RESOLUTION NUMBER 85-3801
. A RESOLUTION CONSENTING TO THE SALE AND TRANSFER BY THE
FIRST NATIONAL BANK AND TRUST COMPANY OF THE SALINA, KANSAS
LARSONBUILDING CENTER, INC. REVENUE BONDS OF 1982 TO THE J. R.
RAUH .TRUST AND CONSENTING TO THE RELEASE OF THE MORTGAGE ON
CERTAIN REAL ESTATE.
BE IT RESOLVED by the Governing Body of the City of Salina,
Kansas, that:
Section 1. The City of Salina, Kansas, hereby consents to the sale
and transfer by The First National Bank and Trust Company of the Larson
Building Center, Inc. Revenue Bonds of 1982 to the J. R. Rauh Trust on the
condition that prior to such transfer the J. R. Rauh Trust certifies to the City
that it is purchasing the bonds for investment purposes and that it has no
present intention, agreement or arrangement for distribution, transfer,
assignment, resale or fivision of its interest in said bonds in any manner which
would be inconsistent with the provisions of Ordinance Number 82-8917.
Section 2. The City of Salina, Kansas, consents that The First
National Bank and Trust Company execute a release of its mortgage, dated
August 3, 1982, and recorded in Book 349 of Mortgages at pages 889-890, upon
the specific condition that the release be approved in writing by all of the
registered owners of the Larson Building Center, Inc. Revenue Bonds of 1982 as
shown on the bond register.
Section 3. This resolution shall be in full force and effect from and
after its adoption.
Adopted by the Board of Commissioners and signed by the Mayor this
5th day of August, 1985.
