1765 Improve Highland Avenue.ORDINANCE_NO. 1765. .. An ordinance providing for the paving, curbing, guttering and ex- cavating of Highland avenue, in the city of Salina, between Prescott av- enue and Republic avenue, specifying the manner of construction and providing for the cost thereof and manner of payment. Whereas, there has been presented to the mayor and council a pe- tition requesting said mayor and council to pave, curb, gutter Highland avenue, and Whereas, said petition has been found to contain the names of a majority of'the resident property owners owning property fronting on both sides of said Highland avenue as well as a majority of the resident property owners on both sides of said street to the center of the block on either side thereof, between the limits above defined; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That is is necessary and hereby ordered that Highland avenue,\in the city of Salina, Kansas, between the south line of Prescott\\ae he couth line of Republic avenue, be paved, with such pavias the Mayor and Council may hereafter designate and selecfter provided, said paving_to be thirty-three(33) feet in wgutter to gutter, except that at the intersections of streets ah paving shall extend to the lot line on said Highland avenue. \ Sec.' 2. That if ib�-hecessary and hereby ordered that said High- land avenue, between the 1%�jts defined in section one hereof, be, curbed and guttered on both sides th**ueof with cement curbing and guttering, according to the specifications ere in adopted, the -curb part theveof to be six inches in thickness and a gutter part thereof to be thirty inches, more or less, from the back,cgge of such curb to the paving line of said street, 'aAd the lot line edge _o such curbing shall be eighteen and one-half (18 -al) feet, from, -and paralle17�V.ith the center line of, said street; provided, that at the intersections of streets and alleys such curb and gutter shall extend.to.the.-lot. line of\ said Highland avenue. Sec. 3. All excavating, rolling and filling necessary for the proper construction of such paving, curbing and guttering shall be done, amd such paving, curbing and guttering shall belaid and constructed on the established grade of said Highland avenue as heretofore or hereafter established by the ordinances'of said city. Sec. 4. That the specifications of the City Engineer, for the • work and improvement hedein specified, are now on file with the City Clerk, are hereby adopted as and for the specifications for the Improve - went of said street, which specifications cover and embrace the different kinds of street giving, such as brick block, asphaltic -concrete and ce- merit, with concrbte foundation, and cement curb and gutter, and said 1 1 1 1 1 I PAY 95 1 1 1 1 F� engineer shall also file with said clerk an estimate of the cost of the Work and improvement herein provided for. Sec. 5. The city clerk shall advertise for bids for the different kinds of street paving therein specified, and for such curbing, guttering and excavating, and, after the ,receipt of such bids, if the same are found to be satisfactory to the mayor and council, said mayor and council shall determine the kind of paving material to be used on said street, amd may let the contract for the paving of said street with the material so selected, and for the curbing and guttering of said street, said bids to be received and returned on or before the 15th day of June 1914. Sec. 6. .After the passage of this ordinance, the mayor and council shall appoint three disinterested househoulders who after having taken an oath to fathtfully and Impartially appraise all lots and pieces of ground liable to taxation for the improvements herein provided for, shall, within ten_(10) days after having been notified of their appoint- ment proceed to appraise said lots and pieces of ground liable to taxa- tion (without regard to any buildings or improvements thereon) and after making said appraisement, shall return the.same to the mayor and council at the first meeting thereof after such .appraisement shall have been. completed, and after such appraisement is returned to the mayor and coun- cil the said mayor and council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper, and at said special session the mayor and coun- cil shall, if they deem it -just and proper, alter or change such ap- praisement. Sec. 7. For the purpose of paying for such paving, curbing and guttering and excavating, the mayor and council are hereby authorized and directed to issue bonds of the city of Salina, in an amount not to exceed the contract price and to run for such period -of time as the mayor and council shall determine, not exceeding however ten years from the date of such bonds and be payable in equal installments un each year for the life of said bonds, together with interest not to exceed five (5) per cent per annum, which bonds shall be made payable at the fiscal agency of the State of.;Ransas, and for the purpose of paying principal and interest on said bonds as they severally become due the mayor and council shall each year, during the life of said bonds, levy an assessment against the lots and pieces of ground liable to taxation for the improvements herein provided for in an amount sufficient to pay the principal and interest for that year; Provided, that for the purpose of defraying the cost of paving and otherwise improving the. squares and I .11 areas formed by the intersections of streets and alleys as well as where the improvement is through or adjacent to property of the city, for which the city would be liable, the assessments shall be made against all the taxable property of the city; and the city clerk shall certify said assess- ments as they are severally made, to the county clerk of Saline county, at the same time and in the same manner as other city taxes are certified, and said assessments shall beliable to the same penalties as all other taxes. That it is necessary and hereby ordered that said Highland avenue, between the limits defined in section one hereof, be curbed and guttered on both sides thereof with cement curbing and guttering, according to the specifications herein adopted, the curb part thereof to be six inches in thickness and the gutter part thereof to be thirty inches, more or less, from the back edge of'such curb to.the paving line of said street, and the lot line edge of such curbing shall be eighteen and one-half (182) feet from and parallel with the center line of said street;provided, that at -the intersections of streets and alleys such curb and gutter shall extend to the lot line of said Highland Avenue, Sec. 3.. All excavating, rolling and filling necessary for the proper construction of such paving, curbing and guttering shall be done, and such paving, curbing and guttering shall be laid and constructed on the established grade of said Highland avenue as heretofore or hereafter established.by the ordinances of said city. Sec. 4. Sec. 5.
