ORDINANCE NO. 1
An ordinance relating to and apportioning'and levying special assessments
on certain lots and pieces of ground, in the c Ay of Salina, Kan-
sas, to pa the cost of paving, curbing and guttering Tenth street,
in said city, between the scum line of South street and the north
line of Morrison avenue; and relating to and providing for the
collection and payment of such assessments.
Be it ordained by the Mayor and Councilmen of the city of Salina:
Section 1. For the purpose of paying the cosh of paving, curbing,
guttering and excavating Tenth street, in the city of Salina, Kansas,
between the south line.of Sou+,h street and the north line of Morrison
avenue, there are hereby levied and assessed, on the property liable
therefor --being all the lots and pieces of ground lying on either side
of said street, for the distance improved as aforesaid,; to the center of
the blocks on either side thereof --according to' the appraised value of
such lots and pieces of ground without regard to the buildings or im-
provements thereon, special assessments covering the cost;of such work
and improvement; said special assessments being based on the special
valuation and appraisement of said lots and pieces of ground heretofore
made by three disinterested appraisers appointed by the mayor and
council, which said appraisement is hereby referred to and made a part
of this ordinance; and the several amounts levied., apportioned and
assessed against each of said lots and pieces of ground, for. the_pur�.
poseaforesaid,. are hereby found to be and designated and described as

Sec. 3. Said amounts leaded, apportioned and assessed aforesaid
shall be due and collectible in ten (10) equal annual installments,.the
first becoming due -with the taxes levied for the year 1913, and one of
said installments falling due each and every year thereafter until all
are paid, and all to be collected with interest as in this ordinance
provided; Provided, that the owner of any piece of property liable for
any such special assessinentz may redeem his property from such liability
by paying into the city treasury the entire amount chargeable against
the same, as in this ordinance designated, at any time within thirty
(30) days after the publication of this ordinance and before the issu-
ance of the bonds of said city in payment of the balance of the cost of
.said improvements, and his property so paid on shall not thereaa.fter be
liable for anv further assessments for the cost of said improvements,
nor for any part of said bonds.
Sec. 4. There is hereby further levied and asssessed against each
lot and piece of ground described in section two of this ordinance five
(5) per cent interest per anrnrm or, all of said installments therein men-
tioned, .from the date of the g x xxzk bands which may be issued at
the end of the/thirty days specified in the preceding section hereof as
by law provided, to the time of the collection of each annual installment,
as provided by law, which said interest shall be collected annuallly at
the same time and in the same manner as said installments; and, after the
taking effect of this ordinance, it shall be the duty of the city clerk
of said city to annually, at the same time other taxes are to be certi-
Pied, and until all of said assessments so apportioned and levied
herein have been been certified, to certify to the county clerk of Saline
county, Kansas, a full list of all property liable to assessment and tax-
ation for such work and improvements, except such property on which the
special assessments aforesaid have been'pald in full, as hereinbefore
provided, together with the respective amounts due on each of said lots,
and pieces and parcels of ground, which amounts shall include the annual
and the
installments zi interest on the same on all unpaid balances for one
year at the rate of five per cent per annum, as aforesaid; and such
amounts so certified shall be collected as other taxes and assessments
are collected.
Sec. 5. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
