RESOLUTION NUMBER 3454
A RESOLUTION AUTHORIZING THE EXECUTION OF A DEED BY THE MAYOR COVERING
CERTAIN REAL ESTATE.
WHEREAS, on the 13th day of May, 1966, the City of Salina, Kansas,
advertised that it would receive bids for certain real estate as hereinafter
described; and,
WHEREAS, on the 23rd day of May, 1966, J. E. Foley submitted a bid in
the amount of $12,500 for the real estate hereinafter described; and,
WHEREAS, the said J. E. Foley was the highest and best bid received
and accepted by the City of Salina, Kansas, SO NOW, THEREFORE,
BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:
Section 1. That the Mayor and City Clerk are hereby authorized and
directed to execute a special warranty deed in favor of J. E. Foley covering
the following described real estate, to -wit:
The East Ninety-eight feet (E 98') of Lots Two (2)
and Four (4) and the East Ninety-eight feet (E 98')
of the North Twenty-five feet (N 25') of Lot Six (6),
all on Highland Avenue in Prescott Addition to the
City of Salina, Saline County, Kansas,
all in accordance with action of the Board of Commissioners in the acceptance of
the bid of J. E. Foley on May 23, 1966, and his full payment of the purchase
price as therein specified.
Section 2. That this Resolution shall be in full force and effect
.from and after its adoption.
Adopted by the Board of Commissioners and signed by the Mayor this
15th day of October, 1979.

This Indenture, made this 15th day of October, 1979, between THE
CITY OF SA102a, KANSAS, a municipa corporation, of the first part, and
J. E. FOLEY of Saline County, Kansas, in the State of Kansas, of the
second part, WITNESSETH:
That said party of the first part, in consideration of the sum of
Twelve Thousand Five Hundred Dollars ($12,500), the receipt of which
is hereby acknowledged, does by these presents, grant, bargain, sell
and convey unto said party of the second part, his heirs and assigns,
with special warranty covenant all the following described real estate,
situated in Saline County and State of Kansas, to wit:
The East Ninety -Eight Feet (E 98') of Lots Two (2)
and Four (4) and the East Ninety -Eight Feet (E 98') of
the North Twenty -Five Feet (N 25') of Lot Six (6), all
on Highland Avenue in Prescott Addition to the City of
Salina, Kansas.
TO HAVE AND TO HMD THE SAME, together with all and singular the
tenements, hereditaments and appurtenances theretunto belonging or in
anywise appertaining, forever. And said first party for itself, its
successors and assigns does hereby covenant, promise and agree, to and
with said party of the second part, that it will warranty and forever
defend the same unto said party of the second part, his heirs and
assigns, against said party of the first party, its successors, and
all and every person or persons whomsoever, lawfully claiming or to
claim the same, or any part thereof, by, through or under it.
IN WITNESS WHEREOF, the party of the first part has hereunto
caused this deed to be signed on its behalf by its Mayor thereunto
duly authorized so to do, and to be attested by its City Clerk and
has caused.its common seal to be hereunto affixed the day and year last
above written.

before me, the undersigned, a notary public in and for the county
and state aforesaid came Karen M. Graves, Mayor of the City of Salina,
Kansas, and D. L. Harrison, City Clerk, who are personally known to
me to be such officers and who are personally known to me to be the
same persons who executed as such officers the within instrument of
writing on behalf of said City of Salina, Kansas, and such persons
duly acknowledged the execution of the same to be the deed and act of
said City.
