1783 Sewer Improvements - CrawfordI IPA Y ORDINANCE- NO,* 1783- (Published 783.-(Published in the Saline Evening Journal August .F� 1914 ) An ordinance providing for the construction of certain sewers in the city of. Salina, Kansas, providing for the manner of constriction and for the payment of the cost thereof. Be it ordained by the Mayor and Councilmen of t1he City 'of Salina: x.3"7 Section I. That it is necessary and hereby ordered that the follow- . ing described sewers be built and constructed in the city of Salina, Kansas to -wit: An eighteen (18) inch sewer on Crawford avenue between Santa Fe aven ue and Highland avenue, including catch basins and manhdles; A fifteen (15) inch sewer on Highland avenue between Crawford aven- ue and Bond street,. including catch basins and manholes: A twelve (12) inch sewer on Highland avenue between Prescott aven- ue and Crawford avenue, including catch basins and manholes; all as here- - inafter provided. Sec.. 2. That.the plans and specifications of the city engineer of said city,, 'for the'.sewe.rs above described, dated the 30th day of July, 1914,. and now on file with the ciyy clerk,. -are hereby adopted and approved as and for the plans and specifications for such sewers, and are hereby made a part of this ordinance, and all the work herein and in such plans and specifications described shall be done in accordance and compliance with such plans and specifications. Sec. 3. After the passage and publication of this ordinance, the City Clerk, shall advertise for bids for the construction of such sewers in the official city paper, for at least four consecutive Isgues thereof; said bids to be received on or before the 17th day of August 1914, at 5 o'clock p. m. of said day; and, upon receipt and opening of such bids, the mayor and council may, and are hereby authorized to let the.contract for the building and construction of such sewer to the most and satisfactory and responsible bidder, as determined by the said mayor and council; Pro- vided, that no contract shall be let hereunder for a total sum or amount of money which shall be in excess of the total estimated cost of such sewer, estimated and made by the city as engineer of said city, which said city engineer is hereby directed to make and file with the city clerk on or before the 17th day of August, 1914. Sec. 4. That the person to whom said contract is awarded as afore- said shall execute a written contract with said city for the building and construction of such sewer aforesaid, and shall file with the city clerk, a,good and sufficient bond, in the total sum of said contract, conditioned that he will build such sewers according to said plans and specifications, j that he will re -fill the ditches made in said Highland and Crawford aven- ues in the building thereof, that he will fulfill all guaranties made in said specifications and hold and save the city of Salina harmless from all damages to persons or property that may arise through his carelessness in performing said contract. Sec. 5. The cost and expense of constructing such sewers and com- pleting the same shall be assessed against all lots and pieces of ground contained in the city of Salina as a sewer district, as provided by Ord- inance No. 618 of the city of Salina, padned and approved December 23, 1887, and the mayor and council are hereby authorized to provide for the Payment of the cost thereof by installments instead of levying the entire tax or special assessment for such cost at one time, and for such Install- ments they may issue improvement bdinds of the city of Salina, payable in. installments of equal amounts each year, none of which bonds nor the in- stallments thereof shall run longer than ten years or'bear interest ex- ceeding five per cent per.Jannum, and such bonds may be delivered to the contractor constructing such sewer in payment thereof, or, the mayor and council may sell said brands at not less than their par value and nay said contractor out of the proceeds therefo, and such.bonds small be of such denominations as the mayor and council mgy deem proper; and, for the pur- pose of paying principal and interest on said bonds -as they severally be- come due the mayor and council shall, each year during the life of said bonds, levy an assessment against all taxable property in said city at the assessed value thereof for general revenue purposes in an amount sufficient to pay the principal and interest for that year; and the city clerk shall certify such assessments as they'are severally made to the county clerk of Saline county, Kansas, at the same time and in the same manner as other taxes of said city are certified. pec. 6.
