RESOLUTION NUMBER 85-3772
A RESOLUTION DETERMINING THE ADVISABILITY OF CURBING,
GUTTERING, PAVING, GRADING, STORM DRAINAGE, SANITARY SEWER AND
WATER MAIN IMPROVEMENTS, ESTIMATING THE COST THEREOF, DEFINING
THE BOUNDARIES OF THE IMPROVEMENT DISTRICT, METHOD OF ASSESSMENT,
AND APPORTIONING THE COST BETWEEN THE IMPROVEMENT DISTRICT AND
THE CITY AT LARGE.
WHEREAS, said improvements were requested by petition of those liable
for the cost of the same, said proceedings shall be without notice, as provided
by K.S.A. 12-6a04.
BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:
Section 1. That the Board of Commissioners of the City of Salina,
Kansas, hereB-y--Finds and finally determines that it is . advisable to make the
following improvements, to-wit:
Curbing, guttering, paving and grading of SEITZ DRIVE
from ' Applewood Lane to Pheasant Lane
Curbing, guttering, paving and grading of PHEASANT LANE
from Georgetown Road to the east line of Lot 6, Block 5,
Replat of Blocks 4, 10, 11, 12, Georgetown Addition to
the City of Salina, Kansas.
The installation of a storm drainage pipe in Seitz Drive
beginning at the intersection of Seitz Drive and Village
Lane; thence running south in Seitz Drive to the
intersection of Pheasant Lane.
Lateral Sanitary Sewer 642.
The installation of a 6" water main in Seitz Drive
The installation of a 6" water main in Georgetown Road
Section 2. The extent or boundaries of the proposed improvement
district to be assessed is:
That part of the City of Salina, Saline County, Kansas, described as
follows, to-wit:
All of Lots 5, 6, 7, 8, the East 19.3 feet of Lot 13,
all of Lots 14, 15, 16, 17, Block 3
The East 38.8 feet of Lot 5, all of Lots 6, 7, 8, 9, 10,
11, 12, 13, 14, 15, 16, 17, 18, 19, Block 4
Lots 1, 2, 3, 4, 5, 6, 7, Block 5
The South 31.2 feet of Lot 4, Lots 5, 6, 7, 8, 9,
North 65.7 feet of Lot 10, Block 6
All in the Replat of Blocks 4, 10, 11, 12, Georgetown Addition
to the Cityof Salina, Saline County, Kansas.
Section 3. The estimated or probable cost of such improvements is
$142,381.50.
Section 4. The apportionment of cost between the Improvement District
and the City' at Targe is as follows:
1. Costs chargeable to private property in the amount of
$142,381.50.
2. No Costs chargeable to the city at large.
Section 5. The assessment with accrued interest shall be levied as a
special tax upon the property included within the benefit district concurrent
with the general property taxes and shall be payable in ten (10) equal annual
installments.
Section 6. The method of assessment shall be based on the adjusted
front footage of lot of land and without regard to the buildings or
improvements of the land.
Section 7. That the advisability of the improvements set forth herein
is herebyestaGlished without notice and hearing, as authorized by K.S.A.
12-6a04(1).
Adopted by the Board of Commissioners and signed by the Mayor this
1st day of April, 1985.
