1683 Poll Tax(Published in the Sali.naEvening Journal September 1912). ORDINANCE N0.I� D �p An ordinance relating to and providing for the payment and collection of ppoll tax in the city of Salina, providing punishment for he viola - ion of thisordnance,a.nd repealing section thirty-six (36) of Ordinance No.. 635 of said city. Be it ordained by the Mayor and Councilmen of the city of Salina: Vho Liable. Section 1. Every male person in the city of Salina between twa my -one and fifty years of age, who is not a public charge, a.nd who has been a resident of the State of Kansas for at least thirty days, shall. be liable each year to pay to the street comissioner of said city a poll tax in the sum of three dollars, which such poll tax, when collected, shall be expended by said city upon its streets, alleys and highways; Provided, that all members of the Kansas National Guard shall be exempt from the payment of such poll tax during their term of service, and the certificate of 'a commissioned o'fficer.',;shall;.e sufficient evidence of membership and of such exemption; and provided further; `"that all members of the vountary fire department of said city in active ser- vice shall also be exempt from the payment of such poll tax. receipt therefor, and shall account for all moneys so received by-him- to yhim to the treasurer of said city; Provided, that any such person may pay his poll tax to the city clerk who shall, in like manner, receipt such person for such tax so paid, and who shall likewise accou-,t to said city treasurer for all moneys so received by him from such source. Notice_ of -pavmentt of tax. Sec 3. It' shall be the duty of said street commissioner to mail to each parson liable -to pay the poll tax provided for in this ordinance, to the last knovm postoffice address of such person, a. written or printed notice stating that such'pyPrsc-)n 'is liable for the payment of such poll tax for the current year, and stating that such.,#.ax will be due and payable within thirty days after the receipt by him of such notice; and such-noticebshall be mailed in a stamped en- velope, Mving a return card on the same; and the fact that am such i envelope so addressed and mailed shall not be returned to such street commissioner by the postoffice through which the same is sent shall be prima facie evidence that the person4to Whom such notice was so mailed received the same; Provided, that all such notices so to be mailed by said street commissioner for any one year must be mailed by him on or Of before the first day of September fix such year. Penal,-. Sec. 4. Any person who shall fail to pay the poll tax imposed and provided for by this ordinance, within thirty days after the receipt by him of the notice provided for in section three hereof, shall be deemed guilty of a misdemeanor and, upon conviction thereof in the and costs of prosecution; police court, shall be fined in the sum of five dollars and it shall be part of said judM- ent of conviction that the person so found guilty shall pay the poll tax for the failure to pay which he shall have been convicted to said police judge, and said police judge is hereby author- ized to accept such poll tag and pay the same over to the street com- missioner upon the latter's receipt therefor. Repeal,, Sec. 5. That section thirty-six (36) of Ordinance No. 635, approved March 7, 1888, and which said section reads as z follows, viz: "That any person who shall neglect or refuse to do two days' work on the public highways, or furnish a substitute, or pay the sum of three dollars as required by law, shall be deemed guilty of a misdemeanor, and shall be fined,`upon conviction thereof in the police court, the sum of five dollars and costs," be and such section is hereby repealed. Take effect. Sec. 6. This ordinance shall take effect and be in force from and after its publication once in the Salina Evening Journal.
