1792 Alley Improvements (4th & 5th Street)157- ORDINANCE NO. 1792 (Published in the Salina Evening Journal October 9' , 1914.) An ordinance providing for the paving of the alley between Fourth and Fifth streets, from Iron avenue to Walnut street, specifying the manner of construction, providing for the cost thereof and manner of payment. WHEREAS,'by resolution ugly adopted by the Mayor and Council on the 3rd day of August, 1914, said Mayor and Council.declared and now declare that it is necessary to pave the alley between Fourth and Fifth streets, from Iron avenue to Walnut street; and, WHEREAS, said resolution was published for.more than five days in the Salina Evening Jouvnal, a daily newspaper published in said city; and, WHEREAS, a majority of the resident owners of property liable to assessment for the cost of such improvement did not, within twenty days from the last publication of such resolution., -file with the City Clerk any protest against such improvement or the making of the same; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that the alley between Fourth and Fifth. streets, in the city of Salina, from Iron Av- enue to Walnut street, be,paved with such material as the mayor and coun- oil may select, as hereinafter provided, the full width thereof, viz: ten (10) feet. Sec. 2. All excavating, rolling and filling necessary to prop- erly construct such paving shall be done, and such paving shall be constructed according to the established grade of said alley as provid- ed by the ordinances of said city. SeC. That the specifications for the paving of said alley and the estimated cost of the same, made and prepared by the City Engineer and now -on file with the City Clerk, are hereby approved. Sec. 4. After the passage of this ordinance the city clerk shall advertise for bids for the construction of such paving, to be returned on the 19th day of October, 1914s and after such bids are received, the Mayor and Council shall determine the kind of paving to be used in said alley and are hereby authorized to let the contract therefor. Sec. 5. After the passage.of this ordinance the Mayor and Coun- oil shall appoint three disinterested appraisers who, after having tak- en an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation for the improvement herein provided for, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground so liable to taxa- tion (without regard to any buildings or improvements thereon) and Sec. 6. For the ptrpose of paying for such improvement, the may- or and council are hereby authorized and directed to issue bonds of the city of Salina, in an amount not to exceed the contract price of such work and improvement, and run for such a period of time as the mayor and council shall determine, not to exceed ten years from their date, and made payable in equal installments in each year for the life of said bonds, together with interest not to exceed five per cent (5%) per annum, and made payable at - the fiscal agency of the State of Kansas, and for the pur- pose of paying principal and the interest on said bonds as they severally become due, the mayor and council shall, each year during the life of the bonds levy an assessment against the lots and pieces of ground liable to taxation for the improvements herein provided for, in an amount suffic- ient to pay the principal and interest for that year; and the city clerk shall certify such assessments , as they are severally made, to the coup- ty clerk of Saline county, Kansas, at the same time and in the same man- ner as other city taxes are certified, and said assessments shall be liable to the same penalties al all other taxes. Sec. 6.
