81-3544 Sell Real Estate1 1 RESOLUTION NUMBER 81-3544 (Published in the Salina Journal I—k�W_ / 4— , 1981) A RESOLUTION DETERMINING THAT IT IS ADVISABLE AND NECESSARY TO OFFER TO SELL CERTAIN REAL ESTATE TO THE UNITED STATES POSTAL SERVICE AND AUTHORIZING THE MAYOR TO EXECUTE SUCH DOCUMENTS AS MAY BE NECESSARY. WHEREAS, by Ordinance Number 80-8786 adopted on the 21st day of April, 1980, the City of Salina, Kansas, authorized the issuance of its Yellow Van Movers, Inc. Industrial Revenue Bonds, Series 1980, dated April 1, 1980, the aggregate principal amount of $400,000; and, WHEREAS, from the proceeds of said industrial revenue bond issue the City of Salina acquired title to the following described real estate, to wit: All of Lot Fifty (50) on Fourth Street lying east of UPRR and all of Lot Fifty -Two (52) on Fourth Street, except UPRR, in the Original Town (now City of Salina), Saline County, Kansas; and, WHEREAS, the said property is subject to a lease in favor of Yellow Van Movers, Inc. under the terms of which lease the said tenant has the option to purchase said property at the termination of said lease period; and, WHEREAS, 'the United States Postal Service has expressed an interest in obtaining the above described property and other property adjacent thereto for the purpose rof constructing a United States Postal facility. NOW THEREFORE, BE IT RESOLVED by the Governing Body.:of the City of Salina, Kansas: Sectional. That it is hereby determined to be advisable to offer to sell to the United States Postal Service the above described property and to enter into an "Offer to Sell Real Property", a copy of which is attached to this Resolution. Section 2. That the Mayor of the City of Salina, Kansas, and the City Clerk are hereby authorized and directed to execute the "Offer to Sell Real Property", which is attached hereto. Section 3. That this Resolution is contingent upon securing the written approval of Yellow Van Movers, Inc. to the sale of this property and the further consent of the holders of more than two-thirds of the aggregate principal amount of the Yellow Van Movers, Inc. Industrial Revenue Bonds, Series 1980, dated April 1, 1980. Section 4. This Resolution shall be in full force and effect from and after its adoption.
