RESOLUTION NUMBER 89-4144
A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY CLERK OF
THE CITY OF SALINA, KANSAS, TO EXECUTE A SPECIAL WARRANTY DEED
CONVEYING TO THE LEE COMPANY OR ITS ASSIGNS CERTAIN REAL ESTATE
AND FACILITY PURSUANT TO LEASE DATED JANUARY 1, 1974.
WHEREAS, on the 1st day of January, 1974, the City of Salina,
Kansas, as the Landlord, entered into a Lease with the Lee Company, a
corporation, as Tenant, covering the following described real estate and facility,
to wit:
A tract of land lying in part of the Southeast Quarter (SEJ)
of Section Twenty-seven, Township Fourteen (14) South,
Range Three (3) West of the Sixth Principal Meridian, known
as part of Block Twenty-four (24) Schilling Addition of
Saline County, Kansas, and being more particularly
described as follows:
From the southeast corner of said Southeast Quarter
(SEJ) thence North zero degrees fifty minutes fifteen
seconds East (N..00050115"E.) along the East line of the
Southeast Quarter (SES) a distance of three hundred
sixty-three and ninety-three hundredths (363.93) feet
to the point of beginning, said point of beginning being
a point on the North line of a drainage right-of-way;
Thence South fifty-one degrees fifty-seven minutes
thirty-six seconds West (S.51057136"W.) along said
North line a distance of four hundred sixty-one and one
hundredth (461 .01) feet to the north right-of-way line
of Magnolia Road;
Thence North eighty-eight degrees twenty-nine minutes
five seconds (N.8802910511W.) along said north
right-of-way line a distance of three hundred fifteen
and seventeen hundredths (315.17) feet;
Thence North forty-one degrees twenty-six minutes five
seconds West (N.4102610511W.) along said north
right-of-way line, a distance of one hundred fifty-three
and fifty-one hundredths (153.51) feet to the east
right-of-way line of Centennial Road;
Thence North zero degrees six minutes fifty-three
seconds (N.0010615311W.) along said east right-of-way
line a distance of five hundred thirty-eight and
seventy-one hundredths (538.71) feet;
Thence South eighty-nine degrees forty-six minutes
fifty-four seconds East (S.89°4654"E.) parallel with the
South line of said Southeast Quarter (SES) a distance of
seven hundred eighty-six and thirty hundredths
(786.30) feet to the East line of said Southeast Quarter
(SEJ) ;
Thence South zero degrees fifty minutes fifteen seconds
West (S.0015011511W.) along said East line a distance of
three hundred seventy-five and ten hundredths
(375.10) feet to the point of beginning.
Said tract being subject to a Drainage Easement along
the East line of said Southeast quarter.
Said tract of land containing, ten and forty-nine
hundredths (10.49) acres.
WHEREAS, Article' XIV of said Lease Agreement grants the Tenant the
option to purchase said real estate upon full compliance with the terms of the
Lease, and
WHEREAS, the Tenant has indicated its desire to exercise the Option
to Purchase said real estate, SO NOW, THEREFORE

Kansas:
BE IT RESOLVED by the Governing Body of the City of Salina,
Section 1. That the Mayor and City Clerk of the City of Salina,
Kansas, are hereby authorized to execute a Special Warranty Deed to the above
described real estate and facility in favor of The Lee Company or its assigns
pursuant to Article XIV of the Lease Agreement dated January 1, 1974.
Section 2. That upon execution of the deed the City Attorney is
instructed to deliver the deed to counsel for The Lee Company, upon its full
compliance with all of the terms and conditions of that certain Lease Agreement
dated January 1, 1974, including payment of the option price determined to be
due pursuant to agreement dated April 19, 1974 by and between The Lee
Company and the City of Salina and certification of payment in full of Salina,
Kansas, The Lee Company Industrial Revenue Bonds of 1974 by the City's fiscal
agent, First National Bank and Trust Company.
Section 3. That this Resolution shall be in full force and effect from
and after its adoption.
Adopted by the Board of Commissioners and signed by the Mayor this
20th day of November, 1989.
