A RESOLUTION determining the advisability of acquiring property for
the purpose of establishing a public street from Ohio Street to Kenwood Park
Drive and providing for the curbing, guttering, paving and grading thereof, and
the installation of sanitary sewer improvements; defining the boundaries of the
improvement district; determining the method of assessment and proportioning the
cost between the improvement district and the City -at -large.
WHEREAS, certain improvements were requested by petition of those
liable for the cost of the same, said proceedings shall be without notice as
provided by K.S.A. 12-6a04.
BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:
Section 1. That the Board of Commissioners of the City of Salina,
Kansas, hereby finds and determines that it is advisable to acquire certain real
estate for the purpose of establishing a public street to be known as "The
Midway", which will connect Ohio Street with Kenwood Park Drive.
Section 2. That the Board of Commissioners of the City of Salina,
Kansas, hereby finds and finally determines that it is advisable to make the
following improvemets, to -wit:
Curbing, guttering; paving and grading of The Midway,
Lateral Sanitary Sewer Number 589.
Section 3. The extent of the boundaries of the proposed improvement
district to be assessed is:
All that part of the City of Salina, Saline County, Kansas,
located within the confines of Kenwood Park.
Section 4. The estimated probable costs of such improvements is
$165,000.00.
Section 5. The apportionment of cost between the improvement district
and the City -at -large is as follows:
(1). Cost chargeable to property located within the benefit
district in the amount of $165,000.00.
(2). No cost chargeable to the City -at -large.
Section 6. The assessments with accrued interest shall be levied as a
special tax upon the property included within the benefit district concurrent
with the general property taxes and shall be payable in ten (10) equal annual
installments.
Section 7. The method of assessment shall be based on the square feet
of land and without regard to buildings or improvements located on the land.
Section 8. That the advisability of the improvements set forth
herein is hereby established without notice and hearing, as authorized by
K.S.A. 12-6aO4(1).
