An ordinance providing for the raving, curbing, guttering and
excavating of Walnut stret, in the city'of Salina, Kansas, between
the East side of Fifth street and.the West side of tr,.e present Walnut
street bridge, specifying -the manner of construction and providing
for the payment of the cost thereof and the manner of payment.

Whereas, such petition has been examined by said mayor and coun-
cil and found to contain a majority of the names of the resident own-
ers of property owning property abutting on both -sides of said Walnut
street between the limits above set fohth, and that the mayor and coun-

Sec.,2. That it is necessary and h\hef,

Sec. 3. All excavating, filling and rolling necessary for the
proper construction of such paving, curbing and guttering shall be done,
and such paving, curbing and guttering shall be done and constructed
according to the established grade of said Walnut str3et, as heretofore
or hereafter established by the ordinances of said city.
Sec. 4. For the work and improvements herein provided for, the
city engineer shall make and file with the city clerk, on or before the
16th day of March, 1914, plans and specifications thereof, which speci-
fications whall cover and embrace the different kinds of street paving,
such as brick block, asphaltic -concrete and cement, with concrete found-
ation, and cemet curb and gutter; and said engineer shall also file

herein provided for.
5. After such ,pl6Lns and specifications shall have been filed
with said city clerk, the mayor and council shall advertise for bids for
the -different kinds of street paving therein specified, and for such
curbing, guttering and excavating, arid, after the receipt of such bids,
if the same are found satisfactory to the said mayor and council, said
mayor and council shall determine the kind of paving material to be used
on said street, and may let the contract for the paving of said street
with the material so selected, and for the curbing., guttering and exca-
vating of said street.
Sec. 6. After the passage and publication of this ordinance the
mayor and council shall appoint three disinterested householders who,
after having taken theft oath to faithfully and impartially appraise all
lots and pieces of ground lible to taxation for the improvements herein
provided for, shall, within ten days after having been notified of their
appointment, proceed to appraise said lots and pieces of ground liable
to taxation without regard to any buildings or improvements thereon,
and, after making said appraisement, shall return the same to the mayor

h�i�anvUc�ancJ31. the said mayor and council shall designate a time .for
ng a special session for the purpose of hearing complaints and e-
qualizing said a ppraisment, of which session due notice shall be given
In the official city paper, and at such special session the mayor and
council shall, if they deem it just and proper, alter or change such
appraisement.
Sec. 7. For the purpose of paying for such paving, curbing and
guttering.the,mayor and council are hereby authorized and directed to
issue bonds of the city of Salina, in an amount not to exceed the cont
tract piAce, and to run for such period of time as the mayor and coun-
cil shall determine, not exceeding'however ten years from the date of
such bonds, and be made payable in equal installments in each year for
the life of said bonds, together with interest not to exceed five per
cent per annum, which bonds shall be made payable at the fiscal agency
of the State of Kansas; and for the purpose of paying principal and in-
terest,on said bonds as they severally become due the mayor and council
shall each year during the life of said bonds levy assessments against
the lots and pieces of ground liable to taxation for the improvements
herein provided fro in an amount sufficient to pay the principal and
interest for that year; provided that for the purpose of defraying the
cost of paving.and otherwise improving the squares and areas formed by
the crossing of streets and alleys as well as where the improvements
is through or adjacent to property of the city, for which the city
would be liable, the assessments shall be made against all the taxable
property of the city; and the city clerk shall eettifysaid assessments
as they are severally made, to the county clerk of Saline county, Kan-
sas, at the same time and in the same manner as other city taxes are
certified, and said assessments shall be liable to the same penalties
as all other taxes.
Sec. 8. This ordinance shall take effect and be in force from
and after its publication once in the Salina Evening Journal.
