1761 Improve Walnut StreetIN Y 87 ORDINANCE NO. 1761 (Publishedin the Salina Evening Journal May .7i 1914.) An ordinance specifying and selcting the paving material.to be used and letting the contract for the paving and excavating, and for the curb- ing and guttering of certain portions of Walnut street in the City of Salina. Whereas, under the provisions of Ordinances rigimbered 1749 and 1750, 1 passed and approved March 2, 1914, the mayor and council determined to pave, curb and gutter Walnut street, in the city of Salina, between Tenth street and College avenue and between the west side of the Walnut street bridge and Fifth st ret ; and, Whereas, proposals for doing such paving, curbing and guttering have been filed wigh the city clerk, as provided in said Ordinance No. 1749 and 1750, and such proposals have been examined by the Mayor and Council, and the proposal of the Kaw Paving Company is hereby found and determined to be the most satisfactory proposal for the kind and char- acter of pavement hereinafter designated and selected; and, Whereas, the proposal of The Kaw Paving Company of Topeka, Kansas, is hereby -found and determined to be the most satisfactory proposal for the curbing and guttering of said street, within the limits aforesaid; and, Whereas, the cost of paving and excavating,, and of curbing and gut- tering, said street under said proposals does not exceed the estimated cost of the same as heretofore estimated by the city engineer of the city of Salina, which said estmate of cost is now on file with the city clerk; and., Whereas, since the 2nd day of March, 1914, -the mayor and council duly passed a resolution declaring it necessary to improve said Walnut street, between the limits hereinbefore set forth, in the manner set forth in said Ordinances numbered 1749 and 1750, and duly caused such resolu- tions to be published for ten days in the official city paper, and that within the time prescribed by law no protest was filed with the mayor and council against the making of the improvements specified in said resolutions'; therefore, Be it ordianed by the Mayor and Councilmen of the City of Salina: Section 1. That the mayor and council hereby determine that said Walnut street, between the limits hereinbefore defined, shall be paved with One -Course Vitrified Vertical Fiber Side Wire Cut Brick Paving Blocks pavement, on a five inch concrete base with asphalt filler, as specified in the specifications of the city engineer therefor filed by him with the city clerk on the 16th day of March, 1914, and whuch specifications are hereby adopted and approved as and for the specifications for the paving, curbing and guttering of said street. Sec. 2. That a contract be and is hereby let to the Kaw Paving Company, for the paving and excavating of said Walnut street between the east side of Fifth street and the west side of the present Walnut street bridge and the west side of Tenth street and the, east side of College avenue, at and for the uniform price of One and 76100 Dollars, ($1.76) per square yard for the square yards of suc7g pavement and concrete found- ation actually laid on said street, and at One and 87100 Dollars ($1.87) for the paving of the Street Railway right of way, and for the excavat- ing necessary to properly construct such pavement, said contractor shall be paid at the rate of thirty-three cents (33¢) per cubic yard for the cubic yards of dirt actually removed from said street, all as computed amd measured by the city engineer. Sec. 3. That a contract be and is hereby let to the Kaw Paving Company for the curbing and guttering of said street as above defeind at and for the uniform price of fifty-eight cents (58�) per lineal foot for the lineal feet of curbing and guttering actually constructed, laid and put in place on said street, as computed and measured by the city engineer. Sec. 4. That such contracts are awarded upon.the express condi- tion that the work and improvement thus awarded shall be done in strict accordance with the specifications of the city engineer therefor, which specifications are hereby made a part of this ordinance and of the con- tract hereby awarded. Sec. 5..The city attorney is hereby diredted to make and prepare a contract with the parties above named for the contracts herein let and awarded to them respectively, and that the mayor and clerk execute _ "I such contracts on the part of the city.
