1777 Alley Improvements (Santa Fe & 7th)WAY ORDINANCE NO. 1777. (Published in the Salina Journal Julv 9-rs." 1914.) An ordinanee providing for the re -paving of the alley between Santa Fe avenue and Seventh street from the south line of Iron avenue to the south line of Lot No..115 on Seventh street and No. 116 on Santa Fe Aven- ue, and providing for the assessment of the cost thereof and the manner of payment. WHEREAS, by resolution duly adopted by the mayor and council on the first day of June, 1914, said mayor and council declared and now de- clare that it is necessary to pave the alley between Santa Fe Avenue and Seventh street from the south line of Iron avenue to the south line of Lot No. 115 on Seventh street and No. 116 on Santa-Fe-Avenuq;aarlo, WHEREAS, said resolution was published for more than five days in the Salina Evening Journal, a daily newspaper published in said city; and, WHEREAS, a majority of the resident owners of property liable to assessment for the cost of such improvement did not, within twenty days from the last publication of such resolution, file with the city clerk any protest against such improvement or the making of the same; therefore, Beit ordained by the Mayor aid Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that the alley between Santa Fe avenue and Seventh street, in the city of Salina, Kan- sas, from the south line of Iron avenue to the south line of Lot No.115 on Seventh street and No. 116 on Santa Fe avenue, be re -paved, as in this ordinance provided. Sec. 2. That such alley be re -paved the present width of the same and for the length hereinbef ore described and in the form and manner as specified in the engineer's specifications therefor hereinafter provid- ed. . Sec. 3. That the city engineer of said city shall make and pre- pare, and file with the city clerk, on or before the 27th day of July, 1914, meeting of the mayor and council, specifications for the re -paving of such alley, naming therein concrete and brick block, or concrete found- ation paving material, and, after the filing of such specifications, the city clerk shall advertise for bids for the re -paving of such alley, to be returned before the next regular meeting of the mayor and council, and after the receipt of such bids the mayor and council shall select the kind of material with which such alley shall be re -paved, and may let the contract therefor; and such engineer shall, before such contract is let, file with the said clerk his estimate of the cost of such improve- ment. Sec. 4. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested appraisers who, after having taken an oath to faithfully and impartially appraise all lots and .123 124 U Pieces of ground liable to taxation, without regard to the buildings and improvements thereon, for the improvement herein provided for, shall, within ten days after having been notified of their appointment, proceed to appraise daid lots and pieces of ground liable to taxation (without regard to any buildings or improvements thereon), and, after making said appraisement, shall return the same to.the mayor and council at the first meeting thereof after such appraisement shall have been completed, and after such appraisement is returned to the mayor and council, said mayor and council shall set a time for holding a special session for the pur- pose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper, and at said special session the mayor and -council shall, if they deem it just and proper, alter or change such appraisement. Sec. 5. For the purpose of paying for such re -paving of said alley, the mayor and council shall apportion the cost thereof between the prop- eryy liable in'proportion to the value of such property as made and giv- en by said appraisers and levy assessments against such property there- for, said assessments to be divided into such number of annual payments as the mayor and council may determine, or to be levied as one assess ment and collected at one time, or the mayor and council may divide such assessments into annual payments and issue.bonds therefor, none of which assessments or bonds, however, shall run for a longer period than ten years, and shall bear interest on the deferred payments*at not to ex- ceed interest at five per cent per annum Sec. 6.
