1747 Sewer Improvements - Walnut StreetITPAY Ll 1 F� 1 1 - - - - - ORDINANCE NO_, 1747 - - - - - — (Published in the Salina F.yenina jpurnal Eigbrnar11 /GI 19141 T An ordinance providing for the construction of' a certain sewer in the city of Salina, Kansas, and letting the contract therefor, and providing for the payment of the cost thereof. Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that a ten (10) inch sewer be built on Walnut street, in the city of Salina, Kansas, between the vest side of Tenth dtreet, and the east side of College avenue, the same being an extension of the present Walnut street sewer between the limits above defined. Sec. 2. That the plans and specifications of the city engineer of said city for the sewer above described, dated February 2, 1914,,and now on file with the city clerk, are hereby adopted and approved as and for the plans and specigications for such sewer and are hereby made a part of this ordinance, and all the work hereunder described in such plans and specifications shall be done in accordnance and compliance with such plans and specifications. Sec. 3. That a contract be and is hereby let to Lenard C. Ahart, Salina, Kansas, for the building and construction of the sewer, includ- ing all catch -basins and manholes, as described in said plans and speci- fications, at the following price or prices, to -wit: that is to say: For building, laying and constructing said sewer, as per plans and specifications aforesaid, forty-three and one-half (43L) cents per lineal foot, the exact length thereof to becbtermined by the meas- urements of said city engineer and to be the length of sewer to be paid for by said city under said contract: For six (6) manholes, built and constructed according to said plans and specifications Twenty-four Qe24.00) Dollars each; and for one (1) manhole Twenty-five (25.00) Dollars. For brickwork for six (6) catch -basins, built and constructed :_ according to said plans and specifications Seven 07.00) Dollars each; for ten (10) inch sewer pipe connecting manhole and catch -basin Forty (40�) Cents per lineal foot; for closing ends of dis-connected pipes (50M Cents each; for Cast Iron Tops for catch -basin Seven 07.00) Dollars each. And it is.hereby found and determined that the prices hereby agreed to be paid for such work and improvement aforesaid are less than the estimated cost of the same heretofore made by the city engineer of said city and now on file with the city clerk. Sec. 4. That the person to whom said contract is awarded as afore- said shall execute a written contract with said city for the building of such sewer aforesaid, and shall file with the city clerk a good and sufficient bond, in the total sum of said contract, conditioned that .62 he will build such sewers according to said specifications, that he will re -fill the ditches made in said Walnut street in the building thereof, that he will fulfill the guarantee required in said specifi- cations nd hold and save harmless the city of Salina from all damages tp person or property that may arise through his carelessness in per- forming said contract. Sec. 5. The cost and expense of constructing smch sewer, manholes and catch -basin shall be assessed against all lots and -pieces of ground contained in the city of Salina as a sewer district, as provided by Ordinance No. 613 of the city of Salina, passed and approved December 23, 1887, and the mayor and council are hereby authorized to provide for the payment of the cost thereof by installments instead of levying the entire tax or special assessment at one time, and for such install-. ments they may issue improvement bonds of the city of Salina, payable in installments of equal amounts each year, none of which bonds nor the installments thereof shall run longer than ten years or bear interest exceeding five percent per annum, and such bonds may be delivered to the contractor building such sewer in payment thereof, or the mayor and council may sell said bonds at not less than their par value and pay said contractor out of the proceeds thereof: and such bonds shall be of such dendminations as the mayor and council may deem proper; and for the purpose of paying the principal and interest on said bonds as they severally become due, the mayor and council shall each year during the life of said bonds levy an assessment against all the taxable real prop- erty in said city at the -assessed value thereof for general revenue purposes, exclusive ofimprovements, in an amount sufficient to pay the principal and interest for that year; and the city clerk shall certify said assessments as they are severally made to the county clerk of Sa- line county, Kansas, at the same time and in the same manner as other taxes of said city are certified. Sec. 6. This ordinance shall take effect and be in force from and after its publication once in the Salina Evening Journal. Passed and approved February 16th, 1914. V. E.
