RESOLUTION NUMBER 3293

A RESOLUTION authorizing and ordering certain sanitary sewer improvemen
ordering preparation of plans and specifications, and the estimate of costs.
WHEREAS, a petition was filed with the City Clerk on the.3rd day of
June; 1976, proposing certain sanitary sewer improvements for certain.tracts.of
land adjacent to Stimmel Road; and
WHEREAS, the Governing Body of the City of Salina, Kansas,•did on 12th
day of July; 1976, find such petition to be insufficient; and
WHEREAS, the Governing'Body of the City of Salina,. Kansas, did on the
20th day of September, 1976, duly adopt a resolution finding it advisable -to
make the aforementioned improvements under the provisions of Chapter.12, Article
6a of the Kansas Statutes Annotated, SO NOW, THEREFORE
BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:
Section 1. That the following improvements are hereby authorized and
ordered to be made in accordance with the findings of the Governing Body:
Construction and installation of Lateral Sanitary Sewer^554. •.
Section 2. The extent or boundaries of the proposed improvement
district to be assessed is:
That part of the City of Salina, Saline County, Kansas described
as follows, to -wit:
Beginning at a point Three Hundred Fourteen (314.0) feet east of
the Southwest corner of Section 36, Township 13 South, Range 3
West; thence north and parallel with the west line of said Section
36 a distance of Three Hundred Thirty-eight and nine tenths
(338.9) feet; thence east and parallel with.the south line of
said Section 36 a distance of Ninety (90) feet; thence south and
parallel with the west line of said Section 36 a distance of One
Hundred Five and nine tenths (105.9) feet; thence east and parallel
with the south line of said Section 36 to the centerline of
Mulberry Creek; thence south and east along the centerline of
Mulberry Creek to a point that is Eight Hundred Seventy-six
(876.0) feet east and One Hundred Ninety-nine (199) feet north of
the Southwest corner of said Section 36; thence south and parallel
with the west line of said Section 36 a distance of One Hundred
Ninety-nine (199) feet to the south line of said Section 36;
thence west along the south line of said Section 36 a distance of
Thirty-three and seven tenths (33.7) feet; thence south and
parallel with the west line of Section 1, Township 14 South,
Range 3 West a distance of Three Hundred Forty-nine and five
tenths (349.5) feet; thence west and parallel with the north line
of said Section 1 a distance of Two Hundred Seventy and eight
tenths (270.8) feet; thence south and parallel with the west line
of said Section 1 to the centerline of Dry Creek; thence north
and west along the centerline of Dry Creek to a point Four Hundred
(400) feet east of the Northwest corner of said Section 1,
Township 14 South, Range 3 West; thence north to a point on the
north line of said Section 1, that is 400 feet east of the
northwest corner of said Section 1; thence west along the north
line of said Section 1, Ninety (90) feet to the point of beginning.
Section 3. The estimated or probable cost of such improvement is
$13,519.00.
Section 4. The apportionment of cost between the improvement district
and the City -at -large, is as follows:
1. Costs chargeable to private property in the
amount of $13,519.00.
2. No costs chargeable to the City -at -large.

Section 3. The estimated or probable
cost of such improvement Is $13,519.00.
Section 4. The apportionment of cost be-
tween the Improvement district and the
City -at -large, is as follows:
1. Costs chargeable to private prop-
erty In the amount of $13,519.00.
2. No costs chargeable,to the -City -
at -large.
Section 5. The assessment with ac-
crued interest shall be levied as a spe-
cial tax upon the property included
within the benefit district concurrent
with the general property taxes and
shall be payable in ten (10) equal an-
nual installments.
Section 6—The method of assess-
ment shall be based on the front foot-
age of each lot and without regard to
the buildings or Improvements of the
land.
Section 7. The City Engineer be and
is hereby directed and ordered to pre-
pare plans and specifications, and es-
timates of the 'cost of said
Improvements.
Section 8. That for the purpose of
providing funds to pay the cost of
such Improvement until bonds can be
Issued therefor, the Mayor and,City
Clerk be and they are hereby author-
ized to execute temporary notes of
the City of Salina, Kansas, as provid-
ed by K.S.A. 10-123 and 12-6a04, not to
exceed the aggregate provided by
law. Such temporary notes may be is-
sued by Resolution from time to time

as required during the progress of
the work on the Improvement herein
recited. Such temporary notes shall
be in the form and executed as pro-
vided by law.
Section 9. The City Clerk is hereby
authorized and directed to make prog-
ress payments to the contractor for
materials furnished and labor per=
formed under the contract whenesti-
mates therefor are presented to him
which have been properly certified
by the City Engineer, so long as the
total aggregate payments do not ex-
ceed the total contract price.

Board of Commissioners of the City
of Salina, Kansas, In Regular Session
this 27th day of September, 1976.
