RESOLUTION NUMBER 86-3859
A RESOLUTION REQUESTING. THAT PROPERTY IN THE CITY OF
SALINA AND INDUSTRIAL PARK LAND OUTSIDE THE CORPORATE LIMITS OF
THE CITY OF SALINA BE DESIGNATED AS AN ENTERPRISE ZONE AS
AUTHORIZED BY K.S.A. 12-17,109; AND REPEALING RESOLUTION NUMBER
86-3832.
WHEREAS, the following described area lies within the corporate limits
of the City of Salina, Kansas:
Tract 1. Beginning at the intersection of the center lines of
North Ninth and West Ash Streets (Point of Beginning);
thence southerly along the center line of North Ninth Street
and continuing along the center line of South Ninth Street to
its intersection with the center line of West Prescott Avenue;
thence easterly along the center line of West Prescott Avenue
and continuing easterly along the center line of East Prescott
Avenue to its intersection with the center line of South
Fourth Street; thence northerly along the center line of
South Fourth Street to its intersection with the center line
of East Mulberry Street; thence easterly along the center
line of East Mulberry Street to its intersection with the old
Smoky Hill River channel; thence continuing in an easterly
and northerly direction along the center line of an unnamed
park drive in Oakdale Park to its intersection with the
center line of Oakdale Drive; thence northerly along the
center line of Oakdale Drive to its intersection with the
center line of South Front Street; thence northerly along the
center line of South Front Street and continuing along the
center line of North Front Street to its intersection with the
center line of East Elm Street, thence easterly along the
center line of East Elm Street to its intersection with the
center line of the old Smoky Hill River channel; thence
northwesterly, northeasterly, easterly and southeasterly
along the old Smoky Hill River Channel to its intersection
with the center line of East Elm Street; thence easterly
along the center line of East Elm Street to a point three
hundred feet (3001) east of the center line of North Ohio
Street; thence northerly on a line parallel with the center
line of North Ohio Street and three hundred feet (3001) east
thereof to a point which is two hundred feet (2001) north
and three hundred feet (3001) east of the southwest corner
of Section Six (6), Township Fourteen (14) South, Range
Two (2) West of the Sixth Principal Meridian (6th P.M.) in
Saline County, Kansas; thence westerly to a point which is
two hundred feet (2001) north and two hundred feet (200')
east. of the southwest corner of said Section Six (6); thence
northerly to a point which is three hundred feet (3001) north
and two hundred feet (2001) east of the southwest corner of
said Section Six (6) , the same point being three hundred
feet (3001) north of the centerline of East Pacific Avenue;
thence westerly on a line parallel with the center line of East
Pacific Avenue and three hundred feet (3001) north thereof
to the center line of North Front Street; thence northerly
along the center line of North Front Street to the center line
of East Harsh Avenue, extended from the west; thence
westerly along the center line of East Harsh Avenue,
extended, East Harsh Avenue and West Harsh Avenue to its
intersection with the center line of North Eighth Street;
thence northerly along the center line of North Eighth Street
to its intersection with the center line of West Euclid
Avenue; thence westerly along the center line of West Euclid
Avenue to its intersection with the center line of North
Ninth Street; thence northerly along the center line of North
Ninth Street to its intersection with the center line of the
Salina, Kansas Flood Protection Levee; thence westerly along
the center line of said Flood Protection Levee to its
intersection with the center line of North Tenth Street
extended from the south; thence southerly along the center
line of North Tenth Street extended and the center line of
North Tenth Street to its intersection with the center line of

West Harsh Avenue; thence westerly along the center line of
West Harsh Avenue to its intersection with the center line of
North Eleventh Street; thence southerly along the center line
of North Eleventh Street to its intersection with the center
line of West Pacific Avenue; thence westerly along the center
line of West Pacific Avenue to its intersection with center
.line of the old channel of Dry Creek; thence southerly and
southwesterly along the center line of the old channel of Dry
Creek to the south right-of-way line of the Atchison, Topeka
and Santa Fe (ATSF) Railway; thence westerly along the
south right-of-way line of the ATSF Railway to the south
right-of-way line of the Union Pacific Railroad (UPRR);
thence southwesterly along the south right-of-way line of the
UPRR to the west line of Section Eleven (11), Township
Fourteen (14) South, Range Three (3) West of the Sixth
Principal Meridian; thence southerly along said west line to
the south line of said Section Eleven (11); thence southerly
along the east line of Section Fifteen (15), Township
Fourteen (14) South, Range Three (3) West to the northeast
corner of the Southeast Quarter (SES) of said Section Fifteen
(15); thence westerly along the north line of the Southeast
Quarter (SES) of said Section Fifteen (15) to the west line of
said southeast quarter; thence southerly along the west line
of said southeast quarter a distance of approximately one
thousand six hundred seventy feet (1,6701) to the east
right-of-way line of Interstate Highway Number One Hundred
Thrity-five (1-135); thence southeasterly along the east
right-of-way line of said Highway 1-135 a distance of
approximately one thousand ninety feet (1,0901) to the center
line of West Crawford Street; thence easterly along the
center line of West Crawford Street to its intersection with
the center line of the Missouri Pacific Railroad; thence
northerly along the center line of the Missouri Pacific
Railroad to its intersection with the center line of Spruce
Street; thence easterly along the center line of Spruce
Street to its intersection with the center line of South
Phillips Street; thence northerly along the center line of
South Phillips Street and continuing along the center line of
North Phillips Street to its intersection with the center line
of West Ash Street; thence easterly along the center line of
West Ash Street to the point of beginning. Said tract
contains 1732.81 acres, more or less.
Tract 2. Beginning at a point where the west right-of-way
line of Arnold Avenue intersects the south right-of-way line
of Sutherland Road, thence South zero degrees six minutes
twenty-four seconds East (S01612411E) along the west right-
of-way line of Arnold Avenue a distance of three hundred
fifty-two feet (3521) thence South Eighty-nine degrees
fifty-three minutes thirty-six seconds West (S89053136"W) to
the security fence a distance of two hundred twenty feet
(220') , thence northerly along the security fence to the
south right-of-way line of Sutherland Road, thence east
along the south right-of-way line of Sutherland Road to the
point ' of beginning, containing 1.77 acres, more or less, all
located in the Schilling Subdivision of the City of Salina,
Saline County, Kansas.
Tract 3. Beginning at the southeast corner of the Northeast
Quarter (NEJ) of Section Three (3), Township Fifteen (15)
South', Range Three (3) West of the Sixth Principal Meridian
in Saline County, Kansas, thence South Eighty-nine degrees
twenty-seven minutes two seconds West (S89027102"W), along
the south line of said quarter section a distance of one
thousand two hundred fifty and eighty-three hundredths feet
(1,250.831) to the point of beginning; thence South
eighty-nine degrees twenty-seven minutes two seconds West
(S89027102"W) along the south line of said quarter section a
distance of one thousand one hundred twenty and three
hundredths feet (1,120.031); thence North zero degrees six
minutes twenty-four seconds West (N00006124"W) a distance
of seven hundred six and thirty-two hundredths feet
(706.321); thence North eighty-nine degrees fifty-three
minutes thirty-six seconds East (N89053136"E) a distance of
three hundred ninety feet (390.001); thence North zero
degrees six minutes twenty-four seconds.West (NO0006124"W)
a distance of seventy feet (70.00'); thence North eighty-nine
degrees fifty-three minutes. thirty-six seconds East
(N89153136"E) a distance of seven hundred thirty feet
(730.00'); thence South zero degrees six minutes twenty-four
seconds East (SOO°06124"E) a distance of seven hundred
sixty-seven and sixty-six hundredths feet (767.661) to the
point of beginning. Said tract contains 19.222 acres, more
or less.
Tract 4. Block Eleven (11), Schilling Subdivision (12 acres)
and a tract of land in the Southeast Quarter (SES) of
Section Thirty-four (34), Township Fourteen (14) South,
Range Three (3) Vilest of the Sixth Principal Meridian in
Saline County, Kansas, and more particularly described as
follows:
Beginning at a point lying two hundred seventy-eight
feet (2781) North zero degrees six minutes twenty-four
seconds West (NO006124"W) of the southwest corner of
said Block 11 and on the east line of Arnold Avenue;
thence North zero degrees six minutes twenty-four
seconds West (NO006124"W) along the said east line of
Arnold Avenue a distance of four hundred three feet
( 403') to the south line of General Jim Road; thence
North eighty-nine degrees fifty-three minutes thirty-six
seconds East (N89053136"E) along the south line of
General Jim Road, a distance of four hundred sixty feet
(4601) to a point lying five hundred eighty feet (580')
South eighty-nine degrees fifty-three minutes thirty-six
seconds West (S89053136"W) of the northeast corner of
Block Eleven (11); thence South zero degrees six
minutes twenty-four seconds East (SO006124"E) a
distance of four hundred three feet (4031) to a point
which is a corner of Block Eleven (11); thence South
eighty-nine degrees fifty-three minutes thirty-six
seconds West (S89053136"W) a distance of four hundred
sixty feet (4601) to the point of beginning. Said tract
contains 4.26 acres, making a total of 16.26 acres, more
or less, for the total area.
Tract 5. A portion of Block 16, beginning at the
intersection of the west right-of-way line of Scanlan Avenue
and the north right-of-way line of the diagonal drainage
ditch, thence north along the west right-of-way line of
Scanlan Avenue two hundred sixty-two and fifty-six
hundredths feet (262.561); thence west seven hundred
ninety-six and fifty-two hundredths feet (796.521), more or
less, to the east right-of-way line of Hein Avenue; thence
south along the east right-of-way line of Hein Avenue eight
hundred eighty-seven and seventy-nine hundredths feet
(887.791) to a point on the north right-of-way line of the
diagonal drainage ditch; thence northeasterly one thousand
eleven and eight hundredths feet (1,011.081) to the point of
beginning; containing 11.39 acres, more or less; in the Plat
of Schilling Subdivision; all in the Northeast Quarter (NE4)
of Section Thirty-four (34), Township Fourteen (14) South,
Range Three (3) West of the Sixth Principal Meridian in
Saline County, Kansas.
Tract 6. A tract of land in the Northeast Quarter (NES) of
Section Thirty-four (311), Township Fourteen (14) South,
Range Three (3) West of the Sixth Principal Meridian in
Saline County, Kansas, more particularly described as:
Commencing at the northeast corner of said quarter section;
thence North eighty-nine degrees forty-six minutes fifty-four
seconds West (S89046154"W) a distance of one thousand three
hundred forty-four feet (1,3441); thence South zero degrees
six minutes twenty-four seconds East (SO000612411) a distance
of one thousand fifty-one and thirty-eight hundredths feet
to the southwest corner of said tract and point of beginning;

thirty-six seconds East (N8905313611) a distance of four
hundred sixty-nine and ninety-seven hundredths feet
(469.971); thence North zero degrees six minutes twenty-four
seconds West (N00006124"W) a distance of five hundred
ninety-four and ninety-seven hundredths feet; thence South
fifty-one degrees fifty-seven minutes and thirty-six seconds
West (S51057136"W) a distance of five hundred ninety-five
and eighty-six hundredths feet; thence South zero degrees

distance of two hundred twenty-eight and sixty-six
hundredths feet (228.661) to the point of beginning (4.44
acres, more or less).
Tract 7. A tract of land in the Southeast Quarter (SES) of
Section Twenty-seven (27), Township Fourteen (14) South,
Range Three (3) West of the Sixth Principal Meridian in the
City of Salina, Saline County, Kansas, more particularly
described as follows: Commencing at the southwest corner of
said Southeast Quarter (SES); thence easterly on an assumed
bearing of South eighty-nine degrees forty-six minutes
fifty-four seconds East (S89046154"E) a distance of three
hundred twenty-two and sixty-four hundredths feet (322.641)
to a point on the west right-of-way line of Hein Avenue;
thence North zero degrees six minutes twenty-four seconds
West (NO006124"W) along said west right of way line, a
distance of three hundred sixty-nine and and forty-four
hundredths feet (369.441) to the point of beginning:
Thence continuing North zero degrees six minutes
twenty-four seconds West (NO006124"W) along said west
right of way line a distance of four hundred
twenty-five feet (425.00'); thence South eighty-nine
degrees fifty-three minutes thirty-six seconds West
(S89053136"W) a distance of two hundred forty-nine feet
(249.01); thence South zero degrees six minutes
twenty-four seconds East (SO006124"E) a distance of
four hundred twenty-five feet (4251); thence North
eighty-nine degrees fifty-three minutes thirty-six
seconds East (N89053136"E) a distance of two hundred
forty-nine feet (249.01) back to the point of beginning.
The above described tract of land contains 2.43 acres,
more or less.
WHEREAS, the area has a combined population of 5,621 which is 13.4%
of the population of the City of Salina as enumerated in the 1980 U.S. Census;
and
WHEREAS, the boundary of each area is continuous and the combined
areas encompass 13.70 of the area of the City of Salina; and
WHEREAS, the unemployment rate for the area is greater than 1j times
the average state rate of unemployment for the comparable time period; and
WHEREAS, the Board of Commissioners of the City of Salina, Kansas
finds that there is substantial deterioration, abandonment or demolition of
commercial and residential structures in the area; and
WHEREAS, the Board of Commissioners of the City of Salina, Kansas
has considered the eligibility requirements and certifies the correctness of the
supporting evidence; and
WHEREAS, the legal counsel has provided a written opinion of
conformance to the law for designation as an enterprise zone; SO NOW,
THEREFORE,
BE IT RESOLVED by the Governing Body of the City of Salina,
Kansas:
Section 1. That the areas hereinbefore described meet the
requirements for designation as an enterprise zone.

Section 2. That the Secretary of the Kansas Department of Economic
Development is hereby requested to approve these areas as an authorized
j enterprise zone consistent with K.S.A. 12-17,109.
Section 3. That
this Resolution shall be in
full
force and effect, and
Resolution Number 86-3832
is hereby repealed after
the
official designation by
the Kansas Department
of Economic Development
of
the Enterprise Zone
hereinbefore requested.
Adopted by the Board of Commissioners of the City of Salina, Kansas
and signed by the Mayor this 22nd day of September, 1986.
