An ordinance specifying and selecting the paving material to be
used, and letting the contract for the paving and excavating and for the
curbing and guttering of certain portions of Highland avenue in the City
of Salina, and amending sections one (1) and two (2) of Ordinance
No. 1765.
Whereas, under the provisions of Ordinance No. 1765, passed and
approved May 25, 1914, the mayor and council determined to pave, curb
and gutter Highland Avenue, -in the City of Salina, between the south line
of Prescott avenue and the north line of Republic avenue; and,
Whereas, proposals for doing such work and improvements have been
filed with the city clerk and been examined by the mayor and council,
and the proposal of Watts & Amerman is hereby found and determined to
be the most satisfactory proposal for the kind and character of pavement
hereinafter designated and selected for said street; and,
Whereas, the proposal of Watts & Amerman is hereby found and de -
terminad to be the most satisfactory proposal for the curbing and gut-
tering of said street, within the limits aforesaid; and,
Whereas, the cost of said improvements, that is to say; the pav-
ing, curbing, guttering and excavating of said street, under said pro-
posals does not exceed the estimated cost of the same heretofore esti-
mated by the city engineer of the city of Salina, which said estimate of
cost is now on file with the City Clerk; therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That the mayor and council hereby determine that said
Highland avenue, in the city of Salina, between the south line of Pres-
cott avenue and the north line of Republic avenue, shall be paved with
Bermudas Lake Asphaltic -Concrete paving material, as specified in the
specifications of the city engineer therefor, filed by him with the City
Clerk on the 25th day of May 1914, and which said specifications are
hereby adopted and approved as and for the specifications for the paving,
curbing and guttering of said street', and such paving material is here-
by selected for the paving of said street.
Sec 2. That a contract be and,is hereby let to Watts & Amerman,
for the paving and excavating of said Highland avenue between the south
line of Prescott avenue and the north line of Republic avenue, with the
material above selected, at and for the uniform price of One and 50100
Dollars, 01.50) per square yard, for the square yards of such pave-
ment and concrete foundation actually laid on said street, and for the
excavating necessary to properly construct such paving, said contractor
shall be paid at the rate of Thirty-three (33¢) cents per cubic yard,
for the cubic yards of dirt actually removed from said street; all as
computed and measured by the City Engineer.

Sec. 3. That a contract be and is hereby let to Watts & Amerman,
for the curbing and guttering of said street as above defined at and for
the uniform price of Fifty-five (55¢) cents per lineal foot, for the lineal
feet of curbing and guttering actually constructed, laid and put in place on
said street; as computed and measured by the City'Engineer.
Sec. 4. That such contracts are awarded upon the express condition
that the work and improvements shall be done in strict accordance with the
specifications of the city engineer therefor, which specifications are here-
by made a part of this ordinance and of the contract hereby awarded; and
upon the further condition, among others, that said Watts & Amerman shall
give to the City a surety bond, in the approximate sum of the cost of such
paving when laid, guaranteeing such pavement against all cracks, depressions
and settlements and faulty material and workmanship for a period of five
years from and after it is laid and accepted by the City.
Sec. 5. That section One (1) of Ordinance No. 1765, passed and ap-
proved May 259 1914, be amended so as to read as follows, viz: "Section 1.
That it is necessary and hereby ordered that Highland avneue, in the City
of Salina, Kansas, between the south line of Prescott avenue and the north
line of Republic avenue, be paved with such material as the mayor and coun-
cil may hereafter designate and select, as hereinafter provided, said'pav-
ing to be thirty (30) feet in width, from gutter to gutter, except that at
the intersections of streets and alleys such paving.shall extend to the
lot line of said Highland Avenue."
Sec. 6. That section Two (2) of said Ordinance No. 1765, be amended
so as to read as follows, viz: "Sec. 2. That it is necessary and hereby
ordered that Highland Avenue, between the limits defined in section One (1)
hereof, be curbed and guttered on both sides thereof with cement curb and
gutter, according to the specifications herein adopted, the curb part there-
of to be six inches in thickness and the gutter part thereof to be thirty
inches, more or less, from the back edge of such curb to the paving line of
said street, and the face edge of such curbing shall be seventeen (17)
feet from and parallel with the center line of said street; provided, that
at the intersections of streets and alleys such curb and gutter shall ex-
tend to the lot line of said Highland Avenue.
Sec. 7. That original sections One (1) and Two (2) of Ordinance No.
1765 be_and each of them are hereby repealed.
Sec. 8. That the city attorney is hereby directed to prepare a con-
tract or contracts with the party or parties above named for the work and
improvement herein let and awarded to them respectively, and that the Mayor
and Clerk execute such contracts on the part of the City.

Sec. 9. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal..
