1774 Improve Tenth StreetORDINANCE NO. 1774.

An ordinance specifying and selecting the paving material to be
used, and letting the contract for the paving, excavating, curbing and
guttering of certain portions of Tenth street in the City of Salina.
Whereas, under the provisions of Ordinance No. 1776, passed and ap-
proved May 25, 1914, the mayor and council determined to pave, curb and
gutter Tenth street, in the city of Salina, between the north line of
Iron avenue and the south line of Ash street; and,
Whereas, proposals for doing such paving., curbing and guttering and
for excavating said street have been filed with the city clerk, as pro-
vided in said Ordinance No. 1776, and such prop6sals have been examined -
by the mayor and council, and the proposal of Watts & Amerman is hereby
found and deterimed to be the most satisfactory proposal for the kind
and character of pavement hereinafter designated and selected; and,
Whereas, the proposal of Watts and Amerman is hereby found and de-
termined to . be the most satisfactory proposal for the curbing and gutter-
ing of said street, within the limits aforesaid; and,
Whereas, the total cost of paving and excavating and of curbing and
guttering said street under said proposals aforesaid does not exceed the
estimated cost of such improvements as heretofore estimated by the City
Engineer of the City of Salina, which said estimate of cost is now on file
with the City Clerk. Therefore,
Be it orddined by the Mayor and Councilmen of the City of Salina;
Section 1. The mayor and council hereby determine that said Tenth
street, between the north line of Iron avenue and the south line of Ash
street, shall be paved with Bermudas Lake Aphhaltic-Concrete paving mat-
erial, as specified in the specifications of the City Engineer therefor,
filed by him with the City Clerk on the 25th day of May 1914, and which
specifications are hereby adopted and approved as and for the specifica-
tions for the paving, curbing, guttering and excavating of said street,
and such Bermudas Lake Asphaltic*Concrete paving material is hereby se-
lected for the pavement of said street.
Sec. 2. That a contract be and is hereby let to Watts & Amerman,
of Salina, Kansas, for the paving and excavating of said Tenth street,
between the north line of Iron avenue and the south line of Ash street,
at and for the uniform price of one dollar and fifty cents ($1.50) per
square,yard for the square yards of such pavement with a concrete bbse
as specified, actually laid on said street; and for the excavating nec-
esarry to properly construct such pavement, said contractors shall be
paid at the rate of thirty-three (33�) cents per cubic yard for the cubic
yards actually removed from said street, all as computed and measured by
the City Engineer.

Sec. 3. That a contract be and is hereby let to Watts & Amerman
for the curbing and guttering of said street, as abovw defined, at and
for the uniform price of fifty-five cents (55/) per lineal foot for the
lineal feet -of curbing and guttering, as specified, actually constructed
.and put in place on said street, as computed and measured by the City
Engineer.
Sec, 4. That such contracts are awarded upon the express condition
that the work and improvement thus awarded shall be done in strict ac-
cordance with the specifications of the City Engineer therefor, which
are hereby made a part of this ordinance and of the contract hereby award-
ed; and upon the further condition, among others, that said Watts & Amer-
man shall give to the City a surety bond, in the approximate sum of the
cost of such paving when laid, guaranteeing such pavement against all
cracks, depressions and settlements and faulty material and workmanship
for a period of five years from and after it is laid and accepted by
the City.
Sec. 5. The City Attorney is hereby directed to make and prepare
a contract with the parties above named for the contracts herein let and
awarded to them respectively and that the Mayor and Clerk execute such
contracts on the part of the City.
Sec. 6. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
