1780 Issue Bonds• ORDINANCE NO. 1780. (Published in the Salina Evening Journal August , 1914) Providing for the -issue _ of $16,,000.00 of Bonds of the City of Sa- lina, Kansas, to compromise and refund certain existing legal bonded in- debtedness of said City. WHEREAS, the City of Salina, in the State of Kansas, did on or about the lst day of July 1899, by due and legal proceedings and ordinances under authority of the Laws of Kansas, cause to be issued $44jO0O.0O of Refunding Bonds, of said city, bearing interest at five (5%) per cent per annum, pay- able semi-annually on January lst and July lst each year, in denomination of $1,000 each, and due July 1st, 1914, which said bonds were dated July lst, 1899, and WHEREAS, there are yet outstanding and unpaid of said issue of Bonds $16,000.00, being sixteen (16) Bonds of $1,000.00 each, numbered as follows: 1, 2, 5, 6, 7, 22, 23, 242 252 26, 27, 28, 29, 30, 43, and 44, which con- stitute a valid and binding indebtedness of said city, and upon which all interest has always been paid promptly, including the last interest coupons to mature thereon on July lst, 1914,.and WHEREAS, there is no sufficient sinking fund on hand in the Treasury of said City, created or existing, available for the payment of said Bonds yet outstanding as above recited, and WHEREAS, it is deemed to the best interests of said city, that said Bonds and the indebtedness thereby represented, be refunded in accordance with the Laws of the. State of Kansas, Now therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. ' hat f.or the purpose of Refunding $16,000.00 of the out - standing Bonds of the City of Salina, Kansas, being sixteen (16) Bonds of $1,000.00 denomination, numbered: 1, 2, 5, 6, 7, 22, 23, 24, 25, 26, 27, 28, 29, 309 43 and 442 both inclusive, all dated July 1st, 1899, and due July lst, 19142 bearing five per cent (5%) interest, being the unpaid balance of an issue of $442000.002 duly and legally made by the City of Salina on or about July lst, 1899. The mayor of said city shall sig and the City Clerk of said City shall attest under the seal of said city sixteen (16) new Re- funding Bonds of 1,000.00 each, to be numbered one (1) to sixteen (16), both numbers inclusive, for exchange as hereinafter provided, with coupons attached thereto for interest thereon at five per cent (5%) per annum, pay- able semi-amnually on January lst and July lst of each year, which coupons shall bear fac simile lithographic copies of the signatures of said Mayor and said City Clerk respectively, which lithographic signatures are hereby expressly authorized and shall be a valid and legal execution of said cou- pons as fully as the actual signatures of such officers thereto. The Bonds hereby authorized shall be issued in conformity with and in pursuance, and by authority of "An Act to enable Counties, Municipal Corporations, Boards of Education of any City and School District to refund their indebtedness", 1 1 1 1 1 I PAY Y -12.9 Or should the present holders of said outstanding Bonds fail or refuse to present the same for exchange as herein authorized, the said Mayor is.here- by authorized and dirdcted to sell the new Refunding Bonds hereby author- ized at.not less than their par value, represented by the face of each Bond and interest accrued from and after July 1st, 1914, and to pay and cancel the Bonds heretofore described now outstanding. And upon such ex- change or sale being made as above provided, the new Bonds hereby author- ized shall be legal 'evidenc4 of v,*Ild and binding indebtedness of Salina, Kansas. Sec. 4. Thereupon, and upon the delivery of said new five per cera (511'1,) Refunding Bonds in . exchange for the old five per cent (5 O ) Bonds, as above specified, the Mayor and Clerk shall issue proper cRr* o;ic�• es to the effa t that the said sixteen (16) five per cent (50) Bonds de- scribed of One Thousand ($1,000.00) Dollars each, have been cancelled as required by this Ordinances and by law, and have been filed in the office of the County Clerk as herein required, and deliver the same to the hold- er of said Bonds os refunded, together with the five per cerit (5%) Re -funding Bonds hereby authorized. And said County Clerk of Saline County shall thereupon register the said sixteen (16) new Refunding Bonds in the Bond Register of his office according to law, and he shall certify on each bond that the same have been registered by him. which took effect March 10, 1879, being Chapter 50 of the Laws of 1879 of the State of Kansas and amendments thereto now in force. Such new Bonds shall be dated July 1st, 1914, and the interest and principal there- of shall be made payable at the office of the State Treasurer of the State of Kansas at Topeka, Kansas, and the said Bonds shall be due as fol- lows: July 1st, 1919. Sec. -2. Said Refunding Bonds, when executed, shall be registered- egisteredwith withthe City Clerk of Salina, Kansas, the County Clerk of Saline County, Kansas,.and with the Auditor of the State of Kansas,,as required by law. Sec. 3. it is further provided, that when said new Refunding Bonds to be issued hereunder, are fully executed with the coupons for the in- terest attached as provided herein, they shall be delivered by the Mayor of the City of Salina, to the owners and holders of said Bonds to be re- funded in actual manual exchange for sixteen (16) five per cent (5/) Bonds of the date.of July 1st, 18992 upon presentation thereof, Bond for Bond, and dollar for dollar, at their par value, and upon delivery od said new bonds hereby authorized, the said five per cant (5%) Bonds described, so exchanged, shall be cancelled and marked "Paid in Full" across the face of each of said coupons, and said old Bonds and coupons when cancelled shall be filed in the office of the County Clerk of Saline county, Kansas. And said County Clerk of Saline County shall thereupon register the said sixteen (16) new Refunding Bonds in the Bond Register of his office according to law, and he shall certify on each bond that the same have been registered by him. There is hereby levied annually at the time stated time of making such levy of other taxes, a tax sufficient in amount to pay the Interest on said Bonds represented by said coupons as they became due, and to create a sinking fund for redemption of said Bonds as they mature, which shall be collected with the other taxes in said county and paid into the Treasury of the County as provided by-law for other taxes, and the same shall be and remain a specific fund for the redemption of said Bonds, prin- cipal and interest as the same shall mature.
