1749 Improve Walnut Street-64 R D I .N A N L E. N 0.- 1749 An ordinance providing for the paving, curbing, guttering and ex- cavating of Walnut street, in the city of Salina, Kansas, between the West side of Tenth street and the East side of College avenue, specifying the manner of construction and providing for the payme►at of the cost thereof and the manner of payment. Whereas, a petition has been presented to the mayor end council re- questing said mayor and council to pave, curb, gutter and excavate Walnut street, in the city of Salina, between the West side of Tenth street and the East side of College avenue, and, Whereas, such petition has been examined by said mayor and council and found to contain a majority of the names of the resident owners of property owning property abutting on both sides of said Walnut street be tween the limits above set forth, and that the mayor and council by virtue thereof have jurisdiction to make the improvements in such petition prayed for: therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Walnut street, in the city of Salina, Between the West side of Tenth street and the East side of College avenue, be paved, with such material as the may- or and council may hereafter select and designate, as h6v'.;_nafter provided, said paving to be thirty-three (33) feet in width, from gutter to gutter, except that at -the interesections of streets and alleys such pavement shall extend to the lot lines of the intersecting streets. Sec. 2. That it is necessary and hereby ordered that Walnut street, between the limits defined in section one hereof, be curbed on both sides thereof with cement curbing, and guttered on both sides thereof with ce- ment guttering, such curb to be about six inches in thickness and such gutter to be twenty-four (24) inches in width from the inner edge of such curb, and such curb -shall be set eighteen and one-half (184) feet from the center of said street, on either side thereof, exeept at the intersections of streets and alleys, where such curb and gutter shall return to the lot lines on said Walnut street. Sec. 3. All excavating, filling, and rolling necessary for the proper construction of such paving, curbing and gutteri,,K :hall be done, and such paving, curbing and guttering shall be done and constructed ac- cording to the established grade of said Walnut street, as heretofore or hereafter established by the ordinances of said city. Sec. 4. For the work and improvements herein provided for, the city engineer shall make and file with the city clerk, on or before the 16th day of March, 1914, plans and specifications thereof, which specifi- cations shall cover and embrace the different kinds of street paving, such as brick block, asphaltic -concrete and cement, with concrete found- ation, and cement curb and•gutter; and said engineer.shall also file with 1 1 1 1 ITPAY 1 d 1 1 .01ZINANCE_NO. 1749 Con. said clerk an estimate cost of the work and improvement herein provided for. Sec. 5. After such plans and specifications shall have been filed with said city clerk, the mayor and council shall advertise for bids for the different kinds of street paving therein specified, and for such curb- ing, guttering and excavating, and, after the redeipt of such bids, if the same are found satisfactory to the said mayor and council, said mayor and council shall determine the kind of paving material to be used on said street, and may let the contract for the paving of said street with the material so selected, and for the curbing, guttering and excavating of said street. Sec. 6. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested householders who, aft- er having taken an oath to faithfully and impartially appraise all lots and pieces of ground libale to taxation f.or the improvements herein pro- vided for, shall, within ten days after having be.--,, noti. Ied of their appointment, proceed to appraies said lots andpieces of ground liable to taxation, without regard to any buildings or improvements.thereon, and, after making said appraisement, shall return the same to the mayor and council at the first meeting thereof after such appraisement shall have been completed, and after such appraisement is returned to the mayor and council the said mayor and council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper, and at such special session ti;e mayor and council shall, if they deem it just and proper, alter or change such appraisement. Sec. 7. For the purpose of paying for such paving, curbing and guttering the mayor and council are hereby authorized and directed to is- sue bonds of the city of Salina, in an amount not to exceed the contract price, and to run for such period of time as the _. .Mor a .*I council shall detdrmine, not exceeding however ten years from the date of such bonds, and be payable in equal installments in each year for the life of said bonds, together with interest not to exeeed five percent per annum, whcih bonds shall be made payable at the fiscal agency of the State of Kansas, and for the purpose of paying principal and interest on said bonds as they severally become due t! -_e mayor and council shall each year during the life of said bonds levy assessments against the lots and pieces of gr ground liable to taxation for the improvements herein provided for in an amount sufficient to pay the principal and interest for that year; Pro- vided that for the purpose of defraying the cost of paving and otherwise improving the squares and areas formed by the crossing of streets and s we alleys as well as where as the improvement is through or adjacent to - property of the city, for whcih the city would be liable., the assess- ments shall be made against all the taxable property of the city; and the city clerk shall certify said assessments as they are sever- ally made, to the county clerk, of Saline county, Kansas, at the same time and in the samemanner as other city taxes are certified,' and said assessments shall be liable to teh same penalties as all other taxes. All excavating, .filling and roiling necessary for the proper construction of'such paving, curbing and guttering shall be done, and such paving, curbing and guttering shall be done and constructed according to the established grade of said Walnut street, as heretofore or hereafter established. by the ordinances of said .city. Sec. 4. For the work and improvernents herein provided for, the city engineer shall make and file with the city clerk, on or before the "day ;of_ 1914; plans and specifications thereof, which specifications shall covrrand embrace the different kinds of street paving, such as brick block,, asphaltic concrete -and cement, with' concrete foundation, andcement.curb andgutter; and said engineer shall also file with said clerk an estimate of the cost of the work and improve- rnent herein provided Sec. 5.
