85-3809 Designate Enterprise Zone1 n RESOLUTION NUMBER 85-3809 A RESOLUTION REQUESTING THAT PROPERTY IN THE CITY OF SALINA AND INDUSTRIAL PARK LAND OUTSIDE THE CORPORATE LIMITS OF THE CITY OF SALINA BE DESIGNATED AS AN ENTERPRISE ZONE AS AUTHOR- IZED BY K.S.A. 12-17,109; AND REPEALING RESOLUTION NUMBER 84-3697. WHEREAS, the following described area lies within the corporate limits of the City, of Salina, Kansas: Tract 1. Beginning at the southeast corner of the northeast quarter of Section 3, Township 15 South, Range 3 West of the 6th P.M.in Saline County, Kansas, thence S 890 27' 02" W. along the south line of said quarter section a distance of 1250.83' to the point of beginning: thence S 890 27' 02" W; along the south line of said quarter section, a distance of 1120.031; thence N 000 06' 24" W a distance of 706.32'; thence N 890 53' 36" E a distance of 390.001; thence N 000 06' 24" W a distance of 70.00'; thence N 890 53' 36" E a distance of 730.00'; thence S 000 06' 24" E a distance of 767.66' to point of beginning. Said tract contains 19.222 acres more or less. Tract 4. Block 11 of the Schilling Subdivision (12 acres) and a tract of land in the Southeast Quarter of Section 34, Town- ship 14 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas and more particularly described as follows: Beginning at the Northwest Corner of said Block 11 and on the east line of Arnold Avenue extended; thence north along the said east line of Arnold Avenue extended, a distance of 403 feet to the south line of General Jim Road extended; thence east along the south line of General Jim Road extended, a distance of 460 feet to the west line of Block 11; thence south along the west line of Block 11 a distance of 403 feet to a point which is a corner of Block 11; thence west along the north line of Block 11, a distance of 460 feet to the point of beginning and contains 4.26 acres, making a total of 16.26 acres more or less for the total area. A portion of Block 16, beginning at the intersection o the. west right-of-way line of Scanlan Avenue and the north right-of-way line of the diagonal drainage ditch, thence north along the west right-of-way line of Scanlan Avenue 262.56 feet; thence west 796.52 feet, more or less, to the east right-of-way line of Hein Avenue; thence south along the east right-of-way line of Hein Avenue 887.79 feet to a point on the north right- of-way line of the diagonal drainage ditch; thence northeaster- ly 1011.08 feet to the point of beginning; containing 11.385 acres, more or less; in the Plat of Schilling Subdivision; all in the Northeast Quarter (NEk) of Section Thirty-four (34), Township Fourteen (14) South, Range Three (3) West of the Sixth Principal Meridian in Saline County, Kansas. WHEREAS, the following described area lies outside the corporate limits of the City of Salina, Kansas; however, it is and has been an estab-lished and existing industrial park prior to April 28, 1983: . 1 1 1 Tract 7. Beginning at a point which is one thousand seventy feet 1,0701) south and two hundred seventy-five feet (275') east of the northwest corner of Section Twelve (12), Township fifteen (15) South, Range Three (3) West of the Sixth Principal Meridian (6th P.M.) in Saline County, Kansas; thence east nine hundred eighty feet (9801); thence south one thousand five hundred feet (1,5001); thence west eight hundred thirty feet (830'); thence north seven hundred fifteen feet (7151); thence west a distance of one hundred fifty feet (1501); thence north a distance of seven hundred eighty-five feet (785') to the point of beginning (Approximately 31.3 acres); Tract 8. All of that part of the South Half of the Northwest Quarter (S/2 NW/4) of Section One (1), Township Fifteen South (15S), Range Three West (3W) of the Sixth Principal Meridian in Saline County, Kansas, described as all of Lots Nineteen (19) through Thirty (30) inclusive, Block Two (2), Plat of Block 2 and Replat of Lots 1, 13, 21 and 22 of Block,1 South Indus- trial Area, in Saline County, Kansas; and a tract of land in the Southwest Quarter (SW/4) of Section One (1), Township Fifteen (15) South, Range Three (3) West of the Sixth Principal Meridian, in Saline County, Kansas, described as follows: Beginning at a point 150.80 feet east of the Northwest corner of said Southwest Quarter; thence south along the east right- of-way line of old U.S. Highway 81 (S. 9th Street), a distance of 300.00 feet; thence east along a line parallel to the north line of said Southwest Quarter, a distance of 2465.28 feet to a point on the west right-of-way line of the Union Pacific Railroad; thence north along the West line of said Railroad right-of-way, a distance of 300.00 feet to the north line of said Southwest Quarter; thence west along the north line of said Southwest Quarter a distance of 2465.15 feet to the point of beginning. Tract 9. A tract of land in the Southwest Quarter (SW/4) of Section One (1), Township Fifteen (15) South, Range Three (3) West of the Sixth Principal Merdian in Saline County, Kansas, more particularly described as follows: starting from the Southwest corner of said Southwest Quarter (SW/4), thence N 000 07' 06" E along the west line of said Southwest Quarter (SW/4) a distance of Thirteen Hundred Fifty-nine and Ninety-eight Hundredths (1359.98) feet; thence S 890 40' 52" E parallel with the South line of said Southwest Quarter (SW/4) a distance of one hundred sixty-four and Fifty -Seven Hundredths (164.57) feet to the point of beginning; said point of beginning being a point on the north line of an existing public right-of-way eighty and Thirty -Seven Hundredths (80.37) feet east of its interesection with the east right-of-way line of old U.S. Highway Eighty-one (81) (S. 9th St.) : Thence N 050 44' 25" E parallel with said east right-of-way line a distance of Five Hundred (500.00) feet: Thence S 891 40' 52" E parallel with the south line of said southwest quarter a distance of Eight Hundred Fifty and Fifty -Six Hundredths (850.56) feet: Thence S 000 03' 57" W parallel with the west line of the union pacific railroad right-of-way a distance of four hundred Ninety -Seven and Seventy -Seven Hundredths (497.77) feet; thence N 890 40' 52" W parallel with the south line of said Southwest Quarter (SW/4) a distance of Nine Hundred (900.00) feet to the point of beginning. Said tract of land containing ten (10.00) Acres. WHEREAS, both areas have a combined population of 4,594 which is 11.0% of the population of the City of Salina as enumerated in the 1980 U.S. Census; and 1 1 WHEREAS, the boundary of each area is continuous and the combined areas encompass 10.9% of the area of the City of Salina; and WHEREAS, the unemployment rate for the area is greater than 11 times the average state rate of unemployment for the comparable time period; and WHEREAS, the Board of Commissioners of the City of Salina, Kansas finds that there is substantial deterioration, abandonment or demolition of commercial and residential structures in the area; and WHEREAS, the board of Commissioners of the City of Salina, Kansas has considered the eligibility requirements and certifies the correctness of the supporting evidence; and WHEREAS, the legal counsel has provided a written opinion of confor- mance to the law for designation as an enterprise zone; SO NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the City of Salina, Kansas Section 1. That the areas hereinbefore described meet the require- ments for designation as an enterprise zone. Section .2. That the Secretary of the Kansas Department of Eco - nomic Development is hereby requested to approve these areas as an authori- zed enterprise zone consistent with K.S.A. 12-17,109. Section 3. That this Resolution shall be in full force and effect, and Resolution Number 84-3697 is hereby repealed after' the official desig- nation by the Kansas Department of Economic Development of the Enterprise Zone hereinbefore requested.
