85-3768 Adv Eastgate & Dow Addition Imp1 1 1 (Published in The Salina Journal �VCV) 22- , 1985) RESOLUTION NUMBER 85-3768 A RESOLUTION DETERMINING THE ADVISABILITY OF CURBING, GUTTERING, PAVING, GRADING, SANITARY SEWER, WATER MAIN AND SERVICE' LINES, AND STORM DRAINAGE IMPROVEMENTS, ESTIMATING THE COST THEREOF, DEFINING THE BOUNDARIES OF THE IMPROVEMENT DISTRICT, METHOD OF ASSESSMENT, AND APPORTIONING THE COST BETWEEN THE IMPROVEMENT DISTRICT AND THE CITY -AT -LARGE. WHEREAS, said improvements were requested by petition of those liable for the cost of the same, said proceedings shall be without notice, as provided by K.S.A. 12-6a04. BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. That the Board of Commissioners of the City of Salina, Kansas, hereby finds and finally determines that it is advisable to make the following improvements, to -wit: Curbing, guttering, paving and grading of EASTGATE DRIVE from the intersection of Courtney Drive at Bradshaw Drive to the intersection of Courtney Drive at Ellsworth Avenue. Curbing, guttering, paving and grading of BELOIT AVENUE from Courtney Drive to Eastgate Drive. Curbing, guttering, paving and grading of COURTNEY DRIVE from the north line of Bradshaw Drive to the south line of Ellsworth Avenue. Lateral Sanitary Sewer 643. Lateral Sanitary Sewer 644. Lateral Sanitary Sewer 645. Lateral Sanitary Sewer 646. Lateral Sanitary Sewer 647. The installation of a 6" water main and service lines to serve Block 1; Block 2; Lots 1 through 5, Block 3; Lots 6 through 10, Block 4; all in Eastgate Addition to the City of Salina, Saline County, Kansas. Drainage system to serve all lots in Eastgate Addition to the City of Salina, Saline County, Kansas. Section 2. The extent or boundaries of the proposed improvement district to be assessed is: That part of the City of Salina, Saline County, Kansas, described as follows, to -wit: Lots 1 through 18, Block 1; Lots 1 through 9, Block 2; Lots I through 10, Block 3; Lots 1 through 10, Block 4; All in Eastgate Addition, Replat of Blocks 4, 5, 6, and 9 Dow Addition to the City of Salina, Saline County, Kansas. 1 1 11 Section 3. The estimated or probable cost of such improvements is $542,242.25. Section 4. The apportionment of cost between the Improvement District and the City -at -large is as follows: 1. Costs chargeable to. private property in the amount of $542,242.25. 2. 'No costs chargeable to the City -at -large. Section 5. The assessment with accrued interest shall be levied as a special tax upon the property included within the benefit district concurrent with the general property taxes and shall be payable in ten (10) equal annual installments. Section 6. The method of assessment shall be based on the adjusted front footage peach lot of land and without regard to the buildings or improvements of the land. Section 7. That the advisability of the improvements set forth herein is hereby esta fished without notice and hearing, as authorized by K.S.A. 12-6a04(1).
