1668 Improvements 7th St(Published in the Salina Evening; Journal, July ____,1912) ORDINAIJcE N0._l668 An Ordinance providing for the paving, curbing and guttering of Seventh street, in the city of Salina, between the south side of Watlut street and the south line of Weil Place; specifying the manner of construction, providing for the cost thereof and the manner of payment, and letting the contract therefor. WHEREAS, there has been presented to the mayor and council a pttition requesting said mayor and council to pave, curb and gutter Seventh.street, in the city of Salina, Kansas, between the south line of Walnut street and the south line of Weil Place; and, WHERRIAS, said petition has been found. to contain the, names of a majority of the resident property owners owning property $routing:,, on both sides of said Seventh street between the limits above defined; therefore, ` Be it ordained by the Mayor and Councilmen of the city of Salina: Section 1. That it is necessary and hereby ordered bhat Seventh street, in the city of Salina, Kansas, between the south line of Walnut street and the south line of `r1eil Place, be paved with asphaltic -concrete pavement, on a ve inch concrete base, and accord- ing to the specifications therefor, as hereinafter provided, said paving to be forty-three (43) feet in width from gutter to gutter between Walnut street and South street, and Thirty-three (33) feet in width from gutter to gutter from said South street to Weil Place, except that at the intersections of streets and alleys such pavilg shall extend ±xX to the lot line on Seventh street. Sec. 2. That it is necessary and hereby ordered that said Seventh street, between the limits defined in section one hereof, -be. curbed and guttered on both sides thereof with cement curb and gut -ter, according to the specifications hereinafter provided for, the lot line edge of such curbing to be set twenty-four (24) feet from and parallel with the center line of said street between Walnut street and South street, and nineteen (19) feet from and parallel with the center line of said street between said South street and Weil Place; Provided, that at the intersections of streets and alleys such curb and gutter x shall return to the lot line of said Seventh street. Sec. 3. That all excavating, filling and rolling necessary for the proper construction of said paving, curbing and guttering be done, and such paving, curbing and guttering shall 'be constructed according to the ettablished grade of said Seventh street, as :'We- tofore or hereafter established by the ordinances of said city. Sec. 4. That the plans and specifications of the city engineer of said city, now on file with the city clerk, for the paving, curbing, guttering and excavating of said Seventh street are hereby adopted and approved as and for the plans and specifications for the improvement of said street, and all work herein and in such plans and specifica- tions provided for shall be done in accordance with such plans and specifications, which are hereby incorporated in and made a part of this ordinance. Sec. 5. After the passage of this ordinance the mayor and council shall appoint three disinterested householders, who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation and assessment for the cost of making such improvements, without regard to any buildings or im provements thereon, and after making said appraisement said appraisers shall return the same to the,city council, at the first meeting there- of after such appraisement shall have been made and completed; and after said appraisement is returned to the city council the mayor and council shall designate a time for holding a special session of said mayor and council for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper, and at such special session the mayor and council, shall, if they deem it just and proper, alter or change such appraisement. Sec. 6. That a contract be and is hereby let to The Kaw Paving Company of. Topeka, Kansas, for the paving and excavating of said Seventh street with asphaltic -concrete paving material, as specified in the said specifico,tions of the said city engineer, as aforesaid, on a five inch concrete base, at and for the uniform price of One and fifty-eight.($1.58) Dollars per square yard for the square yards of such pavement actually laid and put in place on said -street, and for the excavating necessary to properly lay and construct such pave - %0 said Kaw Paging Company shall be paid at the rate of Thrity five (3�¢) cents per cubic yard for the actual number of cubic yards of suchexcavating done by such contractor. Sec. 7. That `a contract be and is hereby let to Lyon Brothers of Salina, Kansas, dor the curbing and guttering provided for in this ordinance at and"for the uniform price of Thirty two (32) cents per lineal foot for the curbing and Twenty eight (28) cents per linahl foot for the guttering constructed and -put in place on said stre=et. Sec. 8., That the prices for :such work and improvements as specified and agreed to be paidinsections 6 and 7 of this ordinance, are hereby found to be less than the prices for cost of such vJork and improvements made and given in the vitt' engineerIs estirnr.te of the cost therefor now on file with the city clerk. Sec. 9. For the purpose of paying for the work and impro�egnents herein provided for in installments instead of levying the entilee tax or special assessments for such cost at one time., the mayor and council are hereby authorized to issue improvement bonds of the city ofSalina payable in installments of equal amounts in each year, none of ikich bonds no'r any of the installments thereof shall run longer than ten years nor bear interest exceeding five (1) per cent per annum. Such bonds. rnay- be issued to the contractors constructing; such improvetnts in p,ti:.mient. thereof , or -the mayor and council may sell said. bonds at not less than their par value and pay the proceeds thereof to the con- tractors, and such bonds shall be of such denominations as the myor and council may deem proper. And for the purpose of paying principal and interest on said bonds, as they severally become due, the rWyor and. council shall each year during the life of said bonds, levy an assessment against the lots and pieces of ground liable to taxattion and assessment for such improvernents in an amount sufficient to pay the principal and interest for that gear: Provided, that for tke purpose of paying the cost of the improvements of the squares axld areas formed by the crossing of streets and alleys, for which the city Would be Ubble, the assessments shall be mads against all the taxable property of the city; and the city clerk shall certify such assessments, as -they are severally riad§, to the counter clerk .of Saline county, Kansas, at the same time and in the same manner as other city taxes are certified, to be collected as other taxes are collected. - Sec.
