1669 Improvements Weil Place(Published in the Salina Evening Journal,. July 1912. ) OR nAyiCE 170.1669. An Ordinance providing for the paving, curbing, guttering and excava- ting of Weil Place from Seventh street to Eighth street, in the city' of Salina; specifying the manner of construction, providng for the cost thereof and. the manner of payment, and letting the contract therefor..: WHEREAS, there has been presented to the mayor and council a gtition requesting said mayor and council to pave, `curb, gutter and excavate Weil Place, in the city of Salina., Kansas, between Seventh street and Eighth street; rind, WTM'REAS, said petition has been found by the said mayor and council to contain the names of a majority of the resident property owners owning property fronting on both. sides of said. Weil Place between the limits above defined; therefore, Be it ordained -by the Mayor and Councilmen of the city of Salina„ Section -1.,' - That it is necessary and hef'oby ordered that 4Jei'1 Place, in the city of Salina, Kansas., between the east line of Seventh street and. the east line of Eighth street, be paved with asphaltic-concrote pavement, on a five inch concrete base, and ac- cording to the specifications therefor, as hereinafter provided., said paving to be. twenty four (24) feet in width from gutter to. gutte•, except that at the -intersections of streets and alleys such paving shall extend from lot line to lot line on said Weil Place. Sec..2. That it is necessary and hereby ordered that said Weil Place, between the limits defined in section one hereof, be curbed and guttered on - both sides thereof with cement curb and gutt w,; according to the specifications hereinafter provided for, the lot line edge of such curbing to be set fourteen and a half (14-) feet from and parallel with the center line of.said street east and west;, Provided, that at the intersections of streets and alleys such curb and. gutter shall return to the lot line of said street. Sec. 3. That all excavating, filling and rolling necessary for th.e proper construction of said paving., curbing and guttering be done, and such paving, curbing and guttering shall be constructed according to the established grade of said Weil Place, as heretofore or hereafter established by the ordinances of said city. Sec. 4. -..That the plans and specifications of the city engineer of said city, novo on file with the city clerk, for the paving, curbing, guttering and. excavating of said Weil Place are hereby adopted and approved as and for the plans and specifications for the improvement of said street, and all wort; herein and in such plans and specifica- tions provided for shall be done in accordance with such plans and specifications, which are hereby incorporated in and made a part of this ordinance. Sec. 1® After the passage of this ordinance the mayor and. council shall appoint three disinterested householders, who, after having taken an oath to faithfully and impartially- appraise all lots and pieces of ground liable to taxation and assessment for the cost of making such improvements, without regard to.any buildings or im provements thereon, and after making suid appraisernlent.said appraisers shall return the same.to the city council, at the first meeting there- of after such appraisen,ent shall have been made and completed; and after .said appraisement is returned to the city council the mayor and council shall designate a time for holding a special session of said mayor and council for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall she. giver_ in the official city paper, and at such .special sessim the mayor and council, shall, if they deem it just and proper, alter or .change such appraisement. Sec. 6. That a contract be and is hereby let to The Katie Paving Company of Topeka, Kansas, for the paving and excavating of said i'leil Place«With asphaltic -concrete paving material, as specified in the said specifications of the said city engineer, as aforesaid, on a five inch concrete base, at and for the uniform price of One and fifty-eight ($1.58) Dollars per square yard for the square yards of such pavement actually laid and put in place on said street, and for the excavating necessary to properly lay and construct such pave- ment said Kaw Paving Company shall be paid at the rate of Thirty' -five (J-54 cents per cubic yard for the actual number of cubic yards of such excavq:ting done by such contractor. Sec. 7. That a contract be add is hereby let to Lyon Brothers of Salina, Kansas, for the curbing and guttering provided for in this ordinance at and for the uniform price of Thirty-two (32) cents per lineal foot for the curbing; and Twenty-eight (28) cents per lineal foot -for the guttering constructed and put in piaee on said street. Sec. 8. That the prices for such work and improvement as I specified a.nd agreed to be paid in sections 6 and 7 of this ordinanceee, are hereby found to be less than the pricbs.for cost df such work and improvements made and given in the city engineerts estimate of the cost therefor=_now on file with the city clerk. Sec. 'g. For the purpose of paying for the voric—anti; improvements herein provided for in installments instead. of levyirje_- the entire tax or special assessments for such cost at one time, the mayor and council a.re.hereby authorized to issue improvement bonds of the city of Salina payable in installments of equal amounts in each year, none of which bonds nor any of the installments thereof shall run longer than ten years nor bear interest 'exceeding five ped cent per annum. Such bonds may be issued to the contractors constructing such improvements in payment thereof, or the mayor and council may sell said bonds at not less than their par value and pay the proceeds thereof to tle con- tractors, and such bonds shall be of such glenoenina.tions as the mayor and council may deem proper. And for the purpose of paying; principal and interest on said bonds, as they severally become due, the nWor and council shall each year during the life of said bonds, levy an assessment againstthe lots and pieces of ground liable to taxation and asdessment for such improvements in an amount.sufficiert to pqy, the principal and interest for that year: Provided, that for the purpose of paying the cost, of the improvements on. the squares and areas formed by the crossing of streets and alle;rs,'for which the city would be .liable, the assessrr:.ents shall be made against all the taxable property of the city; and the city clerk shall certify such assessrlents, as they are severally made, to the county clerk of 01 Saline county, Kansas, at `` ie— ssrne time andira the same manner as other city taxes. are certified., to be ' collected as -other -taxes are collected.
