Provided, that the City Clerk shall advertise for bids for the re -construction and re-laying of said sidewalk, as provided for in this ordinance, including the removal and re -setting of any curbing or coping now on the south line of said walk as existing, and the filling and bringing to grade such sidewalk as specified in said specifications, such bids to be received on or be- fore eight o'clock P. M., of the 19th day of October, 1914, and the mayor and council are hereby authorized to let the contract for the re-laying and re -construction of such sidewalk, and of filling and bringing such walk to grade and removal and re -setting such curbing or coping in front of all lots and pieces of ground where the owner or owners thereof fail or refuse to comply with this ordinance before the 19th day of October, 1914. Sec. 5. The Committee on sidewalks of the city council shall make a report to the council of the sidewalk re -constructed and re -built by the City, together with the filling done and the curbing or coping removed and re -set, giving the dimensions and cost of the work done by it and contracted for, and the expense thereof shall be assessed against the real estate abutting thereon, according to the front foot thereof, and such cost and expense shall be taxed against such real estate and collect- ed like other taxes and assessments. Sec. 6. Ordinance No. 1779, passed and approved July 20, 19140 is hereby repealed. Sec. 7.
