ORDINANCE NO. 17.66. -

An ordinance providing for the paving, curbing, guttering and excav-
ating of Tenth street, in the city of Salina, betweenthe north line of
Iron Avenue and the south line of Ash street, specifying the manner.of
construction and providing for the cost thereof and the manner of pay-
ment.
Whereas, there has been preented to the mayor and council a petition
requesting said mayor and c until to pave, curb, gutter and excavate
Tenth street, in the city of Salina, Kansas, and,
Whereas., said petition has been found, by said mayor and council, to con-
tain the names of a majority og the resident property owners owning prop-
erty fronting on both sides of said Tenth street as well as a majority
of the resident property owners on both sides of said street to the
center of the block on either side thereof, between the limits above
def ined, therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That it, is necessary and hereby ordered that Tenth stred.
in the city of Salina, Kansas, between the north line of Iron avenue
and the south line of Ash street, be paved, with such material as the
Mayor and Council may hereafter designate and select, as hereinafter pro-
vided, said paving to be thirty-three (33) feet in width, from gutter to
gutter, except that at the intersections of streets and alleys such pav-
Ing shall extend to the lot line on said Tenth street.
Sec. 2. It is necessary and hereby ordered that said Tenth Street,
between the limits defined in section,one hereof, be curbed and guttered
on both sides thereof with cement curbing and guttering, according to the
spec.ificati'ons hereinafter adopted, the curb part thereof to be six in-
ches,in thickness and the gutter prt thereof to be thirty inches, more
or less, from the back edge of such curb to the paving line on said
street, and the lot line edge of such curbing shall be eighteen and one-
half (182):feet from and parallel with the center line of said street;
Provided, that at the.intersetions of streets and alleys such curbing
and gutter shall extend to the lot line of said Tenth street.
Sec. 3. All excavating, rolling and filling for the proper con-
struckion of such paving, curbing and guttering shall be done, and such
paving shall be laid on the established grade of said Tenth street as
heretofore or hereafter established by the ordinances of the city of
Salina.
Sec. 4. That the specifications of the City Engineer for the work
and improvement herein specified, and now on file with the city clerk
are hereby adopted as and for. The specifications for the improvement
of said street, which specifications cover and embrace the different
kinds of street paving, such as brink block, asphaltic concrete and ce-
ment, with.concrete foundation, and cement curb and gutter;.and said
engineer shall also file with said clerk an estimate of the cost of the
work and improvement herein provided for.
Sec. 5. The City Clerk shall advertise for bids for - the different.
kinds of streets paving therein specified, and for such curbing, gutter-
ing and excavating, and, after the receipt of such bids, if the same are
found to be satisfactory to the mayor and council, said mayor and council
shall determine the kind of paving material to be used on said street,
and may let the contract for the paving of saidstreet with the material so
selected and for the curbing and guttering of said street, said bids to be
received and returned on or before the 15th day of June, 1914.
Sec. 6. -After the passage of this ordinance, the mayor and council
shall appoint three disinterested householders who after having taken an
oath to faithfully and 'impartially appraise all lots and pieces of
ground liable to taxation for the improvements heeein provided for,.shall
within ten (10) days after having beenz-Mbtifiiedi6f itheir appointmenty.Upro�
teed to appraise said lots and pieces of ground liable totaxation (without
regard to any buildings or improvements thereon) and after making said ap-
praisement, shall return the same to the mayor and council at the first
meeting thereof after sick appraisement shall have been completed, and
after such appraisement is returned to the mayor and council, the said
mayor and council shall designate a time for holding a special'session
for the purpose of hearing complaints and equalizing said appraisement,
of which special sexsion due notice shall be given in the official city
paper, and at said special session, the mayor and council shall, it they
v deem it just and proper, alter or change such appraisement.
Sec. 7 For the purpose of paying for such paving, curbing and
guttering and excavating, the mayor and council are hereby authorized and
directed to issue bonds of the city of Salina, in an amount not to ex-
ceed the contract price, and to run for such a period of time as the Mayor
and Council shall determine, not exceeding however ten -years from the
date of such bonds and be payable in equal installments in each year for
the life of said bonds, together -with interest not- to exceed five (5) per
cent per annum, which bonds shall be made payable at the fiscal agency of
the Statd of Kansas, end for the purpose of paying principal and interest
on said bonds as they severally become due the mayor and council shall
each year during the life of said bonds, levy an assessment against the
lots and pieces of ground liable to taxation for the.improvements herein
provided fro in an amount sufficient to pay the principal and interest
for that year; Provided, that for the purpose of defraying the cost of
paving and otherwise improving the squares and areas formed by the inter-
sections of streets and alleys as well as where the improvements are
through or adjacent to property of the city, for which the city would be
liable, the assessments shall be made against all the taxable property
of the city, and the city clerk shall certify said assessments as they
are severally made, to the county clerk of Saline county, at the same
time and in the same manner as other city taxes are certified, and said
assessments shall be liable to the same penalties as all other taxes.
Sec. 8. This ordinance shall take effect and be in force from
and after its publication once in the Salina Evening Journal.

An ordinance providing for the paving, curbing, guttering and
