82-3617 Overtime RateA RESOLUTION DETERMINING THE OVERTIME RATE OF PAY AS WELL AS THE
REMUNERATION IN LIEU OF HOLIDAY PAY FOR EMPLOYEES WORKING SCHEDULES OF TWENTY-
FOUR (24) HOURS ON DUTY AND FORTY-EIGHT (48) HOURS OFF DUTY, AND RESPECTIVELY
AMENDING SECTIONS III -3 and IV -3 OF THE PERSONNEL MANUAL, APPROVED BY RESOLUTION
NUMBER 3418, AND REPEALING RESOLUTION NUMBER 3464.
BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:
Section 1. That Section III -3 of the Personnel Manual, approved by
Resolution Number 3418, is hereby amended to read as follows:
"Section III -3. OVERTIME PAY.
Any time worked in excess of an employee's regular schedule ..,..
shall be with the prior knowledge and approval of the immediate
supervisor and/or department head. Overtime pay shall be granted
at the rate of one and one-half (1-1/2) times the employee's
regular hourly rate. For overtime purposes, the hourly rate for
all employees will be based on the 40 -hour work week. Extra time
worked and the corresponding compensation shall be calculated to
the nearest tenth (.1) of an hour. Department heads shall have
the latitude to permit employees to be credited with extra time
worked and exchange it for time off, on a one to one basis.
Provided, department heads and supervisory personnel serving
in administrative or staff level positions, shall not receive extra
compensation or overtime pay. The need for them to work extra or
irregular hours from time to time, in order to carry out their
assigned responsibilities and properly administer the authority
vested in them, is a consideration in the determination of their
salary. Supervi-sors serving in positions below the administrative
or staff level shall be eligible for overtime pay subject to the
approval of the department head.
Administrative or staff level positions shall include department
head, assistant department heads, superintendents, and managers."
Section 2. That Section IV -3 of the Personnel Manual, approved by
Resolution 3418, is hereby amended to read as follows:
"Section IV -3. HOLIDAYS.
The following days shall be considered legal holidays:
New Year's Day, January 1
Washington's Birthday, the 3rd Monday in February
Memorial Day, the last Monday in May
Independence Day, July 4
Labor Day, the 1st Monday in September
Columbus Day, the 2nd Monday in October
Veteran's Day, November 11
Thanksgiving Day, the 4th Thursday in November
Friday after Thanksgiving Day
Christmas Day, December 25
When one of the above legal holidays falls on a Saturday, the
preceding Friday shall be observed for the holiday.
When one of the legal holidays falls on a Sunday, the following
Monday shall be observed for the holiday.

Employees required to work a shift or tour of duty, the major
portion of which occurs on a legal holiday, will be paid holiday
benefit pay in addition to their regular .salary as follows:
(a) All employees, except part time and/or temporary and/or
firemen who work schedules of twenty-four (24) hours on duty and
forty-eight (48) hours off duty, shall receive eight (8) ho.urs
additional pay at their regular hourly rate.
(b) All firemen who work a schedule of twenty-four (24) hours on
duty and forty-eight (48) hours off duty, in lieu of any other holiday
compensation, shall receive each quarter additional compensation which
shall be equal to one twenty-four (24) hour work day at the regular
hourly rate; provided however, said fireman must have been employed
the entire quarter to be eligible for their additional compensation.
Special holiday: From time to time, on special occasions, the
Mayor may proclaim a special holiday. The same personnel rules for
legal holidays also apply for special holidays.
If an employee is on suspension during any legal or special
holiday, he will not be compensated for such holiday."
Section 3. That the existing Sections III -3 and IV -3 of the Personnel
Manual are hereby repealed.
Section 4. This resolution shall be in full force and effect from and
after its adoption.
Adopted by the Board of Commissioners and signed by the Mayor this
18th day of October, 1982.
