RESOLUTION NUMBER 88-3993
A RESOLUTION APPROVING AND AUTHORIZING THE MAYOR TO
EXECUTE AN INTERLOCAL AGREEMENT WITH THE BOARD OF DIRECTORS OF
THE SALINA PUBLIC LIBRARY FOR THE PURPOSE OF AUTHORIZING THE
ISSUANCE OF GENERAL OBLIGATION BONDS OF THE CITY TO FINANCE ROOF
REPAIRS TO THE SALINA PUBLIC LIBRARY BUILDING.
WHEREAS, pursuant to K.S.A. 12-1736 and 1737, the City is
authorized to agree to repair a public building jointly or in cooperation with any
other governmental unit so empowered and to issue general obligation bonds of
the City for such purpose, and
WHEREAS, pursuant to K.S.A. 12-1215 et seq., the Library Board is
empowered to maintain the Salina Public . Library building, including major capital
improvements such as substantial roof repair, and
WHEREAS, the Salina Public Library building is in need of substantial
roof repair; and
WHEREAS, it is the desire of the City and the Library Board to enter
into this Interlocal Agreement providing for repair of the roof of the Salina
Public Library building and for the issuance of general obligation bonds of the
City for such purpose, SO NOW, THEREFORE
BE IT RESOLVED by the Governing Body of the City of Salina,
Kansas:
Section 1. Authorization of Interlocal Agreement. The Mayor is
hereby authorized to execute and the City Clerk to attest an Interlocal
Agreement with the Board of Directors of the Salina Public Library (referred to
as "the Library Board") for the purpose of financing substantial roof repairs to
the Salina Public Library building through the issuance of general obligation
bonds of the City, under authority of K.S.A. 12-1736 and 1737.
Section 2. Terms of Agreement. The Interlocal Agreement referred to
in Section 1 above shall provide that:

A. The City shall issue general obligation bonds in an amount not, to
exceed $140,000.00 on or about December 1, 1988,. and shall make
the proceeds from the sale of such bonds available to the Library
Board for the purpose of financing the cost of roof repairs to the
Salina Public Library building.
B. The bonds issued by the City under the Interlocal Agreement
shall mature in equal principal amounts annually over a period of
five (5) years.
C. The principal and interest payments due each year on the bonds
shall be paid by the Library Board's remittance to the City of
one-half (1/2)
of
the principal and
interest
due in that year on
or before.May

of the same year,
and the
other one-half (1/2)
on or before November 1 of the same year.

D. The Library Board shall also remit to the City for any direct
expenses of the City in conjunction with the issuance of the
bonds.
E. The Library Board's obligation to make such remittances shall be
an annual obligation of the Library Board and shall be payable
solely from funds budgeted and appropriated for that purpose
during the Library Board's then current budget year.
F. The Library Board shall undertake to enter into and administer
the contract necessary to carry out the completion of the roof
repair project for the Salina Public Library building and shall
apply the proceeds from the bonds of the City to be issued under
the interlocal Agreement toward the payment of such contract.
G. The joint undertaking provided for under the Interlocal
Agreement shall be administered cooperatively by the City
Manager and the Director of the Library Board.
Section 3. Approval by Attorney General. Upon adoption of this
resolution authorizing the proposed Interlocal Agreement and upon approval of
the proposed Interlocal Agreement by the Library Board, the City Attorney is
directed to submit the Interlocal Agreement for approval by the Kansas Attorney
General pursuant to the Kansas Interlocal Agreement Act. Upon such approval
by the Kansas Attorney General, the City Clerk is hereby directed to cause a
fully executed copy of the Interlocal Agreement to be recorded with the office of
the Secretary of State and with the office of the Saline County Register of
Deeds.
Section 4. Effective date. This resolution shall be in full force and
effect from and after its. adoption.
Adopted by the Board of Commissioners and signed by the Mayor this
22nd day of August, 1988.
