A RESOLUTION DETERMINING THAT CERTAIN REAL ESTATE IS NO LONGER NEEDED
BY THE CITY OF SALINA FOR PARK PURPOSES AND THAT A SALE THEREOF WOULD BE IN THE
BEST INTEREST OF THE CITY.
BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:
Section 1. That it is hereby determined that the following described
real estate is no longer needed or required for park purposes of the City of
Salina, Kansas.:
A tract of land located in Elmdale Addition.to the City
of Salina, Saline County, Kansas,.being more particularly
described as follows:
Beginning at a point on the north right-of-way line of
Ash Street that is 103 feet west of.the southwest corner of
Lot 3, Block 9, said Elmdale. Addition; thence north 130 feet,
more or less, to the centerline of the .old. Dry Creek channel;
thence southwesterly along the centerline of the old Dry Creek
channel .to the north right-of-way line of Ash Street; thence
east along the north right-of-way of Ash Street a distance of
175.5 feet to the point of beginning. Said tract contains
0.28 acres, more or less; and..
A tract of land in Block 9, Elmdale Addition to the City
of Salina, Saline County, Kansas, being more particularly
described as follows:
Beginning at a point on the south line of Lot 2, Block 9,
said Elmdale Addition .that is 5 feet east of the southwest
corner of said Lot 2; thence west along the south line of Lots
2 and 1, said Block 9 to.the southwest corner of said Lot 1;
thence northeasterly along the west line of said Lot 1 to the
northwest corner of.said Lot 1; thence east along the north
line of said Lot 1 a.distance of 15 feet; thence southeasterly
to the pointof beginning. Said t.ra.ct contains 0.23 acres,
more or less; and,
A tract of land in the Northwest Quarter (.NW/4) of Section
One (1), Township Fourteen (.14) South., Range Three (3) West of
the Sixth Principal Meridian and described as follows:
Beginning at a point on the east right-of-way line of
Ninth Street and one hundred forty-eight and seven tenths .feet
(148..7') north of the southwest corner of,the Northwest Quarter
(NW/4) of Section One (.1), Township Fourteen (14) South, Range
Three (3) West; thence on .a bearing of North zero degrees East
(N.00°00'E.) along said right-of.-wa.y line a distanceof sixty-
one and five tenths feet (61.5'); thence North. two degrees and
twenty-four minutes East (N.02°2.4'E.) along the east right-of-
way line two hundred twenty-four and seven tenths feet (224.7')
to the south line of the Flood Control Dike; thence North
seventy-four degrees and four minutes East_(N.74°04'E.) along
the south line of the Flood Control Dike two hundred fifty-one
and seventy-four hundredths.feet .(251.74') to the centerline
of the old Dry Creek channel; thence South. twenty-nine degrees
and four minutes West (S.29004'w.) along the centerline of old
Dry Creek one hundred feet (100.00'); thence South thirty-one
degrees and forty-nine minutes West (S.31049'W.) along the
centerline of old Dry Creek one hundred ninety-five feet
(1959; thence South forty-five degrees and thirteen minutes
West (S.45°13'W.) along the centerline of old Dry Creek one
hundred thirty-seven feet (1379 to the point of beginning and
contains 0.91 acres, more or less; and,

Section One (1), Township Fourteen (14) South, Range Three (3)
West of the Sixth Principal Meridian and described as follows:
Beginning at a point on the east right-of-way line of
Ninth Street and five hundred sixty and two hundredths feet
(560.02') north of the southwest corner of the Northwest
Quarter (NW/4) of Section One (1), Township Fourteen (14)
South, Range Three (3) West; thence North zero degrees and
zero minutes East (N.00°00'E.) along the east right-of-way
line of Ninth Street a distance of four hundred five and nine
hundredths feet (405.09') to a point; thence North ninety
degrees East (N.90000'E..) a distance of twenty-five (25) feet;
thence North zero degrees East (N.00000'E.) a distance of
thirty-five feet (35') to a point; thence North ninety degrees
East (N.90000'E.) a distance of two hundred seventy feet
(270') to the centerline of old Dry Creek; thence southerly
along .the centerline of old Dry Creek to a point on the north
right-of-way of Flood Control Dike, said point being twenty-
eight and eighteen hundredths feet (28.1$') north and two
hundred fifty-one and ninety-two hundredths feet (251.92')
east of the point of beginning; thence on a bearing of South
eighty-three degrees and thirty-seven minutes West (S.83037'W.)
a distance of two hundred fifty-three and forty-nine hundredths
feet (253.49') to the point of beginning and containing 2.82
acres, more or less.
Section 2. That it would be in the best interest of the City of
Salina, Kansas, that the above described land be sold.
Section I. That if within thirty (30) days from the date of the last
publication of this resolutionthere has not been filed with the City Clerk a
protest signed by the qualified electors of the City of Salina equal in number
to not less than ten percent (10%) of the electors who voted in the last preceding
regular city election as shown by the poll books, then the City of Salina will
proceed to sell said property.
Section 4. That in the event no valid protest petition is filed with
the City Clerk as specified in the preceding section, then the City Manager is
hereby directed to proceed to dispose of the above described property either at
public or private sale under such terms and conditions as he deems in the best
interest of the -city.
Section 5. That this resolution shall be in full force and effect
from and after its adoption and publication twice in the official city newspaper.
Adopted by the Board of Commissioners and signed by the Mayor this
21st day of May, 1979.
